Los aspectos más novedosos de esta Sentencia se vinculan con la prueba de la causalidad, delimitando lo que hay que probar y valorando determinadas pruebas como el informe emitido por la Inspección de Trabajo y la \"autopsia psicológica\" aportada en el proceso.\u0000\u0000\u0000The Judgment of the Superior Court of Justice of Cantabria, subject to comment, is part of a jurisprudential trend that has been consolidated over time and that admits, exceptionally, the calification of worker suicide as an accident of work when causality is proven. La legislación estatal (artículo 48 EBEP) contempla la figura con reducción proporcional de las retribuciones correspondientes y el Tribunal Supremo considera que estamos ante una norma básica. Por lo tanto, el Decreto autonómico que convierte esa reducción de jornada en un permiso remunerado incurre en causa de nulidad y no puede aplicarse.\u0000\u0000\u0000There is discussion about the validity of a regional norm according to which the enjoyment of a permit for legal guardianship (for the care of a descendant under 12 years of age) does not entail a reduction in salary. Ni en relación con los elementos configuradores del accidente (\"con ocasión\" o \"por consecuencia\"), ni en relación con los elementos técnico-jurídicos que conforman la presunción afirmativa (\"el tiempo\" y \"en el lugar de trabajo\"). El TJUE falla que las disposiciones más favorables que establece la normativa nacional con respecto a la Directiva en lo que se refiere a la duración mínima del descanso semanal no pueden privar al trabajador de otros derechos que le concede esta Directiva, y más concretamente, del derecho al descanso diario. Concluye que el descanso diario debe concederse con independencia de la duración del descanso semanal establecida por la normativa nacional aplicable.\u0000\u0000The judgment under review concerns the interpretation of Articles 3 (daily rest) and 5 (weekly rest) of Directive 2003/88/EC of the European Parliament and of the Council of 4 November 2003 concerning certain aspects of the organisation of working time, in relation to Article 31(2) of the Charter of Fundamental Rights of the European Union. The CJEU rules that the more favourable provisions laid down by national legislation with respect to the Directive as regards the minimum weekly rest period cannot deprive the worker of other rights granted by that Directive, and more specifically, of the right to daily rest. La sentencia comentada sienta dos grandes principios: 1º) Cuando se impugnen los servicios mínimos, impuestos por la autoridad gubernativa, la competencia para conocer el litigio corresponde al orden jurisdiccional contencioso-administrativo. 2º) Cuando se cuestiona un comportamiento empresarial, relacionado con la ejecución de los servicios mínimos, el conocimiento del litigio corresponde a la jurisdicción social. A su vez, esa dualidad jurisdiccional conduce a que el plazo de prescripción para reclamar en el orden social no puede activarse hasta la firmeza de la sentencia contenciosa.\u0000The competent jurisdiction (social or contentious) to challenge the minimum services set by the Government Authority is discussed. The commented sentence establishes two main principles: 1º) When the minimum services imposed by the governmental authority are challenged, the competence to hear the dispute corresponds to the contentious-administrative jurisdictional order. 2º) When a business behavior is questioned, related to the execution of the minimum services, the knowledge of the litigation corresponds to the social jurisdiction.
