De no hacerlo de este modo, la empresa incurre en una obstrucción injustificada de los derechos de información de la representación sindical vulnerando el derecho fundamental a la libertad sindical en su vertiente de acción sindical. No obstante, se exponen algunas dudas sobre el alcance de dicha obligación legal y de su propia existencia.\u0000\u0000\u0000The social security contribution bulletins must be delivered to the union representation in time, without the workers' representation having to request them, and with the complete data (including the data in the NAF, IPF and CAF columns that identifies the employee), without the need for the consent of the workers as it is a legal obligation incumbent on the company. Tras un amplio análisis de la normativa anterior a la actualmente vigente, y a la jurisprudencia comunitaria y española, la Sala concluye que debe reconocerse el derecho al demandante, al amparo de una interpretación de la normativa vigente que debe tener en consideración todos los criterios de interpretación regulados en el Código Civil, y prestando especial atención al fortalecimiento del principio de no discriminación por circunstancias personales o familiares.\u0000\u0000The judgment which is the subject of commentary addresses the problem of the right of a worker who is a father to enjoy the breastfeeding leave recognised in the Workers' Statute Law when the mother does not work. El requisito discriminaba a las aspirantes mujeres al exigir una estatura mínima proporcionalmente mayor que a los hombres en relación con las respectivas estaturas medias, con perjudiciales efectos de exclusión de las mujeres de su empleo en la Policía, injustificados y desproporcionados. El Real Decreto 614/1995, de 21 de abril, ha sido después derogado por el Real Decreto 853/2022, de 11 de octubre, por el que se aprueba el Reglamento de los procesos selectivos y de formación de la Policía Nacional.\u0000\u0000The Judgment of the Contentious-Administrative Chamber, Fourth Section, of the Supreme Court annuls article 7.c) of Royal Decree 614/1995, of April 21, which approved the Regulation of the selection processes and formation of the National Corps of Police, which demanded, among others, the requirement of having a minimum height of 1.65 meters for men and 1.60 meters for women to be admitted to the practice of selective tests for admission to the National Police Corps. The requirement discriminated against female applicants by requiring a proportionally higher minimum height than men in relation to their respective average heights, with harmful effects of exclusion of women from their employment in the Police, unjustified and disproportionate. A su vez, el abono de esa pensión está temporalmente condicionado por las posibilidades de que quien la percibe obtenga ingresos propios. El Tribunal Supremo (Sala Primera) ha tomado en cuenta las dificultades que posee el acceso al mercado laboral cuando se ha cumplido la edad que permite percibir el \"subsidio de prejubilación\". En concreto, para sentar la doctrina de que en tales casos no procede fijar un límite temporal a la pensión compensatoria. Specifically, to establish the doctrine that in such cases it is not appropriate to set a temporary limit to the compensatory pension. Aunque ya la doctrina judicial española había entendido que la regla general de incompatibilidad de pensiones resultaba acorde con el principio de \"pérdida de una renta profesional\" (por lo que no puede protegerse a la vez con la percepción de dos prestaciones que tengan la misma finalidad de sustitución), también había insistido en que ese principio únicamente operaba dentro del Régimen General. De este modo, únicamente se podría admitir la compatibilidad entre pensiones que pertenezcan a distintos regímenes. Empero, la cuestión se vuelve más conflictiva al confrontar las proporciones respectivas de trabajadores afectados y los que no en relación a la supuesta diferencia de trabajo entre la mano de obra femenina comprendida en el ámbito de aplicación.
