La sentencia comentada precisa el alcance de esa obligación. Psychosocial risks at work are especially intense in those jobs characterized by high demands of responsibility and the continuous saturation of tasks, as is the case of the Judicial Career, where, precisely to prevent these risks, the Spanish General Council of the Judiciary has been obliged to regulate the workload for the purposes of occupational health of the members of the Judicial Career. Este pronunciamiento pondría freno a la práctica del INSS que obliga a que se señalen dos fechas inalterables de disfrute de la prestación en la solicitud. This appeal resolves that once the paternity allowance has been granted to the parent other than the mother by the INSS, the dates of the suspension of the employment contract indicated in the initial application can be altered because there is no legal or regulatory rule that does so prevent. El TS llega a una conclusión afirmativa tras repasar la jurisprudencia del TJUE y la normativa comunitaria y española aplicable, por considerar que tales bajas son por una causa que no responde a la voluntad del trabajador. The judgment under study deals with the problem of the number of workers that must be taken into account in order for the company to proceed with collective redundancies, and more precisely whether voluntary redundancies that have been encouraged by the company can be included in the calculation. La sentencia comentada concluye que no caben primas, gratificaciones, indemnizaciones o, en general, incentivos por jubilación anticipada para el rejuvenecimiento de la plantilla funcionarial. Esos incentivos tienen naturaleza retributiva y solo proceden si tienen la cobertura de una norma legal general, relativa a la remuneración de los funcionarios de la correspondiente Administración (Local, en el caso de policías municipales). La disposición adicional vigesimoprimera in fine de la Ley 30/1984, de 2 de agosto, de Medidas para la Reforma de la Función Pública, aun previendo medidas de incentivación de la jubilación anticipada, no hizo una regulación precisa para el supuesto de que dichas medidas tuvieran carácter retributivo y, por ello, no satisface la exigencia de que las gratificaciones por jubilación anticipada tengan cobertura en una norma legal de alcance general. Incentives for early retirement for municipal public employees who have a recognized coefficient reducing the retirement age due to their activity are discussed. The judgment concludes that there is no room for bonuses, gratuities, indemnities or, in general, incentives for early retirement for the rejuvenation of the civil service workforce. These incentives are remunerative in nature and are only applicable if they are covered by a general legal norm relating to the remuneration of civil servants of the corresponding Administration (Local, in the case of municipal police officers). La STSJ de Cantabria-SOC núm. 373/2023, de 19 de mayo, confirma que la trabajadora con reducción de jornada ha de percibir el 100 % de los complementos salariales de turnicidad y de exceso de tiempo de relevo; dicho de otro modo: la reducción de jornada por guarda legal no comporta la disminución de los referidos complementos salariales, cuya cuantía se mantiene íntegra. En Espagne, le paragraphe 6 de l'article 37 du Statut des Travailleurs (ET, 2015) reconnaît le droit des travailleurs comme des travailleuses à la réduction du temps de travail pour la garde d'un enfant âgé de moins de 12 ans. Cette réduction du temps de travail implique que la rémunération soit réduite dans la même proportion. La chambre sociale du Tribunal Supérieur de Justice de Cantabrie précise que la réduction du temps de travail n'entraîne pas une réduction parallèle de tous les primes qui figurent sur le bulletin de paie, mais seulement des primes liées à la durée du travail. The specific legal framework for telework ensures that the working conditions of teleworkers cannot be worse than those of face-to-face work. The employer is obliged to provide the means to cover the telework provision in the event of power or internet cuts, without teleworkers having to make up the working time affected by such incidents, or suffer any reduction in pay. Se cuestiona si en dicho contexto la falta de información y consulta de forma individual con los trabajadores constituye una incorrecta trasposición de la Directiva sobre despidos colectivos. Para el TJUE dicha legislación no se opone a la Directiva mencionada siempre y cuando la normativa nacional permita garantizar la plena eficacia de las garantías contempladas en la Directiva y la ausencia de designación de representantes no se impida por circunstancias ajenas a la voluntad de los trabajadores. The Romanian national legislation allows the company not to inform and consult individually the workers concerned on a collective redundancy project when the workers have not renewed their representatives after the expiry of their term of office when they had the possibility to do so. It is questioned whether in such a context the failure to inform and consult directly and individually with the workers constitutes an incorrect transposition of the Directive on collective redundancies.
