La sentencia comentada concluye que no caben primas, gratificaciones, indemnizaciones o, en general, incentivos por jubilación anticipada para el rejuvenecimiento de la plantilla funcionarial. La disposición adicional vigesimoprimera in fine de la Ley 30/1984, de 2 de agosto, de Medidas para la Reforma de la Función Pública, aun previendo medidas de incentivación de la jubilación anticipada, no hizo una regulación precisa para el supuesto de que dichas medidas tuvieran carácter retributivo y, por ello, no satisface la exigencia de que las gratificaciones por jubilación anticipada tengan cobertura en una norma legal de alcance general. Incentives for early retirement for municipal public employees who have a recognized coefficient reducing the retirement age due to their activity are discussed. The judgment concludes that there is no room for bonuses, gratuities, indemnities or, in general, incentives for early retirement for the rejuvenation of the civil service workforce. These incentives are remunerative in nature and are only applicable if they are covered by a general legal norm relating to the remuneration of civil servants of the corresponding Administration (Local, in the case of municipal police officers).
