Si la respuesta es afirmativa, el trabajador tendría una expectativa de privacidad en relación con las actividades que desarrolla en él, siendo inaceptables, por tanto, las fotografías que haya obtenido el detective en ese lugar. Si, por el contrario, la respuesta es negativa, la prueba aportada puede servir para justificar el despido disciplinario por desarrollar actividades incompatibles con las dolencias con las que cursa la enfermedad que le ha llevada a suspender su contrato de trabajo por incapacidad temporal.\u0000\u0000\u0000It addresses whether the garden adjacent to the worker's private home can be considered an opaque space reserved for third parties. Accidente de trabajo \"en misión\": no lo es la caída mientras la persona se toma una ducha en el hotel de alojamiento a que se acude con ocasión de un desplazamiento (\"en misión\") para asistir a un evento relacionado directamente con la actividad profesional: un seminario formativo. {"title":"Sobre la pérdida de la habilitación para tareas de Seguridad Privada.","authors":"Antonio V. Sempere Navarro","doi":"10.55104/rjl_00453","DOIUrl":"https://doi.org/10.55104/rjl_00453","url":null,"abstract":"El personal de Seguridad Privada posee cada vez más relevancia en nuestras sociedades y la propia índole de sus tareas explica que el Estado desee controlarlas. Una de estas manifestaciones viene dada por la necesidad de contar con una habilitación gubernativa para poder desempeñarse como Vigilante de Seguridad Privada. Otra consecuencia viene dada por la incompatibilidad entre ese cometido y la comisión de conductas delictivas. Se discute ahora sobre el modo en que la existencia de una condena penal incide en la privación de esas habilitaciones. La sentencia recurrida sienta tres grandes conclusiones: 1ª) La Administración viene obligada a retirar el permiso cuando existe la condena penal. 2ª) La eventual cancelación de los antecedentes penales no impide que se pierda la habilitación, incluso si sobreviene antes de finalizar el expediente administrativo. 3º) Tras cancelarse los antecedentes penales es posible solicitar una nueva habilitación, pero no queda automáticamente rehabilitada la primigenia. Con ese trasfondo el comentario recuerda las consecuencias que posee la pérdida de la habilitación desde la perspectiva de la relación laboral.\u0000Private Security personnel are becoming increasingly important in our societies and the very nature of their tasks explains why the State wishes to control them. One of these manifestations is given by the need to have a government authorization to be able to work as a Private Security Guard. Another consequence is given by the incompatibility between that task and the commission of criminal conduct. The way in which the existence of a criminal conviction affects the deprivation of these authorizations is now being discussed. The sentence under appeal establishes three main conclusions: 1) The Administration is obliged to withdraw the permit when there is a criminal conviction. 2) The eventual cancellation of the criminal record does not prevent the authorization from being lost, even if it occurs before the end of the administrative file. 3) After canceling the criminal record, it is possible to request a new authorization, but the original one is not automatically rehabilitated.
