La cuestión de fondo que aborda el Tribunal se centra en la determinación del derecho aplicable al reconocimiento de la pensión de viudedad en situaciones de crisis familiar al momento de la entrada en vigor de la Ley 40/2007, de 4 de diciembre, de medidas en materia de Seguridad Social, ponderando la trascendencia que a estos efectos representa la dilación del órgano judicial al tiempo de dictar la correspondiente sentencia en los procesos de disolución matrimonial y separación de mutuo de acuerdo. The substantive issue addressed by the Court focuses on the determination of the law applicable to the recognition of the widow's pension in situations of family crisis at the time of the entry into force of Law 40/2007 of 4 December on measures in the field of Social Security (that is, on 1 January 2008, in accordance with its sixth final provision), weighing the importance that for these purposes represents the delay of the judicial body at the time of issuing the corresponding sentence in the processes of marital dissolution by mutual agreement.
