Abstract
Se discute sobre la validez de una norma autonómica conforme a la cual el disfrute de un permiso por guarda legal (por cuidado de descendiente menor de 12 años) no comporta disminución retributiva. La legislación estatal (artículo 48 EBEP) contempla la figura con reducción proporcional de las retribuciones correspondientes y el Tribunal Supremo considera que estamos ante una norma básica.
