This research is legal research with a statutory, conceptual, and case approach. The results of this study found that Article 18 Paragraf 4 of the 1945 Constitution of the Republic of Indonesia was formulated flexibly with open texture and opened legal policy. Using the original intent of grammatical interpretation, it was found that 7 (seven) meanings of Article 18 Paragraf 4 of the 1945 Constitution of the Republic of Indonesia were 1) the regional head was the chief of local government, (2) Regional heads must exist and the number is 1 (one) person, (3) the deputy of regional head was not mandatory. If there can be 1 (one) or more people, (4) the regional head must be democratically elected, either directly by the people or by the local representative body, (5) the regional head candidate does not have to be submitted by a political party or a combination of political parties so that it can be an individual candidate, (6) the elected regional head is sufficient to obtain a simple majority of votes, and (7) the deputy of regional head is not obliged to be democratically elected,  It is not mandatory to be selected in 1 (one) package of candidate pairs with the regional head, and can be appointed. \u0000Keywords: democratic; election; regional head \u0000Abstrak \u0000Tujuan penelitian ini adalah untuk menemukan makna Pasal 18 ayat (4) UUD NRI 1945. Penelitian ini adalah penelitian hukum dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian ini menemukan bahwa Pasal 18 ayat (4) UUD NRI 1945 dirumuskan secara fleksibel dengan sifat open texture dan opened legal policy. Dengan menggunakan penafsiran original intent gramtikal, ditemukan 7 (tujuh) makna Pasal 18 ayat (4) UUD NRI 1945 yakni 1) kepala daerah merupakan chief of local government, (2) kepala daerah wajib ada dan jumlahnya 1 (satu) orang, (3) wakil kepala daerah tidak wajib ada. As an effort to answer this problem, BPJS Kesehatan issued Regulation of the Director of Health Insurance Guarantee for BPJS Kesehatan No. 2 of 2018and Regulation of BPJS Kesehatan number 1 of 2020. The research method used in this study uses a normative juridical method, this research was conducted by analyzing library materials. or the second data is compared with the applicable regulations related to guarantees for the fulfillment of the rights of BPJS participants in cataract surgery services in hospitals. Implications of BPJS Kesehatan Health Insurance Director Regulation No.2 of 2018 Concerning Cataract Service Guarantee In BPJS Kesehatan regulation No.1 of 2020there are difficulties for BPJS patients in carrying out cataract surgery, namely that they can only perform cataract surgery with cataractsufferers with medical indications in the form of decrease in visual acuity with vision less than 6/18, so that in this case it reduces the rights of BPJS patients to receive guarantees for cataract surgery services through BPJS completely. Legal protection for BPJS patients whorequire medical action in the form of cataract surgery at the hospital in the form of preventive legal protection is very weak. Dispute resolution through non-litigation channels can use mediation as an effort to resolve disputes. Mediation itself is a simple and practical effort in resolving disputes which is preceded by finding and bringing together agreements to resolve problems, assisted by one or more mediators who are neutral and only function as facilitators. \u0000Keywords: cataract; cataract surgery; cataract operation garantee \u0000Abstrak \u0000Terbatasnya kemampuan finansial BPJS Kesehatan merupakan salah satu masalah yang dihadapi program Jaminan Kesehatan Nasional (JKN). Sebagai upaya menjawab persoalan itu BPJS Kesehatan menerbitkan Peraturan Direktur Jaminan Pelayanan Kesehatan BPJS Kesehatan No.2 Tahun 2018 dan Peratutran BPJS Kesehatan nomer 1 tahun 2020. Metode penelitian yang digunakan pada penelitian inimenggunakan metode yuridis normatif, penelitian ini dilakukan dengan menganalisis bahan-bahan pustaka atau data sekunder di bandingkan dengan perundang-undangan yang berlaku terkait dengan jaminan pemenuhan hak peserta BPJS dalam layanan operasi katarakdi rumah sakit. Farid","doi":"10.30996/dih.v19i1.7387","DOIUrl":"https://doi.org/10.30996/dih.v19i1.7387","url":null,"abstract":"Abstract \u0000This paper aims to provide a description of the legal issues that arise, including; to analyze the legal relationship that exists between online drivers and application provider companies and to analyze changes in the status of a partnership legal relationship to a working relationship in the perspective of Indonesian labor law. The research method used is legal research. The results and discussion obtained through the legal materials and approaches used show that: 1) the legal relationship that exists between online drivers and application provider companies is a partnership relationship regulated in Law Number 20 of 2008 concerning Micro, Small and Medium Enterprises Medium as amended in Law Number 11 of 2020 concerning Job Creation with elements consisting of; cooperation either directly or indirectly; there are four principles (mutual need, trust, strengthen, and benefit); presence of business actors; 2) the partnership relationship that is formed between online drivers and application provider companies is different from the work relationship as stipulated in Article 1 number 15 of Law Number 13 of 2003 concerning Manpower as amended in Law Number 11 of 2020 concerning Job Creation, so that the concept of disguised employment relations and dependent employment relations (disguised employment/dependent self-employment) regulated by the International Labor Organization (hereinafter referred to as the ILO) concerning non-standard forms of employment in 2015. \u0000Keywords: employment law; employment relationship; partnership relationship \u0000Abstrak \u0000Tulisan ini bertujuan untuk memberikan perskripsi pada isu hukum yang muncul, antara lain; untuk menganalisis hubungan hukum yang terjalin antara driver online dengan perusahaan penyedia aplikasi dan untuk menganalisis perubahan status hubungan hukum kemitraan menjadi hubungan kerja dalam perspektif hukum ketenagakerjaan Indonesia. Metode penelitian yang digunakan adalah penelitian hukum. Metode penelitian yang digunakan yaitu metode yuridis normatif, yang bersifat analitis preskriptif, denganpendekatan undang-undang, kasus, dan perbandingan hukum. Tulisan ini tidak hanya membahas ganti rugi immateriil menurut KUHPerdata atas dasar tanggung jawab perbuatan melawan hukum saja, tetapi juga akan dibahas ganti rugi immateriil atas dasartanggung jawab kontraktual, serta perbandingannya dengan ketentuan dalam NBW. Berdasarkan putusan yang dianalisis, lingkup ganti rugi immateriil adalah adanya rasa trauma, terciderainya psikologis, tercemarnya nama baik. Lingkup lainnya menurut Arrest Hooge Raad dan yurisprudensi yaitu kehilangan kenikmatan atas suatu ketenangan yang disebabkan tetangganya atau berkurangnyakenikmatan orang atas hak-haknya atas kekayaannya, penderitaan akibat kecelakaan dan hilangnya kebahagiaan hidup. Perbandingan terkait ganti rugi dalam KUHPerdata dan NBW yaitu, mengenai persamaan, bahwa sifat pengaturan ganti rugi yang merupakan hukum pelengkap, prinsip ganti rugi mengembalikan keadaan seakan tidak terjadi wanprestasi/PMH, adanya hubungan kausal antara kerugian dan kesalahan/ wanprestasi, serta adanya kebebasan hakim dalam menilai besaran ganti rugi. Perbedaanya, bahwa NBW mengaturganti rugi secara umum yang dapat diterapkan terhadap jenis pertanggungjawaban dalam NBW, ganti rugi dalam NBW terdiri dari materiil dan immateriil (termasuk penjelasan lingkupnya), NBW mengatur bentuk ganti rugi, adanya wewenang hakim dalam menilainominal ganti rugi yang disepakati para pihak, kerugian yang mungkin timbul dikemudian hari termasuk jika ada klaim asuransi, pihak ketiga yang ikut dirugikan, serta pihak yang dapat mengajukan ganti rugi. \u0000Kata kunci: ganti rugi; immateriil; pengaturan \u0000Abstract \u0000This paper aims to analyze the scope of immaterial compensation in court decisions as well as a comparison of compensation in the Civil Code and NBW. The research method used is normative juridical method, prescriptive analytical, with statutory, case and comparative law approaches. This paper does not only discuss immaterial compensation according to the Civil Code based on unlawful actsresponsibility, but also discusses immaterial compensation based on contractual responsibility, as well as its comparison with the provisions in the NBW. Based on the court decisions analyzed, the scope of immaterial compensation is the existence of trauma, psychological injury, and defamation of reputation. Another scope according to Arrest Hooge Raad and jurisprudence is losing the enjoyment of a peace caused by neighbors or reduced enjoyment of people over their rights of their wealth, suffering due to accidents and loss of happiness in life. Researchers use normative juridical methods through statutory approaches to examine the legal ratio of related laws. Next, the researcher applied qualitative analysis. The results of this study found that the KUHP accommodates living laws and unwritten legal norms in harmony with the principle of legality, therefore the Government must immediately stipulate them by considering everything. Article 1 paragraph (1) of the Criminal Code stipulates the principle of legality, that is, no act can be punished except under pre-existing criminal law provisions. However, Article 5 paragraph (1) of UU No.48/2009 stipulates that judges must explore, follow, and understand the living legal norms and values felt by society. The novelty of this legal research is to analyze norms and values that are unwritten and not promulgated like written law in upholding a sense of justice in society, and the UU No.48/2009 has obligated judges to pay attention to ongeschreven recht a person can be punished based on the law that lives in society, even though the law does not specify explicitly that the act is a criminal act. \u0000Keywords: justice; legality principle; living law \u0000Abstrak \u0000Penelitian ini bertujuan untuk menemukan jalan tengah antara asas legalitas dan norma tidak tertulis dalam rangka pemenuhan rasa keadilan seperti yang diamanatkan oleh Undang-Undang tentang Kekuasaan Kehakiman. Peneliti menggunakan metode yuridis normatif melalui pendekatan perundang-undangan untuk mengkaji ratio legis Undang-Undang terkait. Selanjutnya, peneliti menerapkan analisis kualitatif. Hasil penelitian ini menemukan bahwa KUHP mengakomodir hukum yang hidup dan norma hukum yang tidak tertulis secara serasi dengan asas legalitas, oleh karena itu Pemerintah harus segera menetapkannya dengan mempertimbangkan segala sesuatunya. Pasal 1 ayat (1) KUHP menetapkan asas legalitas, yaitu tidak ada perbuatan yang dapat dipidana kecuali dengan ketentuan hukum pidana yang telah ada sebelumnya. Namun, Pasal 5 ayat (1) UU No.48/2009mengatur bahwa hakim harus menggali, mengikuti, dan memahami norma dan nilai hukum yang hidup yang dirasakan masyarakat. Specifically, this research tries to examine issues related to consumer protection according to Law No.8/1999 in relation to investment activities using crypto assets. The research method uses normative juridical research methods based on juridical aspects such as norms, regulations, and legal theories related to crypto asset investment obtained from scientific papers, books, online media and others related to the object of study under study, namely consumer protection against investment activities using crypto assets. This research tries to explore the urgency behind the need for amendments as well as urging the government to make new, more comprehensive regulations regarding consumer protection in crypto asset investment, given the growth of investors which continues to increase from year to year. Problems also arise because the current Law No.8/1999 existed long before the digital transaction model emerged as it is now so that aspects of legal novelty are needed to ensure legal certainty for the community as a whole in every economic transaction activity, both conventional and digital. \u0000Keywords:; consumer protection; crypto assets; investment \u0000Abstrak \u0000Perkembangan teknologi finansial terus menghasilkan berbagai inovasi khususnya pada produk investasi aset digital yaitu investasi menggunakan aset kripto. Penelitian ini bertujuan untuk mengkaji permasalahan berkaitan dengan perlindungan konsumen menurut UU No.8/1999 dalam hubungannya dengan kegiatan investasi menggunakan aset kripto. Metode penelitian menggunakan metode penelitian yuridis normatif yang berlandaskan pada aspek yuridis seperti norma-norma, peraturan-peraturan, dan teori hukum yang berhubungan dengan investasi aset kripto yang diperoleh dari karya ilmiah, buku, media online dan lain sebagainya berkaitan dengan objek kajian yang diteliti yakni perlindungan konsumen terhadap kegiatan investasi menggunakan aset kripto. Penelitian ini mencoba mengupas urgensi apa saja yang melatarbelakangi perlunya dilakukan amandemen sekaligus mendesak agar pemerintah membuat peraturan baru yang lebih komperhensif mengenai perlindungan konsumen pada investasi aset kripto, mengingat pertumbuhan investor yang terus meningkat dari tahun ke tahun. Problematika pun muncul karena UU No.8/1999 yang berlaku saat ini telah ada jauh sebelum model transaksi digital muncul seperti sekarang sehingga diperlukan aspek kebaharuan hukum demi menjamin kepastian hukum bagi masyarakat secara menyeluruh dalam setiap kegiatan transaksi ekonomi baik yang bersifat konvensional maupun digital. Hasil penelitian ini menunjukkan bahwa UU No.8/1999 dirasa belum dapat menjadi payung hukum bagi perlindungan konsumen pengguna aset kripto di Indonesia. Indigenous peoples' land which is used as the object of infrastructure development without prior approval can result in violation of the rights of indigenous peoples. By using a normative juridical method, this research focuses on reviewing the approval of indigenous peoples whose land is the object of infrastructure development in the public interest. This then becomes important because to what extent is the definition of public interest formulated in the phrase the interests of the State and common interests often lead to prolonged conflicts. The redefinition of public interest by using the concept of the welfare state approach is then deemed relevant for the creation of a responsive land law politics. \u0000Keywords: culture; development infrastructure; public interest \u0000Abstrak \u0000Indonesia sebagai negara berkembang memerlukan pembangunan infrastruktur yang maksimal demi kepentingan umum atau dengan kata lain demi mewujudkan kesejaheraan rakyat. Tanah masyarakat adat yang dijadikan objek pembangunan infrastruktur tanpa adanya persetujuan terlebih dahulu dapat menimbulkan pencideraan hak masyarakat adat. Dengan menggunakan metode yuridis normatif, peneltian ini fokus mengkaji terkait persetujuan dari masyarakat hukum adat yang tanahnya dijadikan objek dalam pembangunan infrastruktur demi kepentingan umum. Hal ini kemudian menjadi penting karena sejauh apa definisi kepentingan umum yang dirumuskan dalam frasa kepentingan Negara dan kepentingan bersama itu sering kali meimbulkan konflik berkepanjangan. As a result of the legal discrepancy in the implementation of the corruption trial, the community loses accountability and doubts the credibility of state officials in enforcing the law on corruption. Positive law regulates material corruption which is more profitable for corruptors so that the implementation of a simple, fast and low-cost, collusion-free judiciary cannot be carried out. Since Perma No.1/2020 was promulgated, it has not reduced the criminalization of corruption cases in terms of light sentences, which should have been eradicated in extra ordinary measures. Corruption trials have precedents in the form of decisions by previous courts that create legal loopholes for judges to determine the same decision, namely light sentences against perpetrators of corruption. The researchmethod used in this research is normative legal research and uses a research approach including statutory approach, conceptual approach, and case approach. The results of this study indicate that Perma No.1/2020 has no value of justice from a societal perspective and after theSupreme Court regulation was promulgated for more than a year it is known that this regulation is optional and does not bind judges to be guided by Perma No.1/2020. Therefore, Perma No.1/2020 must have its material formulation changed and judicially reviewed by thesupreme court with the aim of Perma No.1/2020 the normative material is more proportional, of better quality and produces decisions withoutdisparities in corruption cases with the same characteristics to realize future rule of law. \u0000Keywords: criminal guidelines; Supreme Court regulations; value of justice \u0000Abstrak \u0000Peradilan tindak pidana korupsi di Indonesia tidak sepenuhnya berjalan sesuai dengan norma hukum yang berlaku, disebabkan oleh penyimpangan norma sehingga kolusi terjadi. Akibat dari kesenjangan hukum pada implementasi peradilan tindak pidana korupsi masyarakat kehilangan akuntabilitas dan meragukan kredibilitas aparat negara dalam penegakan hukum tindak pidana korupsi. Hukum positif mengatur korupsi materinya lebih menguntungkan terhadap pelaku korupsi sehingga implementasi peradilan sederhana, cepat, dan biaya ringan bebas kolusi tidak dapat terlaksana. The contract can give rise to rights and obligations for the parties who make the contract. This the contract plays an important role in doing business in Indonesia. This condition is the background of this research in order to find out how the stages of designing a business contract and how to make a business contract structure. This research uses normative legal research with a concept and law approach. The analysis of legal materials was carried out by descriptive, interpretative, evaluative and argumentative analysis. The results showed that the contract design stages consisted of the pre-contract stage, the contract signing stage and the post-contract stage. The parties to an agreement must look at the principles that form the basis of the contract made. The principles in question, such as understanding the elements of the agreement, the principle of the agreement and the legal terms of an agreement, need to be careful and thorough by the parties who make a contract/agreement in designing a good and correct business contract structure. In addition, it must meet procedural requirements, namely fulfilling subjective and objective requirements. A good contract must be clear and detailed, regarding the subject, object and obligations of the parties along with the sanctions imposed on the parties, as well as the clarity of the ways and procedures for implementing sanctions, and not contradicting all legal norms related to the contract. \u0000Keywords: contract design; economic activities; UMKM. \u0000Abstrak \u0000Dalam kegiatan UMKM di Desa Minggirsari Kabupaten Blitar, kontrak merupakan kerangka dasar yang digunakan sebagai bingkai dari hubungan bagi para pelaku ekonomi. Kontrak dapat menimbulkan hak dan kewajiban bagi para pihak yang membuat kontrak tersebut. Dengan demikian kontrak sangat berperan penting dalam berbisnis di Indonesia. Kondisi ini melatar belakangi penelitian ini dalam rangka mengetahui bagaimana tahapan perancangan kontrak bisnis dan bagaimana pembuatan struktur kontrak bisnis. Penelitian ini mempergunakan jenis penelitian hukum normatif dengan pendekatan konsep dan undang-undang. Analisis bahan hukum dilakukan secara deskriptif, interpretatif, evaluatif dan argumentatif analisis. Hasil penelitian menunjukkan tahapan perancangan kontrak terdiri dari tahap prakontrak, tahap penandatangan kontrak dan tahap pasca kontrak. Pihak-pihak yang melakukan suatu perjanjian harus melihat prinsip yang menjadi dasar pada kontrak yang dibuat. Prinsip yang dimaksud seperti paham akan unsur dari perjanjian, asas dari perjanjian serta syarat sahnya suatu perjanjian, perlu cermat dan teliti oleh pihak-pihak yang melakukan suatu kontrak/perjanjian dalam merancang pembuatan struktur kontrak bisnis yang baik dan benar. This research is a normative legal research with a statutory and conceptual approach. The results of the study found that in Minggirsari Village there are many tourist attractions where tourists can enjoy these tourist destinations. However, there are various kinds of problems regarding the environment of these tourist attractions. There are various tourist attractions that still do not have a clear permit. Then there are various empty buildings even though if these buildings are addressed they can potentially become buildings that can be used as tourist attractions. Referring to Law Number 32 of 2009 concerning Environmental Protection and Management, local governments can manage the place into a clean tourist spot while taking into account the aspirations of the community and being participatory by involving all interested parties in environmental management so that the place can be attractive. the attention of the tourists. Penelitian ini adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menemukan bahwa di Desa Minggirsari terdapat banyak sekali tempat wisata di mana para wisatawan dapat menikmati destinasi wisata tersebut. Akan tetapi, terdapat berbagai macam permasalahan mengenai lingkungan dari tempat wisata tersebut. Terdapat berbagai tempat wisata yang masih belum memiliki izin yang jelas. Kemudian terdapat berbagai bangunan yang kosong padahal jika bangunan tersebut dibenahi dapat berpotensi sebagai bangunan yang dapat dijadikan objek wisata. Mengacu pada Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup, pemerintah daerah dapat mengelola tempat tersebut menjadi tempat wisata yang bersih dengan tetap memperhatikan aspirasi dari masyarakat dan bersifat partisipasif dengan melibatkan semua pihak yang berkepentingan dalam pengelolaan lingkungan agar tempat tersebut dapat menarik perhatian para wisatawan.
