Because the purpose of marriage is to realize the sakinah, mawaddah, warahmah household life. In mazhab Syafi’i , father and grandfather are guardians of mujbir who have the right to marry their child or granddaughter who is still aa girl without the need to ask permission from the girl or graandchild. Indonesia itself is a country with a majority people with islamic prinsiples, so here it discusses the opinion of Imam Syafii about ijbar, that is Imam Syafii requires that a father be a guardian of mujbir, but only for childern who are still girls (small or adult). In article 71 letter F of the Islamic law compilation, it is explained that a person can cancel a marriage carried out by force. KHI disagress with Imam Syafii, but in this case the background of coercion is in a different point of view. With this, it is interesting to do research with the title of the concept of ijbar madzhab Syafi’i on article 71 letter f concerning the cancellation of marriages.To obtain the data, the data collection method is used by looking for library materils related to Syafiiyah fiqh and Islamic law compilation then the collected data is analyzed by comparative analysis methods and with normative juridical approaches. The focus of the problem in the preparation of this thesis is concept of ijbar madzhab Syafi’i on article 71 letter f concerning the cancellation of marriages. With thw aim of compiling this to knowt consesnsus of Syafi’i Islamic jurisprudence towards the compilation of Islamic law.The result of this study that the concept of ijbar rights in fiqh Syafi’i is not the same as the compilation of islmic law, in the concept of ijbar Syafi’i wali mujbir does not apply to widows, even thought they are still young, because ijbar is meant for girls. This ijbar concept is also different from KHI in article 71 which states that mrriage can be canceled if the marriage is carried out by forc, in the KHI of marriage is carried out by force is because this action or threat that causes marriage to be canceled, is different from the concept of ijbar Syafi’i which is intended for benefit for the child or grandchildren.Perkawinan merupakan ibadah, dalam Islam perkawinan adalah akad yang sangat kuat untuk mentaati perintah Allah, karena tujuan perkawinan untuk mewujudkan kehidupan rumah tangga yang sakinah, mawaddah dan rahmah. In analyzing the data, the authors used qualitative analysis, namely the analysis of the discussion around the implementation of inheritance for adopted children in Petekeyan village.The point of view used as an approach in the preparation of this thesis is a case study approach. A case study is a research strategy in which the researcher carefully investigates a program, event, activity, process, or group of individuals. The results of this study indicate that based on the results of research, adoption in Petekeyan village does not break the kinship relationship between adopted children and their biological parents and adopted children are also included in the kinship of adoptive parents. Adopted children in Petekeyan village still inherit from their adoptive parents as well as their biological parents. The right to inherit an adopted child against the inheritance of his adoptive parents, namely if the heir does not have biological children, it will be determined by his immediate family or other heirs by looking at the things that have been carried out by the adopted child towards his obligations to his adoptive parents. However, if the heir has biological children, it will be determined by deliberation between the adopted child and the biological child. Adoption of children in Petekeyan village is the same as adopting children in society in general, which can be taken from within the family itself or from outside the family. Inheritance that is carried out in Petekeyan village in general is the giving of inheritance directly from the heir to his heirs while the heir is still alive, in other words, giving inheritance by way of a grant. However, until now there are still Islamic financial institutions that are less aware of the importance of managing cash waqf. We need to know that cash waqf has benefits that can be obtained by the wider community and for the long term. In contrast to waqf in general, which is only in the form of immovable objects such as buildings and land or other immovable objects whose benefits are only felt by some people who are around the waqf land. Therefore, the authors are interested in examining the Juridical Analysis of the Implementation of Cash Waqf at BMT Mitra Muamalah Ngabul Jepara in 2018. The purpose of this study was to determine the management of cash waqf at BMT Mitra MU and also to find out whether the management of cash waqf at BMT Mitra MU was in accordance with the waqf law in Indonesia. This research belongs to the type of qualitative research, by collecting data from oral and written sources, oral sources obtained through observations and interviews by researchers with the BMT Funder Officer in analyzing this research, the authors use the Juridical-Sociological method which describes, analyzes and assesses data related to the problem. cash waqf management in 2018. This study uses a sociological juridical approach, the type of qualitative research, and descriptive analysis methods. Data collection methods used are primary and secondary legal data. The results of this study state that, First, cash waqf conducted by BWI Jepara is accordance with the legal system and regulations in force in Indonesia, namely in accordance with Law Number 41 of 2004 concerning waqf because it is still not optimal in the implementation of the Act. Second, cash waqf conducted by BWI Jepara is still limited to state civil servants and government officials in Jepara have not touched the wider community aspect due to the low public understanding of cash waqf. Third, BWI Jepara as a cash waqf nair which initially only placed cash waqf funds into Islamic banks with the concept of wadiah (deposit) needs to seek to empower cash waqf assets to a more productive sector.Kajian ini bertujuan untuk mengetahui bagaimana peran BWI dalam pelaksanaan wakaf uang di Jepara, apakah sudah sesuai dengan Undang-undang perwakafan di Indonesia khususnya wakaf uang. Kajian ini menggunakan pendekatan yuridis sosiologis, jenis kajian kualitatif dan metode analisis deskriptif. Metode pengumpulan data yang digunakan yaitu data hukum primer dan sekunder. Hasil kajian ini menyatakan bahwa Pertama, wakaf uang yang dilakukan oleh BWI Jepara sesuai dengan sistem dan peraturan hukum yang berlaku di Indonesia yakni sesuai dengan Undang-undang Nomor 41 Tahun 2004 tentang wakaf sebab masih belum maksimal dalam implementasi atas Undang-undang tersebut. This is not in line with the ideals of marriage itself. This study aims to determine the thoughts of Shaykh Mahmud al-Misri about the concept of the sakinah family in the book Al-Ziwāj al-Islāmi al-Sa'īd. The formulations of the problem are: (1) What is the thought of Shaykh Mahmūd al-Miṣri in the book Al-Ziwāj al-Islāmi al-Saīd regarding the concept of the sakinah family? (2) How are the efforts to implement the concept of the sakinah family of Shaykh Mahmūd al-Miṣri in forming a happy family in society? This type of research is a library research with a qualitative descriptive approach. In analyzing data sources, researchers used steps, among others; formulate the problem under study, cite parts of the book content and data sources that are the object of research, describe and analyze in depth to draw conclusions. The results of this study are; first, the concept of the sakinah family of Shaykh Mahmūd al-Miṣri is a process of family formation based on the guidance of Islam both from the aspects of fiqh and social ethics as basic human guidelines both individually and socially and by taking into account applicable laws and regulations as a guarantee of family safety and recognition. which is legal in the community. The type of research carried out is field research (Field Research), which is carried out by going directly to the At-Taufiq Mosque, which is the object, namely in Hamlet Pailus RT 07/03, Karanggondang Village, Mlonggo District, Jepara. The data collection techniques that researchers use are observation, interviews, and documentation. The researchers conducted an analysis using a descriptive qualitative analysis method with the concept of the features of the Maq>as{id al-Sya>ri’ah Jasser Auda system in the form of 'cognition' of Islamic law, the overall scope of Islamic law, openness in the law-making process, interplaying hierarchies, multidimensionality of legal coverage, and understanding of the philosophical intent of Shari'a. Based on the research method used above, it can be concluded that, first, the use of infaq funds at the At-Taufiq Mosque for qard} is considered very effective and functional in terms of the level of problem solving of the qard} practice towards problems that exist in the community around the At-Masjid At-Taufiq. Because in system features, the effectiveness of something is judged by the achievement of its goals. Second, the law on the use of infaq funds at the At-Taufiq Mosque for qard} in the perspective of Maq>as{id al-Sya>ri’ah Jasser Auda is lawful and permissible. It is even recommended to consider the purpose of its use. Then examine whether the concept is still relevant in the digital era. This study uses a type of qualitative literature research and a normative approach, the data sources used are primary sources in the form of Kitab al-Umm, and secondary sources in the form of books and journals related to livelihoods and the digital era, as well as the Marriage Law and the Compilation of Islamic Law. Data collection method used is documentation, and data analysis using descriptive and inductive. The results of this study state that, First, according to Imam Shafi'i, it is the husband who is obliged to provide a living. The types of livelihood that must be provided at a minimum are clothing, food, shelter. The level of living that must be provided is in accordance with the standard of staple food at the place of residence and adjusted to the husband's economy. One mud for a poor husband, two mud for a rich husband, and one and a half for a middle husband. Second, the opinion of Imam Syafi'i, the first regarding the obligation to earn a living is still relevant in the digital era. The second opinion about the kinds of income that must be given is irrelevant to the digital era if the husband is poor, but this opinion can be relevant if the husband is rich. Penelitian ini menggunakan jenis penelitian kualitatif kepustakaan dan pendekatan normatif, sumber data yang digunakan adalah sumber primer berupa kitab al-Umm, dan sumber sekunder berupa buku dan jurnal terkait nafkah dan era digital, serta Undang-Undang Perkawinan dan Kompilasi Hukum Islam. Metode pengumpulan data yang digunakan adalah dokumentasi, dan analisis data menggunakan deskriptif dan induktif. Hasil penelitian ini menyatakan bahwa, Pertama, menurut Imam Syafi'i, yang wajib memberi nafkah adalah suami. Macam-macam nafkah yang harus diberikan secara minimal adalah sandang, pangan, papan. Kadar nafkah yang harus diberikan sesuai dengan standar makanan pokok di tempat tinggal dan disesuaikan dengan ekonomi suami. This study uses a juridicalsociological approach, using a qualitative research type using field research methods. To obtain the data used the method of observation, interviews and documentation. The results of this study state that, first, the implementation of the marriage is carried out in the morning before the bride and groom carry out the qabul consent. Before the procession begins, the whole family and all family members perform prayers. After that, the bride-tobe sungkeman to her sister, then the bride-to-be's sister expresses her sincerity to be willing to be stepped over, and the bride-to-be (sister) hands over the money or goods to her sister. Hasil penelitian ini menyatakan bahwa, pertama, pelaksanaan pernikahan ngelangkahi dilaksanakan pagi hari sebelum calon pengantin melaksanakan ijab qabul. Sebelum prosesi dimulai seluruh keluarga dan seluruh anggota keluarga melaksanakan do’a. Setelah itu, calon pengantin sungkeman kepada kakaknya, kemudian kakak calon pengantin mengutarakan keikhlasannya untuk bersedia dilangkahi, dan calon pengantin (adik) menyerahkan uang atau barang pelangkahan kepada sang kakak. Kemudian kakak memegang tebu wulung yang diikat dengan ingkung bakar sambil berpegangan tangan dengan adik kemudian keduanya melangkahi tumpeng golong sebanyak tiga kali. Whereas in the law it is clear that divorce can only be done before the court.From the description above, problems arise: First, what is the status of divorce without a decision by the Religious Courts. Second, how is the marital status of those who do not have a divorce certificate. Third, how important is the divorce certificate for divorce actors. To solve these problems, a library research method is used where the data are taken from existing books related to the titles that have been taken by the author to find answers to existing problems.The results of the study indicate that divorce without a court decision is not valid, in accordance with article 39 paragraph 1 of Law no. 1 of 1974 concerning marriage that divorce can only be carried out before a court session after the court concerned has tried and failed to reconcile the two parties. Therefore, people who divorce without a court decision are not valid but are legal according to religion only. Meanwhile, marriage without a divorce certificate is also invalid because the divorce certificate is authentic evidence as well as the marriage certificate. The divorce certificate is proof that the person has completed the divorce. 1 of 1974 that a marriage can be annulled if it does not meet the requirements to marry. So important is the divorce certificate to carry out a marriage, which is no less important, namely to ensure the management of child support rights from husband and wife, Gono Gini assets and marriage.AbstrakPenelitian ini mengkaji tentang Perceraian di bawah tangan yaitu perceraian yang dilakukan oleh seseorang dengan tidak melalui jalur hukum atau tanpa proses perceraian di Pengadilan Agama. Padahal dalam Undang- Undang sudah jelas bahwa perceraian itu hanya dapat dilakukan didepan pengadilan.Dari uraian di atas timbul masalah: Pertama, bagaimana status perceraian tanpa putusan Pengadilan Agama. Kedua, bagaimana status perkawinan yang tidak mempunyai akta cerai.Ketiga,sejauh mana pentingnya akta cerai bagi pelaku perceraian.
