Wakaf is a part of Islamic law which is specifically regulated in Indonesia Law number 41 of 2004. In administering wakaf, nazhir (administrator) should manage and develop wakaf properties according to their goals, function and allocation based on Syari’ah principles. In fact, most of administration of wakaf land merely fits to the validity of Islamic Law, but it has not been suited with systematic administration as it should be managed by nazhir personally or institutionally. This case was also happened in Yayasan Al-Munir Cinunjang Gunungtanjung Subdistrict Tasikmalaya Regency. From the background, researcher developed 3 research questions: How is Islamic and Indonesia Law number 41 of 2004 viewpoints about mechanism of wakaf administration, how is mechanism of land wakaf administration in Yayasan Al-Munir Cinunjang Gunungtanjung Subdistrict Tasikmalaya Regency, and how is the suitability in administering wakaf land in Yayasan Al-Munir Cinunjang Gunungtanjung Subdistrict Tasikmalaya Regency with Islamic and Indonesia Law number 41 of 2004. The collected data of the research were qualitatively analysed. Afterwards, the result of analysed data was descriptively explained by the researcher to get more clearly and systematic portrayal for answering the research questions. The result of the research showed that the administration of wakaf land in Yayasan Al-Munir Cinunjang Gunungtanjung Subdistrict Tasikmalaya Regency was still managed conventionally. Nevertheless, there was a significant progress in using and administering wakaf land after the foundation had a notarial deed of establishment. It was revealed by the development of new educational institution under the foundation i.e SMP Terpadu Al-Munir (Al-Munir Integrated Junior High School). In summary, by this unsystematic management, the administration of wakaf land in Yayasan Al-Munir Cinunjang Gunungtanjung Subdistrict Tasikmalaya Regency had not optimally suited yet with Islamic and Indonesia Law number 41 of 2004. \u0000Abstrak. Wakaf merupakan bagian hukum Islam yang mendapat pengaturan secara khusus dalam peraturan perundang-undangan di Indonesia yaitu dalam Undang-Undang nomor 41 tahun 2004. Dalam pengelolaan wakaf, nazhir wajib mengelola dan mengembangkan harta benda wakaf sesuai dengan tujuan, fungsi dan peruntukannya sesuai prinsip syariah. Pada kenyataannya, pengelolaan tanah wakaf masih sebatas memenuhi syarat sah wakaf sesuai hukum Islam, namun belum dilaksanakan sesuai tata kelola sistematis yang seharusnya dilakukan oleh nazhir baik itu perorangan atau lembaga penerima wakaf, seperti yang terjadi di Yayasan Al-Munir Cinunjang Kecamatan Gunungtanjung Kabupaten Tasikmalaya. This research is based on the traditional Minangkabau rules that prohibit tribal marriage. There is no law or verse of the Qur'an that prohibits same marriage. While in minangkabau custom, especially Nagari Bungo Tanjuang upholds falsafat \"Adat basandi syara' syara ' basandi kitabullah\". Therefore the ban on tribal marriage is contrary to the Marriage Act and Islamic Law. From the results of the discussion contained in this thesis, it can be concluded that 1) The practice of prohibition of tribal marriage in Nagari Bungo Tanjuang only refers to customary rules but does not cause the annulment of marriage or invalid marriage. 2) Review of Law No. 1 of 1974 on Marriage against the prohibition of one-tribe marriage is not in accordance with the rules in article 8 of the Marriage Act which only prohibits marriage because of the existence of relationships, marital relationships and relationships. \u0000Abstrak. Penelitian ini berdasarkan kepada aturan adat Minangkabau yang melarang perkawinan sesuku. Padahal tidak ditemukan satupun peraturan perundang-undangan maupun ayat al-quran yang melarang perkawinan sesuku. Sedangkan dalam adat Minangkabau khususnya Nagari Bungo Tanjuang menjunjung tinggi falsafat “Adat basandi syara’ syara’ basandi kitabullah”. Oleh karena itu larangan kawin sesuku bertentangan dengan Undang-Undang Perkawinan dan Hukum Islam. Summons are a process of trial examination that must proceed according to predetermined procedures, namely legally and properly and fairly. The purpose of this principle is that the summons is made based on the laws and regulations and takes into account the distance from which the parties live. There is a decision related to the divorce lawsuit with case number No. 5594/Pdt.G/2020/PA.Sor which was decided by Verstek because the defendant did not attend the trial from start to finish due to the fact that the summons was not received by the defendant at all from the Soreang Religious Court. . This study uses an empirical normative approach, namely regarding the implementation of legal provisions in their actions in every legal event that occurs in society. Sources of data in this study are primary data and secondary data, data obtained by interview where the researcher goes directly to the field by interviewing the parties concerned, the data analysis technique used is qualitative analysis, namely analysis by studying cases. After introducing and describing the data, compare it with the existing theory, then it is processed through several stages to find conclusions and be analyzed. The results of the study show that the process of summoning the defendant in case No.5994/Pdt.G/2020/PA.Sor resulted in a Verstek decision. it is in accordance with the law, especially in article 390 HIR, PP No. 9 of 1975 article 26 only contains injustice received by the defendant because it was due to negligence in conveying the summons from the bailiff/substitute bailiff and village officials. \u0000Abstrak. Pemanggilan merupakan suatu proses pemeriksaan persidangan yang harus berjalan menurut tata cara yang telah ditentukan yaitu secara sah dan patut serta berkeadilan. Maksud dari perinsip tersebut, pemanggilan dilakukan berdasarkan peraturan perundang-undangan dan memperhatikan jarak tempat tinggal para pihak. Terdapat putusan yang berkaitan gugatan perceraian dengan nomor perkara No.5594/Pdt.G/2020/PA.Sor yang diputuskan verstek karena pihak tergugat tidak mengikuti persidangan dari awal sampai dengan selesai yang disebabkan oleh relaas panggilan tidak diterima tergugat sama sekali dari Pengadilan Agama Soreang. Penelitian ini menggunakan pendekatan normatif empiris yaitu mengenai implementasi ketentuan hukum dalam aksinya pada setiap peristiwa hukum yang terjadi dalam masyarakat. Sumber data dalam penelitian ini adalah data Primer dan data Sekunder, data yang diperoleh dengan wawancara dimana peneliti terjun langsung kelapangan dengan cara mewawancarai pihak yang bersangkutan, teknik analisis data yang digunakan adalah analisis secara kualitatif yakni analisis dengan mempelajari kasus. Marriage is a very sacred legal act in which in marriage there is a great agreement with Allah SWT between a man and a woman to build a sakinah, mawaddah, warahmah household, and between the two there is no lineage or mahram relationship. In Islamic law, marriage is declared valid if it is carried out according to religious teachings and the marriage contract complies with sharia. The purpose of the study was to find out how the law of marriage online according to the Shafi'iyah and Hanafi'iyah schools of thought. In this study, the research method used a qualitative approach and data collection was carried out by means of a literature study. The conclusion according to Islamic law is that marriage will be declared valid if the pillars of marriage and the conditions of marriage are met. According to the Syafi'iyah school, the marriage contract must be carried out continuously, which is after the marriage guardian pronounces the consent and the prospective husband pronounces Kabul and must be in one assembly while the Hanafi'iyah school allows for different places or majlis. \u0000Abstrak. Pernikahan merupakan suatu perbuatan hukum yang sangat sakral yang mana dalam pernikahan terdapat perjanjian yang agung terhadap Allah SWT antara laki-laki dan perempuan untuk membina rumah tangga yang sakinah mawadah warahmah.dan di antara keduanya tidak memliki nasab atau hubungan mahram. Dalam syartiat islam pernikahan dinyatakan sah apabila dilaksanak menurut ajaran agama dan akad nikahnya memnuhi syara. Tujuan penelitian untuk mengetahui bagaimana hukum pernikahan secara daring menurut mazhab syafi’iyah dan mazhab hanafi’iyah . dalam penelitian ini metedo penelitian menggunakan pendekatan kualitatif dan pengumpulan data di lakukan dengan studi pustaka. Hasil kesimpulan menurut hukum islam bahwa pernikahan akan di nyatakan sah apabila rukun nikah dan syarat nikah nya terpenuhi. Therefore it requires / requires the presence of contracted parties, meanwhile with the development of technology, the marriage contract through the media of video calls is not considered valid if the terms and conditions are not met. The pillars or essential elements are consent and qabul. The problem points formulated in this study are How Marriage via video call media according to Islamic Law, how is the validity of the Marriage Contract through video call according to Islamic Law. The research method used is the normative juridical method. Which is the object of Marriage Contract Research through video call media according to Islamic Law. The purpose of this research: To know marriage through video call media according to Islamic law, to know the validity of the marriage contract through video call media according to Islamic law. The results of the study concluded that: Marriage via video call is a consent statement uttered by the female guardian which is then answered by the male, based on technological advances through the internet media. The marriage contract through legal video call media fulfills the requirements and harmonious marriage, does not contradict Islamic law, such as a prospective husband and a female marriage guardian, two witnesses and a consent of Kabul. This is confirmed by the provisions of Article 27 to 29 Compilation of Islamic Law, among others, not intermittent, carried out directly by the guardian of marriage concerned and pronounced directly by the groom through a video call, then fulfilled, among others, harmonious, legal requirements, conditions of marriage. \u0000Abstrak. Hukum Islam menegaskan bahwa “perkawinan dinyatakan bentuk ibadah muqayyah keabsahannya terletak pada syarat dan rukunnya. Oleh karena itu mengharuskan/mensyaratkan hadirnya pihak-pihak yang berakad, sementara itu dengan perkembangan teknologi maka akad nikah melalui media video call, tidak dianggap sah jika syarat dan rukunnya ada yang tidak terpenuhi. Rukun-rukun atau unsur-unsur esensialnya adalah ijab dan qabul. Poin masalah yang dirumuskan dalam penelitian ini adalah bagaimana pernikahan melalui media video call menurut Hukum Islam, Bagaimana Keabsahan Akad Nikah melalui media video call menurut Hukum Islam. Metode penelitian yang digunakan adalah metode yuridis normatif. yang menjadi Objek Penelitian Akad Nikah melalui media video call menurut Hukum Islam. Indonesia has legislation that is used as a guide for family law, namely the Compilation of Islamic Law (KHI). In (KHI), the share of inheritance between men and women is regulated in Article 176, where the rights of boys and girls are 2:1. The predetermined share of the treasure is 2/3, 1/2, 1/3, 1/4, 1/6, 1/8. This provision is a ta'abudi thing, something that must be implemented because it has become a provision in Qs. An-Nisa verse 13. However, the distribution of inheritance applied by the people of Kampung Cipicung Girang is different from any other law, namely 1:1 between heirs. This research is a qualitative research, namely the results of observations and interviews obtained from the field directly. The data sources in this study are secondary data sources with primary legal materials in the form of Al-Qur'anul Karim and the Compilation of Islamic Law. The results showed that: (1) Some of the people of Kampung Cipicung Girang carried out the distribution of inheritance using the law according to their traditions, namely 1:1 between male and female heirs. (2) This division is carried out to minimize disputes between heirs. \u0000Abstrak. Indonesia mempunyai perundang-undangan yang digunakan sebagai pedoman hukum keluarga, yaitu Kompilasi Hukum Islam (KHI). Dalam (KHI), bagian waris antara laki-laki dan perempuan salah satunya diatur dalam Pasal 176, dimana hak anak laki-laki dan anak perempuan yaitu 2:1. Bagian yang telah ditentukan dari harta adalah 2/3, 1/2, 1/3, 1/4, 1/6, 1/8. Ketentuan tersebut merupakan hal yang sifatnya ta’abudi, suatu hal yang wajib dilaksanakan karena sudah menjadi ketentuan dalam Qs. An-Nisa ayat 13. Akan tetapi, pembagian waris yang diterapkan oleh masyarakat Kampung Cipicung Girang berbeda dengan hukum manapun yaitu 1:1 antara ahli waris. Penelitian ini merupakan penelitian kualitatif yaitu hasil observasi dan wawancara yang didapatkan dari lapangan secara langsung. Sumber data dalam penelitian ini adalah sumber data sekunder dengan bahan hukum primer berupa Al-Qur’anul Karim dan Kompilasi Hukum Islam. The responsibility of the husband and wife is not only to nurture and educate the child but also to participate in providing guidance on learning. But unlike the community in Ciburial Village many parents are busy working so that the time for the family is reduced especially in terms of the education of their children. In this study, to find out the responsibility of husband and wife to the education of children according to the Marriage Act and Compilation of Islamic Law. And the responsibility of the husband and wife to the education of children in the village ciburial associated with the Law of Marriage and Compilation of Islamic Law. The method used by the author is qualitative descriptive method, this method to understand what phenomena experienced by the study subjects in the form of speech from observed behavior so that this study is correct in accordance with the facts of the field, by interviewing directly with the source. The results of this study showed that the husband and wife's responsibility for children's education in Ciburial Village does not play an active role in carrying out their responsibilities to guide children in learning, because the parents there are busy working, so to guide the child in learning is done by his own child without any guidance. But in Islamic education the parents there have given it well such as telling to pray, recitation and fasting. \u0000Abstrak. Tanggung jawab suami istri tidak hanya memelihara dan mendidik anak namun juga harus berperan serta dalam memberikan bimbingan belajar. Tetapi berbeda dengan masyarakat di Desa Ciburial banyak orang tua yang sibuk bekerja sehingga waktu untuk keluarga berkurang terutama dalam hal pendidikan anak-anaknya. Pada penelitian ini, untuk mengetahui tanggung jawab suami istri terhadap pendidikan anak menurut Undang-Undang Perkawinan dan Kompilasi Hukum Islam. Dan tanggung jawab suami istri terhadap pendidikan anak di Desa Ciburial yang dihubungkan dengan Undang-Undang Perkawinan dan Kompilasi Hukum Islam. Metode yang digunakan penulis yaitu metode deskriptif kualitatif, metode ini untuk memahami fenomena apa yang dialami oleh subjek penelitian dalam bentuk ucapan dari perilaku yang diamati sehingga penelitian ini benar sesuai dengan fakta lapangan, dengan mewawancarai langsung dengan narasumber. Hasil penelitian ini menunjukkan bahwa tanggung jawab suami istri terhadap pendidikan anak di Desa Ciburial kurang berperan aktif dalam melakukan tanggung jawabnya untuk membimbing anak dalam belajar, karena orang tua disana sibuk bekerja, sehingga untuk membimbing anak dalam belajar dilakukan oleh anaknya sendiri tanpa ada bimbingan.
