Individual action y factors outside the school, including individuals y groups, but also structural injustices, family conditions y parental values, etc., must be taken into account. For a long time, international organisations y national governments have prioritised security measures over preventive ones. Education is being used in both approaches, but its preventive function is only beginning to develop since the adoption of the UN Plan of Action to Prevent Violent Extremism. However, the direct effect of education on radicalisation depends not only on what is taught in the classroom but also on how it is taught, which is why the content of curricula, the pedagogical methods used y the values instilled in educational institutions are equally relevant. This research analyses the international y European frameworks that address education as a tool for preventing violent extremism y contrasts them with the recently approved Islamic religion curriculum, in order to comply with the competency-based approach inspired by Organic Law 3/2020, of 29 December, which amends Organic Law 2/2006, of 3 May, on Education (LOMLOE). The final balance of the curriculum analysis is positive. It does not contain «specific» curricular elements for the prevention of violent extremism, but it does contain many aspects «related» to the phenomenon, as well as valuable alternative narratives that focus on shared values y behaviours that help to prevent radicalisation La radicalización que conduce al extremismo violento es un reto multidimensional y complejo, que solo puede superarse mediante una combinación de acciones en diversos ámbitos políticos. La acción del individuo y los factores externos a la escuela, incluidos los individuos y los grupos, pero también las injusticias estructurales, las condiciones familiares y los valores de los padres, etc., deben tenerse en cuenta. Organisational patterns to provide religious assistance in hospitals in France, Belgium and Poland depend, to a large extent, on the circumstances of contemporary history in those nations. All three of them had managed to combine the non-denominationality of the States with granting the rigth of the patients admitted in health centres, to receive spiritual care. The particular norms which grant such a grant are, formal and hierarchically, quite diverse. La asistencia religiosa en los hospitales en la actualidad no resulta considerada solamente como un derecho que se integra en el de libertad religiosa, sino también en el derecho a la salud. Los modelos organizativos de la asistencia religiosa hospitalaria en Francia, Bélgica y Polonia, responden en buena parte a las circunstancias de la historia contemporánea de estas naciones. Sin embargo, en las tres se ha sabido conjugar la aconfesionalidad de los respectivos Estados con la garantía del ejercicio del derecho de los enfermos ingresados en establecimientos de salud a ser atendidos espiritualmente. It begins with a brief comparative analysis, looking at what has been done by European institutions and by some of our neighbouring countries. It then examines why conflicts have arisen in Spain, what happened in 2006 when the subject «Education for Citizenship» was first introduced, and what the current design of the new subject «Education in Civic and Ethical Values» in the LOMLOE entails, a design that is far removed from what this subject should be. Finally, it is suggested what content the subject should have and what scope of action the Autonomous Communities have to recover the meaning that these teachings should have, also taking into account the problems that arise in a decentralised State such as ours. En este artículo se analiza por qué es necesaria la educación cívica y cuál debe ser el modo adecuado de enfocarla. Se aborda inicialmente un breve análisis comparado, dando cuenta de lo realizado por las instituciones europeas y algunos países de nuestro entorno. A continuación, se estudia por qué han surgido conflictos en España, qué ocurrió en 2006 cuando se implantó por primera vez la materia «Educación para la Ciudadanía» y qué supone el actual diseño previsto en la LOMLOE de la nueva materia «Educación en Valores cívicos y éticos», un diseño alejado de lo que debería ser esta materia. {"title":"Educación en ciudadanía democrática y diversidad cultural, religiosa y de convicción. They are also characterized by difficult socio-economic contexts, with weakened elements of social cohesion and structural inequality. This is where tensions and phenomena of intolerance, segregation, discrimination and violent incidents are on the rise, as well as phenomena of disaffection with democracy itself, with growing signs of authoritarianism and populism. In the face of such dangerous dynamics, it is necessary to reinforce factors of social cohesion. Among these is education, since democratic and intercultural competencies, which also have a religious and convictional dimension, are not acquired automatically; they must be learned and practiced. Intercultural management of diversity is based on knowledge of and respect for common minimum contents, which are essential for social cohesion and must be transmitted by the education system. On this basis, it is necessary to guarantee areas for the legitimate exercise of difference, respecting, in its manifestations, the public order protected by law. We believe that democratic and intercultural competencies should be integrated into the subjects under study. It is up to the public authorities, in consultation with the educational community, to program teaching and its contents, an aspect that is not without controversy. We will analyze the curricular provisions linked to the transmission of democratic and intercultural competencies. These include education in civic and ethical values, and the teaching of religion, in its nonconfessional dimension. Las actuales democracias occidentales se caracterizan por su diversidad cultural, religiosa y de convicción. También, por contextos socioeconómicos difíciles, con elementos de cohesión social debilitados y desigualdad estructural. Es ahí donde aumenta la crispación y los fenómenos de intolerancia, segregación, discriminación e incidentes violentos, así como fenómenos de desafección de la propia democracia con crecientes muestras de autoritarismos y populismos. Ante tales peligrosas dinámicas, es preciso reforzar factores de cohesión social. Entre ellos, el de la educación, pues las competencias democráticas e interculturales, que cuentan también con una dimensión religiosa y de convicción, no se adquieren de manera automática; deben aprenderse y practicarse. La gestión intercultural de la diversidad parte del conocimiento y respeto de contenidos mínimos comunes, esenciales para la cohesión social y que el sistema educativo debe transmitir. Sobre esa base, es preciso garantizar ámbitos para el ejercicio legítimo de la diferencia, respetando en sus manifestaciones, el orden público protegido por ley. Consideramos que las competencias democráticas e interculturales deberían integrarse en las materias objeto de estudio. However, a new legal challenge is whether vaccination can be mandatory, and in which settings, and whether an individual can refuse vaccination for various reasons. In the view of law and religion scholars, the focus is on claims for faith-based exemptions. In multicultural societies, there is a huge number of individuals or groups objecting to vaccination for non-medical reasons, putting at risk the achievement of the so-called herd-immunity. The aim of this paper is to analyze conscientious claims against vaccine mandates in the US and in the European responses, to compare various judicial responses and the evolution of the standards of review adopted, and to investigate the impact of new legal challenges on the protection of religious freedom, with a view to exploring new predictable trajectories. El desarrollo de vacunas y su administración ha sido un punto de inflexión clave en la lucha contra el COVID-19, y ha permitido que la vida vuelva a la normalidad en cuanto se ha alcanzado un alto nivel de inmunización. Sin embargo, un nuevo reto jurídico es si la vacunación puede ser obligatoria, y en qué contextos, y si una persona puede rechazar la vacunación por diversos motivos. En opinión de los estudiosos del derecho y la religión, la atención se centra en las reclamaciones de exenciones basadas en la fe. En las sociedades multiculturales, hay un gran número de individuos o grupos que se oponen a la vacunación por razones no médicas, poniendo en peligro la consecución de la llamada inmunidad de rebaño. El objetivo de este artículo es analizar las demandas de conciencia contra los mandatos de vacunación en los EE. However, the continuous modifications experienced in this area, determined by an endless succession of regulations enacted in the field of education, could be endangering both the recognition and the exercise of this right. The latest of these regulations, the LOMLOE, is not an exception. For this reason, this article attempts to address the legal regime conferred by the LOMLOE on the religious education. In order to achieve our objective, it is essential to study the circumstances of the aforementioned organic law, without forgetting to refer to the legal regime of previous stages. In particular, the LOE, the reference and foundation of the current system. Thus, we will examine the degree of correctness of the state legislator and, where appropriate, that of the regional legislators, without forgetting the most significant judicial decisions to that effect. All of this is accompanied by a critical assessment, both of the regulatory regulations and of the different responses offered to the educational community questions. La enseñanza de religión es uno de los derechos que forman parte del contenido esencial del derecho de libertad religiosa. Sin embargo, las continuas modificaciones experimentadas en este ámbito, determinadas por una interminable sucesión de normas promulgadas en materia educativa, podrían estar poniendo en peligro tanto el reconocimiento, como el ejercicio de aquel derecho. La última de estas normas, la LOMLOE, no representa ninguna excepción. Por ello, el presente artículo trata de abordar el régimen jurídico conferido por ésta a la enseñanza de religión. Para alcanzar el objetivo descrito, se hace imprescindible estudiar las circunstancias propias de la ley orgánica citada, sin olvidar referirnos al régimen jurídico de etapas anteriores. En especial, el de la LOE, referencia y fundamento del sistema vigente. Así, se examinará el grado de acierto del legislador estatal y, en su caso, el de los legisladores autonómicos, sin olvidar los pronunciamientos jurisprudenciales más significativos a tal efecto. After a brief exposition of the treatment of the religious phenomenon in each territory, attention is given to the organization and limits of the exercise of religious assistance. It is verified, in the three States analyzed, the recognition of the right in favor of patients and the guarantee of access to hospital centers for religious ministers, upon request; however, although they coincide in terms of its foundation –the right to religious freedom–, they differ in their organization and the range of regulations in which it is collected. El presente trabajo tiene como objeto el análisis del régimen jurídico de la asistencia religiosa en el ámbito sanitario en tres distintos países: Alemania, Italia y Portugal. It refers to the international instruments that regulate it as well as the current regulations in Spain at the national and regional level. In light of these data, the task of the papers to specify the condition of religious entities as bearers of tradition and their link with the ICH. This examination will help us to delimit the scope of the intervention of the public powers in those manifestations in which faith and culture come together. The tensions and the reasons for divergence between the different agents interested in their protection, require us to address possible solutions to achieve the best balance between the different values in presence, so that the protection of conflicting rights is harmonized. El presente trabajo analiza el concepto y régimen jurídico del patrimonio cultural inmaterial religioso, examinando los instrumentos internacionales que lo regulan así como la normativa vigente en España de ámbito nacional y autonómico. A la luz de estos datos, se enfrenta la tarea de precisar la condición de las entidades religiosas como sujetos portadores de la tradición y su vinculación con el PCI. Este examen ayudará a delimitar el alcance de la intervención de los poderes públicos en aquellas manifestaciones en las que se aúnan fe y cultura.
