Abdulla, Arez Azad Hassan","doi":"10.21928/juhd.v8n3y2022.pp112-130","DOIUrl":"https://doi.org/10.21928/juhd.v8n3y2022.pp112-130","url":null,"abstract":"يُعدُّ عيب القصور إحدى أكثر الآفات التي تشوب عملية التسبيب أثناء قيام القاضي بِبناء الحكم القضائي، وهو يزاول وظيفته خلال مسيرتهِ القضائيّة، لأنه من النادر اليوم في الواقع العملي إصدار أحكام دون أن تشتمل على أسبابها، و لكن الذي يحدث هو إحتواء الأحكام على أسباب ألا أن تلك الأسباب تفتقر إلى المبررات التي تفضي الى النتيجة التي توصلت إليها محكمة الموضوع في حكمها، و بالتالي تعجز محاكم الطعن القيام بمهام بسط الرقابة على كيفيّة بناء القاضي لعقيدتهِ من خلال الحكم المطعون به، فمن الأولى أن يؤدي ذلك الى تجهيل ذوي الشأن بالعلة من وراء إصدار الأحكام، و قد بينت هذه الدراسة تعريف عيب القصور في التسبيب، و بيان ما يميزهُ عن غيرهِ من العيوب التي قد تتداخل معهُ في بعض الصفات، في حين تفترق عنهُ في جملة من الِخصال، وكذلك قد سُلط الضوء من خلال هذه الدراسة على آراء الفقه المقارن إزاء صور القصور في التسبيب، علاوة على ذلك، فقد بينت هذه الدراسة أثر القصور على الحكم القضائي، و النتائج المترتبة إذا ما شاب الحكم عيب القصور في التسبيب الواقعي و القانوني أيضاً، بالإضافة إلى ذلك، فقد أظهرت هذه الدراسة موقف القوانين المقارنة (العراقي، المصري، الفرنسي) في مدى إعتبار عيب القصور في التسبيب سبباً من أسباب الطعن تمييزاً.","PeriodicalId":313826,"journal":{"name":"Journal of University of Human Development","volume":null,"pages":null},"PeriodicalIF":0.0,"publicationDate":"2022-08-11","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"126444341","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

{"title":"Speaking Anxiety in the Interlanguage of Kurdish University Students of English: A Quantitative Study","authors":"Inaad Mutlib Sayer","doi":"10.21928/juhd.v8n3y2022.pp103-111","DOIUrl":"https://doi.org/10.21928/juhd.v8n3y2022.pp103-111","url":null,"abstract":"The aim of this study was to investigate the level of speaking anxiety in the interlanguage of Kurdish EFL students at the University of Human Development (UHD), to find out which component of the participants’ interlanguage (phonology, grammar and meaning) contributes more to speaking anxiety, to assess the effect of gender and level of study on the participants’ speaking anxiety, and to examine the correlation between the three components of the participants’ interlanguage as far as speaking anxiety is concerned. The study utilized a quantitative method represented by a 5-point Likert scale questionnaire consisting of 18 items responded to by 106 Kurdish university EFL students from three semesters at UHD. This study examines the lenses through which translation students are motivated to embark on the journey of translation. Whereas translation has long been considered to be an art in which translators principally rely on their talent and passion, or a profession in which practitioners are expected to have acquired necessary skills, translation has gained status as an academic discipline on its own in the past few decades. This paper aims to examine how students from different ethnic backgrounds perceive translation to be while studying the subject at university. To do so, a research questionnaire is devised to obtain students’ perceptions of translation as to whether they perceive it to be an art, craft, or science. The questionnaire aims at translation students from diverse ethnic backgrounds, specifically: Arabic, Kurdish, and Persian. Salih, Nueman Mohammed Almas","doi":"10.21928/juhd.v8n3y2022.pp83-89","DOIUrl":"https://doi.org/10.21928/juhd.v8n3y2022.pp83-89","url":null,"abstract":"تناول هذا البحث جهداً لأحد أعلام الكورد في التفسير، وهو ناصر سبحاني، حيث اشتهر بجهوده في التفسير والدّراسات القرآنية، وقد اهتمّ بدراسة المصطلحات القرآنية اهتماماً خاصّاً، ورسم لذلك نهجاً سار عليه. وممّا وقف عليه في عدّة أماكن من آثاره، مفهوم العلم في القرآن. لذلك عمد البحث إلى دراسة ما ذهب إليه سبحاني، والكشف عن كيفيّة عمله، والإشارة إلى رأي العلماء في تفسير العلم، وتسليط الضّوء على جوانب القوّة والضّعف في دراسة سبحاني. وكان الهدف الوقوف على هذا النّوع من الدّراسات حول المصطلحات القرآنيّة، والإكثار من الاهتمام بها، والكشف عن المناهج المتّبعة فيها. وقد جاء البحث على خطة – ما عدا المقدمة والخاتمة- منظمة في فقرات؛ الأولى لبحث منهج سبحاني في دراسة المفردات القرآنيّة، والثّانية لتناول مادة العلم في القرآن الكريم كما قام به سبحاني، ومقارنته بأقوال بعض المفسّرين والثّالثة لتقويم عمل سبحاني في استخراج مفهوم العلم. ثمّ جاء البحث في الخاتمة بنتائج أهمّها: اعتماد سبحاني في استخراج معاني المصطلحات القرآنية على التفسير الموضوعي بالتركيز على اللغة والسّياق، وتفسير العلم بالإدراك الذي يحدث تغييراً داخلياً في كيان الانسان ويولّد لديه الشّعور بالمسؤولية تجاه ربّه، واقتصار سبحاني على بعض الآيات في تحليلاته لمادة العلم وعدم إشارته إلى معاني العلم في السّنة النبوية. It has been sealed off by the coup of Sayd Zyaddin and Raza Shah. Starting from those days until the present Islamic Republic of Iran, the government has used history, formal state records (historians, political elite and academic institutions) and education to make allegiance among the Kurdish intellectuals. This has been adopted in accordance with the military, security and general policy of the state. It has shaped the Kurdish history and memory to reflect and underpin the formal narrative the state discourse sponsors; it does not reflect the facts and arguments residing in the memory, history and manuscripts of the Kurdish people. This research uses a historically descriptive-analysis and depends on evidence from the written records; it tries to answer these questions: what is Iran’s cultural policy (the state and the elite policy) toward the Kurds? How is the Kurdish Identity imagined in the formal records, the education and the state, what position does that image have? Where intellectual capital is considered one of the most important assets of the organization, it also helps in adding a competitive advantage and investing these assets in light of the mechanisms and principles of governance, which is reflected in achieving high levels of performance and providing services with high quality.\u0000In order to achieve the objectives of the research and test its hypotheses, the primary and secondary data were relied upon and a questionnaire was designed.
