Since existing studies elsewhere have focused primarily on its prevalence, risk factors and impacts, the child rights and family systems implications are less understood. This qualitative pilot study explored Canadian adoptive, kinship and customary caregivers’ considerations of their child’s rights to support and to be heard as they navigated the challenging context of their child’s aggressive behaviour towards them and other family members. The findings from interviews with 18 caregivers indicate that parental approaches were child-centred and trauma-informed as they sought to attend to the best interests of all children affected by AFCCA in their home. The results demonstrate the need for greater acknowledgment of AFCCA from a child rights perspective, and for comprehensive and non-biased family support services in order to fully meet the needs of all AFCCA-affected children and youth. This paper will demonstrate how Canada has aspired to uphold the mental health rights of refugee children in accordance with the United Nations Convention on the Rights of the Child (UNCRC) as well as the heightened commitment that is required to evoke an improved realization of these rights. {"title":"La protection des droits des demandeurs d’asile mineurs dans le Règlement de Dublin III face aux exigences de la CEDH","authors":"Juliette Samson, Gabrielle-Anne Labrecque","doi":"10.22215/cjcr.v9i1.4014","DOIUrl":"https://doi.org/10.22215/cjcr.v9i1.4014","url":null,"abstract":"Adopté en 2013, le règlement de Dublin III impose aux membres de l’Union Européenne (UE) la règle générale selon laquelle le pays responsable de traiter une demande d’asile est le pays par lequel le demandeur est entré dans l’UE. Ce règlement a fait face à une forte critique, notamment en ce qui concerne la protection qu’il offre aux demandeurs d’asile mineurs. Il appert que celui-ci ne permet pas aux pays d’entrée de leur offrir une protection adéquate. La forte concentration des demandes d’asile que crée le règlement de Dublin III nuit de façon exacerbée aux mineurs demandeurs d’asile en raison de leur vulnérabilité particulière. En effet, cette vulnérabilité requiert une mobilisation de ressources supérieure à celle qui est requise pour les adultes. Cela rend difficile, voir impossible, l’évaluation et le respect de l’intérêt supérieur des demandeurs d’asile mineurs. Nevertheless, young women and girls are among the most active in shaping local/global responses. Through an intersectional approach that critically explores child and youth civil and political rights, this paper analyzes climate change activism led by young women and girls during COVID-19, as well as the intersectional complexities that impact the activism that they engage in and carry out. The context is rights advocacy by children.
