In Canada, soccer surpasses other sports in terms of children's participation, promoting physical and mental health, essential life skills, and a sense of community. This article explores the right to play and the importance of play for Canadian children's overall well-being and development. It emphasizes the responsibility of communities and governments to ensure access to safe and inclusive play environments, particularly in organized sports like soccer. The article further explores the role of coaches, the need for safe spaces, and the impact of cultural context in shaping children's development. Recommendations are proposed, including enhanced regulation of coaching and player development using a rights-based approach and the integration of children's perspectives in decision-making processes. By fostering a culture of inclusivity and prioritizing the right to play, Canada can empower its children to thrive physically, cognitively, emotionally, and socially, equipping them with essential skills for success in a rapidly changing world.","PeriodicalId":278193,"journal":{"name":"Canadian Journal of Children's Rights / Revue canadienne des droits des enfants","volume":"14 10","pages":""},"PeriodicalIF":0.0,"publicationDate":"2023-11-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139258181","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This article provides a narrative account of this momentous reform.  It describes the history of Scotland’s law and gives an overview of a civil society campaign, coordinated by children’s organisations, to secure legal reform. It provides reflections on the campaign, setting out key learning points, including the importance of language and framing; the use of evidence; and the strength of broad coalitions. This account is offered to help inform similar campaigns to provide all children with protection from physical harm.","PeriodicalId":278193,"journal":{"name":"Canadian Journal of Children's Rights / Revue canadienne des droits des enfants","volume":"58 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-07-12","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"115076430","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The Act states that “corporal punishment of a child taking place in Wales cannot be justified in any civil or criminal proceedings on the ground that it constituted reasonable punishment.”  The Act also compels the Welsh Government to promote public awareness and to monitor and report on the impacts of the ban three and five years after coming into force. The Act received Royal Assent on March 20, 2020 and came into force two years later. This article traces the history of the campaign to prohibit corporal punishment by parents and those acting in loco parentis. Factors relating to the government, the population and civil society which may contributed to success in Wales are laid out. Some factors are addressed that may explain the lack of progress so far in Wales’s nearest neighbour, England.","PeriodicalId":278193,"journal":{"name":"Canadian Journal of Children's Rights / Revue canadienne des droits des enfants","volume":"19 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-07-12","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"127476098","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

As a Pathfinding Country for the UN Global Partnership to End Violence against Children, Canada has an obligation to remove Section 43 of the Criminal Code, the defence that “justifies” corporal punishment of children. As fellow nations influenced by the English common law underlying that defence, Ireland, Scotland and Wales provide models for Canada.  They demonstrate that the arguments that commonly derail repeal in Canada can be overcome. ","PeriodicalId":278193,"journal":{"name":"Canadian Journal of Children's Rights / Revue canadienne des droits des enfants","volume":"24 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-07-12","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"129566217","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

A large body of evidence demonstrates that it has no positive long-term outcomes and predicts a wide range of adverse effects in childhood and adulthood. The United Nations has declared that corporal punishment violates children’s fundamental rights to protection and has called on all countries to repeal laws that allow or justify it. As of June 2023, 65 countries have prohibited corporal punishment of children in all settings. These laws were implemented to make it clear that no level of violence against children is allowed and to uphold children’s rights to protection. This article aims to: (1) summarize the research and human rights rationales for the prohibition of corporal punishment; (2) provide a global update on its legal status; and (3) present research findings from Sweden, Germany, and New Zealand, three countries that have banned corporal punishment.","PeriodicalId":278193,"journal":{"name":"Canadian Journal of Children's Rights / Revue canadienne des droits des enfants","volume":"25 1","pages":""},"PeriodicalIF":0.0,"publicationDate":"2023-07-12","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"139360155","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Faith leaders have played an important role in this process by, over centuries, animating interpretations of sacred texts that are rooted in colonial patterns of power and control. The Truth and Reconciliation Commission of Canada’s Call to Action 6 urges the Repeal of Section 43 of Canada’s Criminal Code. One contributing factor to blocking progress on this Call to Action is the amplification of colonial Christian interpretations of sacred texts that normalize violence against children and that are rooted in colonial-shaped ideas about gender roles and power. Repeal of Section 43 is a substantive piece of a clear decolonizing strategy. It concretely addresses violence towards children and reshapes society in the best interests of all children.","PeriodicalId":278193,"journal":{"name":"Canadian Journal of Children's Rights / Revue canadienne des droits des enfants","volume":"1 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-07-12","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"129442772","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

In this article, I trace the history of Canada’s law, describe various attempts made to remove it, and present the many recommendations and calls for repeal issued over recent decades. While Canada has stood still, 65 countries have removed their legal defences and prohibited all corporal punishment of children. At this time, Canada has another opportunity to finally remove this archaic defence, as two Private Members’ Bills have been introduced in the House of Commons and the Senate, respectively. By seizing this opportunity, Canada will demonstrate its commitments to children’s rights to protection and dignity, and uphold its pledges to end violence against children and women in Canada.  ","PeriodicalId":278193,"journal":{"name":"Canadian Journal of Children's Rights / Revue canadienne des droits des enfants","volume":"23 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2023-07-12","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"133939582","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Research conducted by Children First Canada (CFC), a charitable organization that serves the over 8 million children living in Canada, over the past four years has continually highlighted the top ten threats to childhood in Raising Canada reports and provided calls to action to mitigate and respond to these concerns. In the Raising Canada 2021 report, cross-cutting themes present across the top threats were also described--one of which touched on the ways in which children and youth often lack sufficient prioritization and inclusion in public policies. Despite these findings, CFC has taken purposeful action to ensure children are granted spaces to participate and inform policy related discussions--internal to the organization or in public spheres. As such, in this paper we highlight these threats and the overarching theme on the lack of engagement with and prioritization of young people, we describe three key ways that CFC has actively included young people, and we describe why inclusion is important for social change. We also discuss what strategies for inclusion can look like in post-pandemic times, but emphasize the need to have inclusion of young people engrained in the fabric of a functioning society.","PeriodicalId":278193,"journal":{"name":"Canadian Journal of Children's Rights / Revue canadienne des droits des enfants","volume":"1 1","pages":"0"},"PeriodicalIF":0.0,"publicationDate":"2022-11-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"128898196","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
