Keputusan yang menetapkan Organisasi Papua Merdeka (OPM) sebagai organisasi teroris tersebut diklaim telah merujuk pada Undang-Undang Nomor 5 Tahun 2018. OPM dianggap telah menyebarkan keresahan dan rasa takut dalam masyarakat. Disisi lain OPM dikenal sebagai organisasi pejuang kemerdekaan. Rumusan masalah ; apakah penetapan Organisasi Papua Merdeka (OPM) sebagai organisasi teroris telah sesuai menurut Undang-Undang No. 5 Tahun 2018 dan bagaimanakah akibat hukum terhadap adanya penetapan Organisasi Papua Merdeka (OPM) sebagai organisasi teroris ? Metode penelitian yang digunakan merupakan penelitian hukum normatif dan bersifat deskriptif analitis dengan menggunakan data sekunder yang diperoleh melalui studi kepustakaan, data diolah secara kualitatif dan penarikan kesimpulan menggunakan logika deduktif. Adapun hasil penelitian, pembahasan dan kesimpulan dalam penelitian ini, berdasarkan Pasal 1 angka (3) jo Pasal 6 UU No. 5 Tahun 2018 tentang Pemberantasan Tindak Terorisme, maka penetapan OPM oleh pemerintah sebagai organisasi teroris telah sesuai dengan ketentuan yang berlaku. Putusan hakim wajib berlandaskan surat dakwaan yang diibuat oleh Jaksa Penuntut Umum karena surat dakwaan adalah dasar dalam pemeriksa-an perkara pidana. Akan tetapi, pada prakteknya seringkali terdapat putusan yang tak berdasarkan surat dakwaan. Pokok pernasalahan dari kasus ini yaitu apakah dasar dan akibat hukum terhadap putusan ultra petita itu. Guna memberikan jawaban terkait permasalah tersebu, riset ini dilaksanakan dengan cara hukum normatif, yakni memiliki sifat deskriptif analitis, data yang digunakan ialah data sekunder, analisis data dilaksanakan dengan cara kualitatif serta penarikan kesimpulan dilakukan dengan pola pikir deduktif. Hasil penelitian menunjukan jika dalam putusan kasasi ditemukan kesalahan karena hakim memutus tidak berdasarkan pada surat dakwaan yang dibuat oleh Jaksa Penuntut Umum dimana terdakwa didakwa menggunakan pasal 112 ayat (1) juncto Pasal 132 ayat (1) huruf a UU No. 35 Tahun 2009 tentang Narkotika. In its ruling on the issue, the Supreme Court's panel of judges rejected the plaintiffs' request for a memorandum of cassation, which was included in the judgement. The plaintiffs in this case, M.Nova Irdiansa and Hj.Enny Adriati, are subject to Article 6 of the Mortgage Act (Parate Eksecusi), which provides legal certainty for debt repayment. The issue is whether Bank CIMB Niaga's execution of mortgage rights on freehold land through a public auction complies with the Minister of Finance Regulation Number 27/PMK.06/2016. Research method is normative law, analytical descriptive, the source literature studies, interviews informants and using deductive logic method. The formulation of the issue in this study is compatibility between the legal repercussions for foreign ships that violate the SIPI falsification laws in the decision number 08/PID/PRKN/2011/PN.TPI and Law no. 45/2009 concerning amendments to Law no. 31/2004 concerning Fisheries, as well as what challenges foreign-flagged vessels encounter when making SIPI in order to use fake SIPI. Normative legislation is the study methodology used, using secondary data backed up by primary data. analysis of qualitative data leading to deduction. The problem is how the Polluter Pays principle is carried out by countries affected by oil spills in their territorial sea and whether the Polluter Pays principle is carried out by countries affected by sea pollution. This study discusses the implementation of the Polluter Pays principle due to marine pollution due to oil spills and the imposition of compensation. Normative research with literature reviews based on court records and facts that arise in cases of tanker accidents and oil rig leaks is used, data use descriptive analysis. The data sources used are primary and secondary legal materials. The results of the research and discussion illustrate the application of the Polluter Pays principle in cases that result in marine pollution by oil. Polluters also carry out compensation for affected countries by using prices prevailing in the market, taking certain actions and implementing restoration of environmental functions. The question being addressed is whether or not the compensation being granted for the construction of Phase I of the Simpang Indralaya-Muara Enim Toll Road in Ogan Ilir Regency is appropriate or not in light of the principles of land acquisition, as well as whether the provisions of the cassation decision No. 701 K/Pdt/2021 regarding the compensation being granted are appropriate or not in light of those principles. Normative legal research is the research method used to address the issues in the study, and analytical descriptive, secondary data kinds are the research's nature and making judgments based on deductive reasoning. This requires the government to make efforts to preserve the Komodo dragon as an endangered species. The problem is whether the construction of the Komodo Island Jurassic Park violates the provisions of the 1972 World Heritage Convention and what efforts need to be made to protect and preserve Komodo dragons? The article is normative research methods were carried out. Data processing is done qualitatively and conclusions is done using deductive methods. The results of the research and discussion are that the development of the Komodo National Park is an integrated and well-planned planned infrastructure regeneration which includes the design of areas, routes, supply of clean water, waste management, cleaning, and rejuvenation of human settlements.
