In its implementation, it is known that there is a compliance approach and a deterrence approach. The compliance approach is identical to preventive legal remedies, while the deterrence approach is identical to repressive law enforcement. This paper analyzes the effectiveness of both through various sources and references. The results of the study show that although both approaches have advantages and disadvantages, in the context of structuring environmental law in Indonesia, their existence is still needed to be the next law enforcement effort when law enforcement that was carried out earlier did not go well. The key to effectiveness is in addition to being in compliance, the element of firmness and consistency of law enforcement and administrative officials also has a major role in efforts to realize environmental management in order to encourage improvements in environmental management in Indonesia.AbstrakDalam upaya penataan hukum lingkungan dikenal adanya instrumen Command and Control yang disebut juga rantai regulasi karena prosesnya dari perencanaan, penyusunan regulasi, penerbitan izin, pengawasan hingga ke pengenaan sanksi. Dalam pelaksanaannya dikenal adanya pendekatan penaatan atau compliance approach dan pendekatan penjeraan atau deterrence approach. Pendekatan penaatan indentik dengan upaya hukum preventif, sementara pendekatan penjeraan identik dengan penegakan hukum represif.  Tulisan ini menganalisa efektifitas keduanya melalui berbagai sumber dan referensi. Hasil studi menunjukkan bahwa kedua pendekaan tersebut meskipun memiliki kelebihan dan kekurangan, namun dalam konteks penataan hukum lingkungan di Indonesia keberadaan keduanya masih diperlukan untuk menjadi upaya penegakan hukum berikutnya manakala penegakan hukum yang dilakukan lebih dulu tidak berjalan dengan baik. The increasing increase in narcotics users is not only for users but also other narcotic inmates such as addicts, dealers, and even narcotics dealers in narcotics prisons, especially in class II-A Narcotics Prisons in Pamekasan. The purpose of the guidance is to make the prisoners or inmates aware that what they are doing is prohibited by law and by their presence in the prison to improve themselves and not to repeat the crime so that they can be accepted again by the surrounding community. Reconstruction of the law on the separation of narcotics prisoners in terms of reducing the prevalence of narcotics users can actually minimize the level of relationship between traffickers and addicts. Which if there is no contact between them, information about narcotics and even the doctrine to abuse narcotics given by dealers or dealer class convicts will be avoided. Referring to the facts on the ground, namely in the Class II-A Narcotics Prison in Pamekasan, the results are still far from what the law aspires to. Narcotics convicts in the Narcotics Correctional Institution do not worsen the condition of prisoners in which these actions can actually have an impact on the wider community in a long time. AbstrakNarkotika merupakan masalah yang sangat serius sehingga hal ini menimbulkan perhatian yang sangat urgen dari Pemerintah. Peningkatan pengguna narkotika yang semakin tinggi tidak hanya bagi pengguna tetapi juga Narapidana narkotika lainnya seperti pecandu, pengedar, bahkan bandar Narkotika di dalam Lapas narkotika khususnya di Lapas Narkotika kelas II-A Pamekasan. Tujuan pembinaan bertujuan agar narapidana atau warga binaan Pemasyarakatan tersebut menyadari bahwa yang dilakukan adalah dilarang oleh hukum dan dengan adanya mereka di Lapas untuk memperbaiki diri dan tidak mengulangi tindak pidana sehingga dapat diterima kembali oleh lingkungan masyarakat di sekitarnya. Rekonstruksi hukum pemisahan narapidana narkotika dalam hal menekan tingkat prevalensi pengguna narkotika sejatinya dapat meminimalisir tingkat hubungan antara narapidana jenis pengedar dengan narapidana jenis pemakai atau pecandu. Yang apabila diantara mereka tidak terjadi kontak maka informasi tentang narkotika bahkan doktrin untuk melakukan penyalahgunaan narkotika yang diberikan oleh Narapidana kelas pengedar atau bandar akan dapat dihindari. Meanwhile, the Ministry of Industry has the task of carrying out government affairs in the industrial sector to assist the President in administering state government as stated in Article 4 of Presidential Regulation Number 107 of 2020 concerning the Ministry of Industry. The legal consequences of the separation of authorities of the two ministries in terms of making salt import policies for the needs and fulfillment of industrial salt as after the ratification of Government Regulation No. 9 of 2018 concerning Procedures for Controlling Imports of Fishery Commodities and Salt Commodities as Raw Materials and Industrial Auxiliary Materials related to the separation of authority between the Ministry of Industry and the Ministry of Maritime Affairs and Fisheries, which affects the Ministry of Industry itself. According to the theory, the authority should be separated in the law before being separated directly in a government regulation. Because this separation of authority is related to power, the two Ministries have the same position in the act and the difference is their duties and functions. However, these two Ministries have a relationship in terms of the import of fishery commodities and salt commodities used as raw materials and industrial auxiliary materials. AbstrakKementerian Kelautan dan Perikanan mempunyai tugas menyelenggarakan urusan pemerintahan di bidang kelautan dan perikanan untuk membantu Presiden dalam menyelenggarakan pemerintahan negara berdasarkan Pasal 2 Peraturan Presiden Nomor 63 Tahun 2015 tentang Kementerian Kelautan Dan Perikanan. Sedangkan Kementerian Perindustrian mempunyai tugas menyelenggarakan urusan pemerintahan di bidang perindustrian untuk membantu Presiden dalam menyelenggarakan pemerintahan negara yang terdapat dalam Pasal 4 Peraturan Presiden Nomor 107 Tahun 2020 tentang Kementerian Perindustrian.Terjadi pertentangan kewenangan atau hak  terkait wewenang Impor garam, ketidak sinkronan peraturan perundang-undangan tersebut terdapat dalam Pasal 37 ayat (3) Undang-Undang Nomor 7 Tahun 2016. The Locall Government Act 2014 stipulates that the provincial government's maritime area is up to 12 nautical miles measured from the high-water line. This provision differs from the provision in Act Number 32 of 2004 concerning Regional Administration, which stipulated that the distance of 12 nautical miles is measured from the low-water line. This alteration of provision reflects the direction of national policies in the authority-sharing between the central and local governments on the management of maritime areas and resources. This study aims to analyze the impacts of the alteration in maritime boundary measurement in the Local Government Act 2014 in the implementation of decentralized maritime resource management. This research was conducted in a juridical-normative manner, using secondary data. The results show that the provision regarding the maritime boundaries in the Local Government Act 2014 has had implications in several aspects, namely (1) the decrease of the maritime resources administered by the provincial governments, (2) the decline in the allocation of funds received by the regional governments, and (3) increasing the emergence of new enclaved waters administered by the central government surrounded by marine area administered by the provincial governments. The results also indicate that the provision has been implemented at the level of harmonization of regulations at the central level, although it has not been implemented in provincial maritime boundary adjustments. Abstrak Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah (UU Pemda 2014) membawa perubahan mengenai garis pantai yang digunakan untuk mengukur batas laut yang dikelola oleh daerah. Dalam UU Pemda 2014 diatur bahwa luas wilayah laut yang dikelola oleh pemerintah daerah provinsi diukur sejauh maksimum 12 mil laut dari garis pantai air pasang tertinggi. Ketentuan tersebut berbeda dengan ketentuan dalam rezim Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintahan Daerah yang mengatur bahwa garis pantai yang digunakan untuk mengukur jarak 12 mil laut adalah garis pantai air surut terendah. Perubahan tersebut mencerminkan arah kebijakan nasional dalam ranah pembagian kewenangan pengelolaan wilayah laut antara pemerintah pusat dan pemerintah daerah provinsi. Penelitian ini bertujuan untuk mengalisis bagaimana dampak perubahan penentuan garis pantai dalam UU Pemda 2014 terhadap pelaksanaan desentralisasi pengelolaan sumber daya kelautan oleh pemerintah daerah provinsi. This decline is the first since Indonesia's previous CPI improved in 2019. Corruption eradication was conducted in various ways and by government efforts to improve technical regulations through derivative regulations and the Supreme Court's regulations. At the end of 2020, a Supreme Court Regulation was issued regarding the regulation of Articles 2 and 3 of Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crimes. This research is normative. The material is obtained through works of the literature analyzed and described in a descriptive qualitative manner. The results depicted that Perma 1/2020 is not yet relevant to eradicate corruption in Indonesia. Issuance of Perma 1/2020 is still sectoral because it only regulates Article 2 and Article 3 of the Corruption Act. Abstrak Pada tahun 2020, Indeks Persepsi korupsi Indonesia berada pada peringkat 102 dari 180 negara dengan skor 37. Penurunan ini adalah yang pertama sejak IPK Indonesia sebelumnya sempat membaik pada 2019. Pemberantasan korupsi dilakukan dengan berbagai cara, juga dengan usaha pemerintah untuk memperbaiki regulasi secara teknis melalui peraturan turunan seperti halnya peraturan mahkamah agung. Pada akhir tahun 2020, terbit Peraturan mahkamah Agung terkait pengaturan Pasal 2 dan 3 Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan atas Undang-undang Nomor 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi. Penelitian ini merupakan penelitian normatif, bahan diperoleh melalui studi Pustaka yang kemudian dianalisis dan diuraikan secara deskriptif kualitatif. Whereas teenagers are the potential next generation to continue the relay of state development. Therefore it is important for researchers to conduct a study and / or research on aetiology and the urgency of criminal policy related to it. This study is aimed at analyzing the problem of violence perpetrated by children - teenagers from the perspective of criminal policy and socio-criminology at the same time. Data from the police show that the dominant act of crime is theft by violence, persuasion, sexual coercion, murder, and assault, while the data obtained from Regional Indonesia Child Protection Commission (KPPAID) show the dominant act of crime are: physical, psychological and sexual abuse and abandonment. Given the impact, the government needs to prioritize criminal policies to tackle child violence, by using 2 (two) penal and non-penal approaches (symptomatic and therapeutic). The political perspective of child violence crime itself is a perspective that does not only see the problem of child violence as merely a criminal law issue but also tries to see the problem from a non-legal perspective. Criminal politics with a penal approach can be carried out by using criminal sanctions selectively, encouraging criminal alternatives that are oriented towards children's needs. Meanwhile, the non-penal approach aims at empowering the role of families, teachers, religious leaders, traditional leaders, and community leaders, empowering the education of perpetrators and victims related to the development aspects of children - teenagers, empowering the economy of the family and society at large, optimizing the role of the government and related institutions, and empowering the role of the family (education and sex education, and self-respect). Abstrak Fenomena kekerasan oleh dan terhadap anak kerap tersaji di media dan menimbulkan rasa prihatin. Padahal anak merupakan generasi penerus yang potensial guna meneruskan estafet pembangunan negara. Karenanya penting bagi peneliti melakukan sebuah kajian dan atau penelitian tentang aetiologi, urgensi kebijakan kriminal berkaitan dengan itu. Penelitian ini diarahkan untuk menganalisis persoalan kekerasan yang dilakukan oleh anak dari perspektif kebijakan kriminal dan sekaligus sosio kriminologis. Data kepolisian menunjukan dominasi kejahatan adalah pencurian dengan kekerasan, pembujukan, pemaksaan seksual, pembunuhan, penganiayaan. Data yang didapat dari KPPAID: penelantaran (ekonomi) kekerasan fisik, psikis, dan seksual. Mengingat dampak, pemerintah perlu mengedepankan kebijakan kriminal guna menanggulangi kekerasan anak, melalui 2 (dua) pendekatan, yaitu penal dan non penal (simptomatik dan teurapatik). Innovation in the financial sector is known as financial technology (fintech). One of these fintech innovations is Equity Crowdfunding (ECF) where ECF allows investors to buy shares from companies that are not listed or do not meet the requirements for an Initial Public Offering (IPO). While this is a positive innovation, it can still pose risks if regulated incorrectly. These risks fall broadly into the categories of failure, fulfillment, fraud, money laundering, and even the risk of theft of business ideas and intellectual property rights. Organizers cannot guarantee that there will be no leakage of company business ideas or information. Article 2 of the Consumer Protection Law stipulates that consumer protection is based on benefits, justice, balance, security, and consumer safety, as well as legal certainty. This is also what is regulated in the Electronic Information and Transactions (ITE) Law. Therefore, it is necessary to research alternative equity crowdfunding financing. This article focuses on an equity crowdfunding-based stock offering system as well as a comparison of stock offerings through equity crowdfunding and initial public offering (IPO) as well as knowing whether the regulations of equity crowdfunding in Indonesia are correct and can accommodate the weaknesses of equity crowdfunding. The research method used by the author is descriptive research with a normative juridical approach, mainly shown to study legal principles related to stock offering through equity crowdfunding. The nature of this research is analytical descriptive, descriptive in nature, meaning that this research is expected to obtain a detailed and systematic description of Indonesian law related to ECF financial technology. The analysis is intended to be based on the description, the facts obtained will be analyzed carefully to answer the existing problems. Abstrak Sektor keuangan merupakan sektor yang memiliki peran penting dalam perekonomian dan terus mengalami perkembangan sesuai dengan kebutuhan masyarakat. Inovasi dalam sektor keuangan dikenal dengan istilah financial technology (fintech). Salah satu inovasi fintech tersebut adalah Equity Crowdfunding (ECF) dimana ECF memungkinkan investor untuk membeli saham dari perusahaan yang tidak terdaftar atau tidak memenuhi persyaratan untuk Initial Public Offering (IPO). Meskipun hal ini merupakan inovasi yang positif, tetap saja akan menimbulkan risiko jika diatur dengan tidak benar. The results of the study are the identification of regulations concerning Myanmar's Foreign Direct Investment compared to Foreign Direct Investment in Indonesia. Related to Foreign Direct Investment, there are several main aspects in the applicable regulations, which must be fulfilled such as the agency that deals with, special investment policies, business fields that are established and restricted to foreigners, the obligations of investors, partner institutions relevant to Myanmar's FDI, investment aggregation as well as the type of investment and guarantee provided to investors in Myanmar.Abstrak Jurnal ini membahas mengenai perbandingan hukum Foreign Direct Investment Negara Myanmar dengan Indonesia. This DIC cannot be separated from stability efforts, financial improvement, and ensuring customer deposits to create public trust in the banking sector. This is the legal form of protection provided by the Government to banking customers. The public is no longer worried about saving money because of crisis and liquidation at a bank. The public's money will remain safe and receive a guarantee of return from the Government through the DIC. However, it cannot be denied that there are still many people who do not understand the role of DIC. This study uses a normative juridical approach to determine the role of the DIC on customer deposits in handling bank liquidation. The role of the Deposit Insurance Corporation is part of the completeness of government instruments in creating a banking and financial safety net. As a banking safety net, it is carried out through a guarantee program and the handling of failed banks (liquidated banks), and as a financial safety net, it is realized in the use of surpluses and premium accumulation. When bank closure fails / the bank was liquidated, LPS guarantees claim payment on customer deposits.AbstrakLahirnya Undang Undang Nomor 24 Tahun 2004 tentang Lembaga Penjamin Simpanan (LPS) menjadi babak baru bagi sistem perbankan nasional. Keberadaan LPS ini tidak bisa dilepaskan dari upaya meningkatkan stabilitas sektor keuangan dan untuk menjamin simpanan nasabah agar tercipta kepercayaan masyarakat kepada sektor perbankan. Hal ini merupakan bentuk perlindungan hukum yang diberikan oleh Pemerintah kepada nasabah perbankan. Masyarakat diharapkan tidak lagi khawatir menyimpan uang di bank, karena apabila terjadi krisis dan likuidasi pada suatu bank, uang masyarakat akan tetap aman dan mendapat jaminan pegembalian dari pemerintah melalui LPS. Namun tidak dapat dipungkiri bahwa masih banyak masyarakat yang belum mengerti tentang peran LPS. Penelitian ini menggunakan pendekatan secara yuridis normatif. Penelitian ini dilakukan untuk untuk mengetahui peranan LPS terhadap simpanan nasabah dalam penanganan likuidasi bank. Peranan LPS merupakan bagian dari kelengkapan instrumen pemerintah dalam menciptakan jejaring pengaman perbankan (banking safety net) dan pengaman sistem keuangan (financial safety net). Sebagai banking safety net dilakukan melalui program penjaminan dan penanganan bank gagal (bank yang dilikuidasi), dan sebagai financial safety net diwujudkan dalam pemanfaatan surplus dan akumulasi premi. Using the normative juridical method, this article concludes that the standard e-commerce agreement has not fulfilled the principle of freedom of contract and has not reflected the values of justice, balance, and proportionality. The contents of the agreement have been made unilaterally. Therefore, further studies are needed to provide space for the parties to negotiate the e-commerce sale and purchase agreement.Abstrak Tujuan dari penulisan artikel ini adalah untuk mengetahui bagaimana penerapan asas kebebasan berkontrak dalam perjanjian baku smart contract e-commerce. Dengan menggunakan metode yuridis normatif, maka kesimpulan dari artikel ini adalah bahwa perjanjian baku smart cotract e-commerce tersebut belum memenuhi asas kebebasan berkontrak  dan  belum mencerminkan nilai keadilan, keseimbangan dan proporsionalitas karena  isi perjanjian telah dibuat secara sepihak.
