However, in practice, Judges are still civil servants, for example about the recruitment of Candidates for Judges in the Supreme Court for the 2017 Fiscal Year who still use the Civil Servant Candidate recruitment system (CPNS) that can be seen in the Supreme Court Regulation (PERMA) Number 2 of 2017 concerning Procurement of Judges. The identification of the problem in this paper is How the Problems of Filling Judges' Mechanism as State Officials Affect the Judicial System. The method used in this research is normative juridical. The specification is descriptive-analytical. This method uses secondary data material sourced from literature and related laws and regulations. Also, data analysis uses qualitative analysis. As for the research results, filling the position of a judge using the CPNS system is not a selection like other state officials; of course, it hurts the judicial system's independence because it currently is a state official. By using CPNS-style selection, judges will find it difficult to independently examine and decide a case, especially if it is related to cases that deal with the government; because of the dualism of a judge's position, judges must obey the government, which can interfere with the personal independence of judges and the independence of the Supreme Court as institutional.AbstrakSejak diterapkannya reformasi peradilan, kedudukan hakim telah berganti menjadi Pejabat Negara, Namun praktiknya, Hakim masih berkedudukan sebagai Pegawai Negeri, contohnya berkaitan dengan rekrutmen Calon Hakim di Lingkungan Mahkamah Agung Tahun Anggaran 2017 yang masih menggunakan sistem rekrutmen Calon Pegawai Negeri Sipil (CPNS) yang dapat dilihat pada Peraturan Mahkamah Agung (PERMA) Nomor 2 Tahun 2017 tentang Pengadaan Hakim. Adapun identifikasi masalah dalam makalah ini adalah Bagaimana Problematika Mekanisme Pengisian Jabatan Hakim Sebagai Pejabat Negara Berpengaruh Terhadap Sistem Peradilan. Metode yang digunakan penelitian ini adalah yuridis normatif. Spesifikasi bersifat deskriptif analitis. Metode ini menggunakan bahan data sekunder yang bersumber dari bahan kepustakaan dan peraturan perundang-undangan yang terkait. Selain itu analisis data menggunakan cara analisis kualitatif. Adapun hasil penelitian yaitu Proses pengisian jabatan hakim meggunakan sistem CPNS bukan seleksi layaknya pejabat negara lain tentu mencederai independensi sistem peradilan karena saat ini merupakan pejabat negara. For supporting the functions, diplomatic missions and diplomatic agents are given privileges and immunities rights. The privileges and immunities rights are not for individual diplomatic agents, but more importantly for the benefit of the mission as a whole. The consequence of having the privileges and immunities rights is the diplomatic missions and diplomatic agents are excluded from the local jurisdiction of the receiving state in the areas of criminal, civil and administrative law. This consequence creates complexity for the receiving country to follow up on diplomatic officials and their families if there is a violation or abuse of diplomatic immunity and privileges. There are some exceptions in world history where diplomatic officials can be followed up by recipient countries which can set a precedent for diplomatic immunity and privileges.AbstrakMisi diplomatik adalah misi resmi negara pengirim di negara penerima yang mengemban misi suci. Guna menunjang kelancaran tugas misi diplomatik maka misi diplomatik dan pejabat diplomatik diberikan hak-hak kekebalan dan keistimewaan. Hak-hak kekebalan dan keistimewaan itu bukan semata-mata untuk diri pejabat diplomatik maupun anggota keluarganya, tetapi yang lebih penting adalah untuk kepentingan misi secara keseluruhan. Konsekuensi dari dimilikinya hak-hak kekebalan dan keistimewaan tersebut adalah misi diplomatik dan pejabat diplomatik beserta anggota keluarganya dikecualikan dari yurisdiksi lokal negara penerima baik di area hukum pidana, perdata maupun acara. Konsekuensi ini mengakibatkan kompleksitas bagi negara penerima untuk menindak lanjuti pejabat diplomatik beserta keluarganya bila terjadi suatu pelanggaran maupun penyalahgunaan kekebalan dan keistimewaan diplomatik tersebut. Cultural diversity in West Kalimantan has resulted in various forms of work in the form of the unique motif in their respective regions. Researchers study the copyright issue of the the unique motif of the Kubu Raya Regency. Researchers used normative legal research, namely analyzing articles in statutory regulations and their implications for research subjects. The unique motif of Kubu Raya Regency (Sail Meretas, Gelombang Muare, Kelambu Raje, Harmoni Serampai and Gelombang Muare Reborn) are among the objects that can be protected under the Copyright Law, based on Article 40 letter j, which includes other motif artworks. The field study was carried out by identifying legal protection measures implemented by the local government against the copyright of local special cloth motifs. Both data were analyzed qualitatively. It was found that efforts to protect the unique motif of Kubu Raya Regency already exist, for example, issuing a Regent Regulation regarding the unique motif of Kubu Raya Regency, registering the unique motif of Kubu Raya Regency at Directorate General of Intellectual Property, promoting and socializing and coordinating The unique motif of Kubu Raya Regency at the National Craft Council of Kubu Raya Regency. Based on the DJKI database, the Gelombang Muare Motif was registered with the copyright to the Director General of Intellectual Property Rights. Local governments need to record all the unique motif of Kubu Raya Regency, including those that have been recorded but modified. The local government needs to develop the economic benefits of the unique motif of Kubu Raya Regency. The concentration of sales coordination for Kubu Raya Regency's unique motif products in Dekranasda must be accompanied by vigorous marketing efforts so that the products can compete in the market. This system considered as the new international security architecture in which the United Nations Security Council has the responsibility to design and implement accordingly in the framework of preserving international peace and security in line with the purposes and principles of the United Nations. Interestingly Chapter VIII of the United Nations Charter also provides constitutional basis for the involvement of regional organizations in the maintenance of international peace and security. As regional organizations are very diverse and not all of them are having the same posture, structure, resources and capability in the context of dealing with the challenges related to international peace and security, this article aimed at analysed the role and position of the regional organization in supporting the implementation of International Collective Security system. The first part traces the concept of International Collective Security embodied in the UN charter. The second part assesses the current engagement and role of regional organization in Europe, with special attention directed to The North Atlantic Treaty Organization (NATO). The third part critically examines the current legal arrangement in Asia with particular attention given to the Association of South-East Asian Nations (ASEAN). In conclusion the capability of NATO in supporting the implementation of the International Collective Security system upon the authorization of the UN Security Council is widely recognized by the international community. However, the overstepping of the mandate may have a negative effect in the future, particularly on the credibility of the responsibility to protect in the context of gross human rights violations. In such a context, to became a more effective player in the future, ASEAN needs to make further adjustment.Abstrak Salah satu penanda penting pembentukan organisasi internasional PBB adalah diterima dan dilembagakannya sistem Keamanan Internasional Kolektif dalam Piagam PBB. This concept has been applied in other countries. Researcher is interested conducting research concerning how the corporate Rescue concept applied in Indonesian bankruptcy act and attempted in bankruptcy practices in Indonesia, also how the urgency of Corporate Rescue concept is associated with the bankruptcy process in Indonesia. This study uses normative legal research method by analizing bankruptcy act, judges 'decisions and the reports of creditors' meetings in the bankruptcy process associated with the corporate rescue concept. Books, journals, and papers are also used as supporting data. The research results are described in descriptive analytical form as follow. The corporate rescue concept is implied in postponement of debt payment obligations provision of Indonesian bankruptcy act. The debtor is obliged to submit a reconciliation proposal regarding debt restructuring, one of the shape of corporate rescue concept. However, the act does not explain further information. Corporate rescue concept has also been implemented in the bankruptcy and postponement of debt payment obligations process. The Supervisory Judges, the curators/administrators always recommends that the Debtor should immediately prepares a reconciliation proposal to the creditors. However, the recommendation is only at the formality stage. The creditors' focus is how their receivables can be paid by liquidated debtor’s asset, therefore the reconciliation proposal has been rejected rather than approved. According to the Indonesian bankruptcy act, solvent companies and companies whose business line concerns basic human needs are easy to be bankrupted, if companies don’t pay debt which is due and collectible to one of their creditors. So to save them and the interests of concurrent creditors, corporation rescue concept must be adopted into Indonesian bankruptcy act and must be socialized to all stake holder. Abstrak Corporate Rescue Concept adalah suatu upaya untuk menyelamatkan perusahaan dari kepailitan agar usahanya tetap bisa berjalan dan utangnya kepada para kreditur dapat dibayar. Therefore, creative industry entrepreneurs must be protected by their intellectual rights so that all copyrighted works are legally protected by their existence and not arbitrarily anyone can steal, trade, multiply without the permission of the owner. However apparently only 17% of the 16.7 million creative industry players registered the results of their creativity. This shows that the protection of Intellectual Property Rights towards the creative industry is still very weak due to several factors, namely; Lack of public awareness / creative industry players to register their creativity businesses; Lack / lack of understanding of the community / industry players regarding the protection of Intellectual Property Rights (IPR); The presumption of some people / creative industry players for the management of registration of Intellectual Property Rights requires quite a large fee; The registration process takes a long time and is complicated. AbstrakIndustri kreatif sebagai salah satu pilar ekonomi masa depan memiliki peran yang sangat strategis dalam mengatasi masalah-masalah yang dihadapi oleh masyarakat bersama pemerintah, terutama di bidang ketenagakerjaan, bidang usaha, dan sebagai sumber penerimaan negara (PDB) . Oleh karena itu, pengusaha industri kreatif harus dilindungi oleh hak intelektual mereka sehingga semua karya cipta dilindungi secara hukum oleh keberadaan mereka dan tidak sewenang-wenang siapa pun dapat mencuri, berdagang, berkembang biak tanpa izin dari pemiliknya. The purpose of this study is to examine the protection of patent application rights in Technology Transfer and Investment Absorption in Indonesia. This research method is normative juridical. This approach is the legal, conceptual and historical approach. This research includes descriptive research, Data used in this research is primary data and secondary data source. Data analysis techniques, which use is qualitative normative descriptive analysis. The results of this study can be seen that there are several Articles in the Law No.13 Year 2016 on Patents that have a high spirit of nationalism that is expected to improve technological progress and increase investment in Indonesia but it is contrary to international law or agreement TRIPs, among them is Article 20, Article 4, Article 78 and Article 120. The Articles are contradictory to Article 27 TRIPs, it is necessary to amend the rules of Patent through the Act and the implementing regulations under it and to make qualification and classification of the products are required to make or use the process in Indonesia so as to appeal to domestic and foreign investors from abroad to invest their capital and bring patent technology to Indonesia. AbstrakSaat ini, bisnis di industri dan teknologi dihadapkan pada tantangan persaingan yang semakin tajam. Bisnis dalam industri dan teknologi dapat dilakukan dengan cara transfer teknologi, yang diharapkan dapat meningkatkan penyerapan investasi dan penyediaan lapangan kerja. Untuk itu sangat diperlukan regulasi yang dapat mendukung iklim investasi dan alih teknologi seperti hukum paten. Tidak hanya berorientasi ke dalam dengan semangat nasionalisme tetapi juga harus mengglobal atau sesuai dengan peraturan internasional untuk menghindari bentrokan dengan negara lain. Electronic Justice as stipulated in Supreme Court Regulation Number 3 of 2018 this is an attempt by the Supreme Court to address complaints in case management which is slow and long-winded trials, costly, difficulty for access to justice, until the low integrity of the judicial apparatus due to the opening of opportunities for maladministration in conventional (non-electronic) judicial implementation. As an institution that just runs, Electronic Justice is found several problems, one of them is disharmony with the regulation of procedural law as stipulated in egulation Number 5 of 1986, imperfect case administration, until the coverage of electronic justice which only covers lawsuit cases in the Administrative Court, cannot be applied to the Appellate Court or Cassation and Review. Based on these problems, this normative law research was carried out, the result of which was the need to issue a Standard Operating Procedure for Electronic Justice in the State Administrative Court and revise the Supreme Court Regulation Number 3 of 2018 by arranging case audits of Appeals, Cassation and Review are carried out electronically. Peradilan secara elektronik sebagaimana diatur dalam Peraturan Mahkamah Agung Nomor 3 Tahun 2018 ini merupakan upaya Mahkamah Agung guna mengatasi keluhan dalam manajemen perkara di pengadilan yang lambat dan bertele-tele, berbiaya mahal, sulitnya akses masyarakat untuk memperoleh keadilan, hingga rendahnya integritas aparatur peradilan akibat terbukanya peluang maladministrasi dalam pelaksanaan peradilan secara konvensional (non elektronik). Sebagai lembaga yang baru berjalan, pada Peradilan secara elektronik dijumpai beberapa permasalahan, antara lain disharmonisasi dengan pengaturan Hukum Acara sebagaimana diatur dalam Undang-Undang Nomor 5 Tahun 1986, Administrasi Perkara yang belum sempurna, hingga cakupan Peradilan secara elektronik yang hanya meliputi perkara Gugatan pada Pengadilan Tata Usaha Negara, belum dapat diterapkan pada peradilan tingkat Banding maupun Kasasi dan Peninjauan Kembali.
