The community has reported this to the provincial government, but there has been no response from the relevant agencies. With this article, it is intended that law enforcement against marine pollution inMasalembu waters can be clearly given and know the impact of coal spills on environmental sustainability in the waters. This research is a type of normative legal research, the approach used is legislation. The result of this study is that the environmental law enforcement used is through criminal law enforcement. Law enforcement in accordance with Law Number 27 of 2007 jo Law 1 of 2014 concerning the Management of Coastal Areas and Small Islands in article 35 letter c and article 75 paragraph 1 letter a. In addition, appropriate law enforcement is contained in Law Number 32 of 2009 concerning Environmental Protection and Management article 98 paragraphs 1 and 2, article 103 and article 104 as amended by Government Regulation in Lieu of Law of the Republic of Indonesia Number 2 of 2022 concerning Job Creation.Keywords: coal spill; criminal law enforcement; marine pollutionAbstrakTumpahan batu bara di Perairan Masalembu, Sumenep menimbulkan keresahan yang dialami oleh masyarakat sekitar. Masyarakat telah melaporkan hal ini kepada pemerintah provinsi, akan tetapi tidak ada respon dari lembaga yang terkait. Artikel ini bertujuan agar penegakan hukum terhadap pencemaran laut di Perairan Masalembu dapat secara jelas diberikan serta mengetahui akan dampak dari adanya tumpahan batu bara terhadap keberlangsungan lingkungan di perairan. Penelitian ini berjenis penelitian hukum normatif, pendekatan yang digunakan adalah perundang- undangan. Hasil dari penelitian ini adalah bahwasanya penegakan hukum lingkungan yang digunakan adalah melalui penegakan hukum pidana. Penegakan hukum yang sesuai Undang-Undang Nomor 27 Tahun 2007 jo Undang-Undang 1 Tahun 2014 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil dalam Pasal 35 huruf c dan Pasal 75 ayat (1) huruf a. Currently, there is a Supreme Court Regulation Concerning Procedures for Settlement of Simple Claims. Simple lawsuits are mild civil lawsuits with a fast case settlement process. Several restrictions have been regulated in this supreme court regulation. This is because this simple lawsuit case is designed to find a quick and straightforward solution to the legal issues faced by the parties so that a protracted settlement of claims does not occur and the payment of cases is resolved based on the principle of a fast, simple, and low-cost trial. This study aims to identify and analyze the implementation of supreme court regulation concerning Procedures for the Settlement of Simple Claims at Class IA Bengkulu District Court. The research method is carried out by empirical juridical research. The study results are the Implementation of Supreme Court Regulation concerning Procedures for Settlement of Simple Claims at the Class I Bengkulu District Court, carried out by existing regulations such as for the settlement of unlawful acts or defaults with a maximum lawsuit of Rp.500.000.000,- (Five hundred million rupiah) and settled by a single judge.However, for dispute resolution, the judge may decide more than 25 days by the supreme court regulation provisions because the judge needs more time to seek peace and give a decision to the parties in settlement of a simple lawsuit. Then the obstacle faced in the payment of a simple lawsuit at the Class I Bengkulu District Court is during the peace process when the plaintiff and the defendant do not have the same nominal value to be paid; it could be because the defendant is unable to pay off the default claim or unlawful act. AbstrakPenyelesaian sengketa dalam masyarakat dapat diselesaikan melalui pengadilan. Saat ini, telah ada Peraturan Mahkamah Agung yang mengatur Tentang Tata Cara Penyelesaian Gugatan Sederhana. Gugatan perdata ringan dengan proses penyelesaian perkara cepat merupakan gugatan sederhana. Perma ini sudah mengatur beberapa pembatasan. However, the existence of these two customary institutions does not yet have legal certainty in Indonesian legal arrangements that specifically discuss their position. As a result, the position of these customary institutions in the national realm is ambiguous due to the unclear status and position of legal products and the strength of the policies issued. The purpose of this research is to discuss the position of the customary village council in Bali Province and the national Dayak Customary Council in Kalimantan in the laws and regulations and the status of policies issued by customary institutions in Indonesian laws and regulations. The method used is normative legal research. Data sources consist of primary legal materials, secondary legal materials, and tertiary legal materials. In this research, the data is analyzed qualitatively and then presented descriptively to get a comprehensive conclusion. The results show that the MDA and the MADN have experienced significant developments ranging from institutional arrangements to legal products issued. Therefore, to provide legal certainty to the position of customary institutions and the status of legal products issued by Customary Institutions, it is necessary to explicitly regulate in Law Number 12 of 2011 as amended by Law Number 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011 concerning the Formation of Legislation concerning the position of Customary Institutions and the resulting Legal Products so that there is no overlap of policies between positive law and customary law that is currently running.AbstrakPembentukan Majelis Desa Adat (MDA) di Provinsi Bali dan Majelis Dewan Adat Dayak Nasional (MADN) di Provinsi Kalimantan menjadi contoh nyata bahwa kesatuan masyarakat hukum adat secara serius menunjukan keberadaannya untuk mengakomodir kepentingan anggota dan menciptakan kebijakan-kebijakan yang dapat berpengaruh secara langsung kepada kesatuan masyarakat hukum adat. In Indonesia, the problem of technology using the internet besides the positive side, is also a negative side that creates new problems in social relations. Restorative justice appears to be a new term in the world of law, and emerged when 3 law enforcement institutions each issued rules regarding the use of this approach, but if one looks closely the spirit of restorative justice has existed since ancient times in the values of the Indonesian people, namely deliberation to reach consensus, as the embodiment of part of the nation's ideological values, namely Pancasila. There is always debate about information and electronic transactions. This indirectly shows the public's need for this law. If you look closely at the issues that often arise are defamation and hate speech, especially during campaigns (related to politicians) and in the entertainment sector (celebrities). So this research is about legal aspects both in terms of the applicable laws and regulations regarding the criminal responsibility of perpetrators who distribute and transmit information, generally related to defamation of social media and examines the application and implementation of these regulations in relation to ITE law with a restorative approach to justice. The application of restorative justice for now is quite good, and accommodates local wisdom values. But in the future it still requires the professionalism of law enforcement (human resources) in its implementation.AbstrakKomunikasi, sosial, ekonomi, dan ilmu pengetahuan saat ini bersinergi dengan teknologi (internet) menjadikan dunia baru di Indonesia maupun seluruh negara di dunia. The research method used is normative legal research, which includes literature study pertaining research on laws as regulated in Article 4 paragraphs (2) and (3) of Act No. 4 of 1996 on Mortgage and Article 4 Government Regulation (GR) No. 103 of 2015 with Article 53 Paragraph (1) GR No. 40 of 1996. The results of this research shows as follows right of use that can be used as Mortgage according to Article 4 paragraph (2) and (3) of Act No. 4 of 1996 on Mortgage is associated with Article 4 GR 103 of 2015 which provides a synchronical statement, the type of house that can be owned by foreigners is a single house located on the land with the right to use and ownership with the deed of the government official who is in the authority and the apartment unit located on the land with the right to use. However, there appears to be a discrepancy. According to Article 53 paragraph (1) GR No. 40 of 1996, Land Use Rights on State Owned Land and Management Rights can function as collateral for debt with encumbered mortgage rights. To achieve legal certainty, the government should revise GR No. 103 of 2015 Jo Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency No. 29 of 2016, so that it contains provisions that regulate the types of rights of use and the criteria for residences of foreigners with mortgage rights and to harmonize the provisions governing the types of rights of use that can be used as mortgage rights. The trend of online shopping in e-commerce has grown quite rapidly, and Shoppe has become one of the choices for consumers for buying and selling transactions online. On that basis, it is essential to analyze the government regulations and policies issued by e-commerce, in this case, e-commerce Shopee, regarding consumer protection. This study uses an empirical juridical method. Source of data obtained from primary data and secondary data. The data collection method is through interviews with Shopee users, and secondary data is obtained through related literature, including laws, books, scientific journals, and sources related to government regulations and Shopee e-commerce. The results show that consumer protection in online transactions mainly refers to Law Number 8 of 1999 concerning Consumer Protection (UU Perlindungan Konsumen/UUPK), even though there have been regulations from the government regarding online transactions. E-commerce Shopee also provides consumer protection regulations in the form of policies, one of which isa policy on returning goods and funds, which is one of the risks that consumers are vulnerable to when conducting online buying and selling transactions. Therefore, between government regulations and e-commerce policy regulations, there must be a connection so that there are no multiple interpretations from consumers. Such provisions do not accommodate the demands of an all-digital era, while the authentic nature of the deed still needs to be maintained because it contains the hopes of the appearers for guaranteed certainty and legal protection of the rights of the appearers. This study aims to examine the relevance of applying the provisions of the physical presence of appearances before a Notary in reading and signing of deeds in making Notary deeds in the digital era and to examine the weaknesses of applying the reading and signing of deeds in making digital-based Notary deeds. The author uses normative legal research methods. The results show that the physical presence of appearers before a Notary at reading the deed in making a Notary deed is not fully relevant to be applied in the digital era because it does not accommodate the demands of the times that require practicality, but on the other hand the conventional way of signing the deed remains relevant to be implemented because it protects the authentic values ofthe Notary's deed. The weakness of digitizing the reading of the deed is that it allows a lack of correct understanding by the appearers of the contents of the deed so that it has the potential for conflict. Meanwhile, the digitization of the signing of the deed causes loss of jurisdiction, unfair competition among notaries, the uncertainty of the date of making the deed and the potential for cybercrime to occur.AbstrakDalam pembuatan akta Notaris, pembacaan dan penandatanganan akta dilakukan dengan kehadiran fisik para penghadap di hadapan Notaris. Ketentuan demikian tidak mengakomodir tuntutan zaman yang serba digital, sementara itu sifat otentik akta tetap perlu dijaga karena di dalamnya terdapat harapan parapenghadap akan jaminan kepastian dan perlindungan hukum atas hak para penghadap. Penelitian ini bertujuan untuk mengkaji relevansi penerapan ketentuan kehadiran fisik para penghadap di hadapan Notaris pada pembacaan dan penandatanganan akta dalam pembuatan akta Notaris di era digital danmengkaji kelemahan penerapan pembacaan dan penandatanganan akta pada pembuatan akta Notaris berbasis digital. Penulis menggunakan metode penelitian hukum normatif, Hasil penelitian menunjukkan bahwa kehadiran fisik para penghadap di hadapan Notaris pada pembacaan akta dalam pembuatan akta Notariil tidak sepenuhnya relevan untuk diterapkan di era digital karena tidak mengakomodir tuntutan zaman yang menghendaki kepraktisan, namun di sisi lain cara konvensional penandatanganan akta tetap relevan untuk diterapkan karena melindungi nilai-nilai otentik akta Notaris. The decision-making organs of the state sometimes do not pay much attention to the general principles of good governance and the applicable laws which result in losses for the community. To guarantee the rights of citizens, there is an extension of PTUN's authority. The type of research used is normative juridical research. The formulation of the problem in this paper is the extension of the authority of the Administrative Court and its implication to the community rights. It also creates obstacles to get justice because there is no clear mechanism in implementing the demands compensation for tort (PMH) by Government. Therefore, people can only sue but do not get actual compensation. The findings in this study regarding the decisions of flood cases in Jakarta and Banjarmasin are that there are injustice in demanding compensation. To ensure legal certainty and protection of the community, the extension of PTUN's authority must stipulate complete provision regarding the tort compensation mechanism, compensating for factual losses experienced by the community by the House of Representative in the amendment to Law Number 5 of 1986 concerning PTUN.AbstrakSalah satu ciri dari negara hukum adalah adanya Peradilan Tata Usaha Negara (PTUN) yang menjamin agar pemerintah tidak bertindak sewenang-wenang terhadap rakyatnya. Sering kali pengambilan keputusan organ negara tidak memperhatikan asas-asas umum pemerintahan yang baik dan peraturan perundang-undangan yang berlaku yang mengakibatkan kerugian bagi masyarakat. Untuk menjamin hak-hak warga negara maka terdapat perluasan kewenangan PTUN. Jenis penelitian yang digunakan adalah penelitian hukum yuridis normatif. Rumusan masalah dalam makalah ini adalah perluasan kewenangan PTUN dan implikasinya terhadap hak-hak warga negara. Perubahan ini berdampak pada adanya hambatan dalam mendapatkan keadilan karena belum adanya mekanisme yang jelas dalam pelaksanaan atas tuntutan ganti kerugian. Sehingga masyarakat hanya dapat menuntut namun tidak mendapatkan ganti kerugian aktual yang dideritanya. Adapun temuan dalam penelitian ini terhadap putusan kasus banjir di Jakarta dan Banjarmasin adalah adanya ketidakadilan dalam menuntut ganti kerugian pada perluasan kewenangan PTUN. Demonopolization has an impact on the change in the status of PT. Pelindo (Persero), which was previously a regulator and operator by monopolizing port business activities, and become a port operator in the format of a Port Business Enterprise (PBE). As PBE PT.Pelindo (Persero) has the same status as a Private PBE, where the exploitation of ports is done through concession rights granted by the Port Authority (PA). The fundamental issue is to examine whether the concession rights which are the impact of demonopolization are in line with the concept of economic democracy based on the Indonesian constitution. The study was conducted using a normative juridical research method and a legislative approach. The results of the study are anticipatory strategies that can be considered by the government in determining policies that prioritize the principles of democracy economy in accordance with the Constitution of the Republic of Indonesia. Determination of the choice to determine the granting of the port concession rights to the private sector must be able to be decided on carefully consideration. The most important thing is to ensure that the economic democratic system must be able to be implemented in the performance of ports even though managed by the private sector, not to override the protection function of the lives of many people in order to achieve the demands of the maximum profit of the company.AbstrakKebijakan demonopolisasi terhadap PT.Pelindo (Persero) melalui Undang-undang No.17 Tahun 2008 tentang Pelayaran, dilakukan oleh pemerintah atas dasar tuntutan globalisasi demi menciptakan kondisi pasar persaingan sempurna, efisiensi serta efektifitas dalam pengelolaan korporasi. Demonopolisasi berdampak pada perubahan status PT.Pelindo (Persero) yang semula berkedudukan sebagai regolator dan operator dengan memonopoli kegiatan usaha kepelabuhanan, berubah hanya menjadi operator pelabuhan dalam format Badan Usaha Pelabuhan (BUP). Sebagai BUP PT.Pelindo (Persero) memiliki status yang sama dengan BUP Swasta, dimana pengusahaan atas pelabuhan dilakukan melalui hak konsesi yang diberikan oleh Otoritas Pelabuhan.
