Meanwhile, defamation is an act of attacking someone's honor or good name by accusingsomething that is clearly meant so that it is publicly known. This study aims to find out what Restorative Justice is, how cases of defamation are resolved with this approach, and what are the factors the perpetrators commit criminal acts of defamation in the study of decisions examined. The factors causing the occurrence of defamation crimes through social media in the city of Bandar Lampung are heartache factors due to events experienced by perpetrators of defamation through social media, there are also political factors, as well as factors of lack of legal awareness by perpetrators of defamation crimes through social media. AbstrakSecara harfiah Keadilan Restoraif adalah pemulihan keadilan, tetapi secara lebih jelas Keadilan Restoratif adalah suatu pendekatan yang menitik beratkan pada kondisi terciptanya keadilan dan keseimbangan bagi pelaku serta korbannya sendiri. Sedangkan pencemaran nama baik adalah perbuatan menyerang kehormatan atau nama baik seseorang dengan menuduhkan sesuatu hal yang maksudnya terang supaya hal itu diketahui umum. Penelitian ini bertujuan untuk mengetahui apa itu Keadilan Restoratif atau Restorative Justice, bagaimana penyelesian perkara pencemaran nama baik dengan pendekatan tersebut, dan apa faktor-faktor pelaku melakukan tindak pidana pencemaran nama baik dalam studi putusan yang di teliti. The problems in Lampung Province are very interesting to discuss in the context of the ambiguity between the central and local governments as administrators and the distribution of powers in the region's decentralisation process. The possibility of such distribution must be regulated in the regional regulation draft on matters that are under the authority of Lampung Province, according to the new material introduced by Law Number 23 of 2014, namely the allocation of general affairs in the hands of the President to the province, which must later be coordinated by the regional chief. By using a qualitative method based on the collection of documents from books, journal articles, national law, and government documents, we analysed the data by using a theoretical framework of the regional autonomy and regulation formulation concepts. We found that a clear and firm mechanism for guidance, monitoring, empowerment, and sanctions is needed to finalise the regional autonomy processes. Another finding was the main reasons for the establishment of regional regulations on government affairs in Lampung Province could be seen from the philosopical, sociological, and legal aspects. Finally, we suggested the imidiate preparation for a regional regulations draft on government affairs in Lampung.Abstrak Tulisan ini bertujuan untuk menjelaskan mengapa diperlukan suatu Peraturan Daerah untuk mengatasi permasalahan yang melibatkan pemerintah dan masyarakat dalam hubungan pemerintah pusat dan daerah di Provinsi Lampung. Permasalahan di Provinsi Lampung sangat menarik untuk dibahas dalam konteks ambiguitas hubungan antara pemerintah pusat dan daerah sebagai penyelenggara dan pembagian kekuasaan dalam proses desentralisasi daerah. Kemungkinan pembagian kekuasaan tersebut harus diatur dalam rancangan peraturan daerah tentang hal-hal yang menjadi kewenangan Provinsi Lampung, sesuai dengan Undang-Undang Nomor 23 Tahun 2014, yaitu pembagian urusan umum menjadi kewenangan Presiden kepada provinsi, yang nantinya harus dikoordinasikan oleh Kepala Daerah. Dengan menggunakan metode kualitatif berdasarkan kumpulan dokumen dari buku, artikel jurnal, perundang-undangan nasional, Penulis menganalisis data dengan menggunakan kerangka teori konsep otonomi daerah dan perumusan peraturan. Penulis menemukan bahwa mekanisme yang jelas dan tegas untuk pembinaan, pemantauan, pemberdayaan, dan sanksi diperlukan untuk menyelesaikan proses otonomi daerah. Temuan lain adalah alasan utama pembentukan peraturan daerah tentang urusan pemerintahan di Provinsi Lampung dapat dilihat dari aspek filosofis, sosiologis, dan hukum. Therefore, there are no rights and obligations that arise between two lovebirds who are dating to the extent that one party among several parties feels aggrieved then that is where the obligation to ask for accountability is demanded. In the period of dating, men often make verbal promises to their lovers without written evidence, for example saying marriage vows. The broken marriage promise certainly causes material and immaterial losses for a woman, so she sues the man to provide compensation. Kudus District Court Number 17/Pdt.G/2016/PN.Kds as a breach of contract, not an act against the law. The research method used is the normative juridical method with the assessment using a conceptual approach, a statutory approach and a case approach.The results of this study indicate that the act of breaking the marriage promise in the Decision of the Kudus District Court Number 17/Pdt.G/2016/PN.Kds is an unlawful act because the basis of the lawsuit fulfills the elements contained in Article 1365 of the Civil Code, namely: the existence of an act, the act must be against the law, there is a loss, there is a causal relationship (causality) between the act against the law and the loss and there is an error. So that the aggrieved party can ask for responsibility for unlawful acts in the form of compensation for both material and immaterial losses to the Defendant. Abstrak Hubungan berpacaran pada dasarnya tidak menimbulkan tanggung jawab hukum apapun, sehingga masa pacaran bukan merupakan hubungan hukum layaknya seperti suami istri. Oleh karena itu, tidak ada hak dan kewajiban yang timbul di antara dua sejoli yang berpacaran sampai dimana ada salah satu pihak di antara beberapa pihak merasa dirugikan maka di sanalah dapat dituntut kewajiban untuk meminta pertanggungjawaban. Dalam masa berpacaran kerap kali laki-laki mengumbar janji-janji lisan kepada kekasihnya tanpa bukti tertulis, misalnya mengucapkan janji kawin. Janji kawin yang diingkari tersebut tentunya menimbulkan kerugian materiel dan imateriel bagi seorang wanita, sehingga ia menggugat si laki-laki untuk memberikan kompensasi. Tujuan yang ingin dicapai dalam penelitian ini adalah untuk menganalisis dan mengkaji pertanggungjawaban hukum pengingkaran janji kawin dan pertimbangan Majelis Hakim dalam memutuskan Putusan Pengadilan Negeri Kudus Nomor 17/Pdt.G/2016/PN.Kds tersebut sebagai wanprestasi bukan PMH (Perbautan Melawan Hukum). Metode penelitian yang digunakan yaitu metode yuridis normatif dengan pengkajian menggunakan pendekatan konseptual, pendekatan perundang-undangan dan pendekatan kasus. This article aims to examine environmental protection in positive law in Indonesia in critical legal studies. This critical legal study is then revealed through a hermeneutic approach and a public policy approach, where this study will see which parts cause ineffective enforcement of environmental protection in Indonesia. The study of this article uses a normative juridical research method and is examined with a statutory approach through Indonesian positive law and a conceptual approach. The results of this study explain the problem of overlapping regulatory policies with the facts in the field, making policies in the law regarding environmental protection need to be revised so that implementation in the field with regulations is balanced. Abstrak Perlindungan lingkungan hidup yang diatur dalam undang-undang tentang Perlindungan dan Pengelolaan Lingkungan Hidup menjadi persoalan terkait tumpang tindihnya antara regulasi sebagai kebijakan publik dengan faktor lain yang terjadi dilapangan, sehingga menyebabkan banyak persoalan lingkungan hidup. Penelitian ini bertujuan untuk mengkaji perlindungan lingkungan hidup dalam hukum positif di Indonesia dalam kajian hukum kritis. Kajian hukum kritis ini kemudian diungkapkan melalui pendekatan hermenutika dan pendekatan kebijakan publik, dimana kajian ini akan melihat bagian mana yang menyebabkan tidak efektifnya penegakan dalam perlindungan lingkungan hidup di Indonesia. This study aims to analyze the effectiveness of law enforcement on the compliance of two-wheeled drivers in Pontianak City. The study was carried out in an empirical juridical manner by looking at facts and data in the field and by analyzing based on a legal approach. Kurangnya kesadaran masyarakat tersebut selalu menimbulkan kerugian bagi pengendara lainnya yang sudah berusaha untuk taat pada peraturan. Penelitian ini bertujuan untuk menganalisis efektifitas penegakan hukum terhadap kepatuhan pengendara roda dua di Kota Pontianak. Kajian tersebut dilakukan secara yuridis empiris dengan melihat fakta dan data dilapangan serta dengan menganalisis berdasarkan pendekatan undang-undang. One of the essential factors in influencing the protection of fishing vessel crews is the competence and quality of the manning agent as a liaison between the migrant workers and the ship owners. Unfortunately, at the regulatory level there are a number of overlapping regulations in regulating the manning agent licensing system. The government has enacted Law Number 11 of 2020 (Job Creation Act) which has the spirit of simplifying business licensing systems and has changed a number of laws relating to manning agents. This study aimed to analyze the diversity of regulations related to the establishment of manning agents that place Indonesian workers on foreign-flagged vessels, and analyzing the role of the Omnibus Law in solving these problems. This research is a normative research, using secondary data consisting of primary, secondary, and tertiary legal materials which were analyzed with qualitative analysis methods. The results showed that the diversity of regulations occurs because different institutions have sectoral regulations that overlap each other, resulting to the varying eligibility to become manning agents, licensing names, licensing issuing institutions, including the terms of licensing requirements. The Omnibus Law seemed to have been successful in solving the overlapping regimes, although still not enough to provide sufficient protection. This study recommends the government to take steps to put differentiated requirements to become fishing vessel manning agent and integrate the new requirements into the existing online-single-submission system.Abstrak Salah satu sektor penempatan pekerja migran yang banyak menimbulkan pelanggaran hak asasi manusia dan ketenagakerjaan adalah sektor pelaut perikanan atau yang dikenal dengan awak kapal penangkap ikan migran (AKPI migran). Dalam konteks penempatan AKPI migran, salah satu faktor yang esensial dalam memengaruhi nasib dan perlindungan AKPI migran adalah kompetensi dan kualitas manning agent sebagai penghubung AKPI migran dan pemilik kapal. Pada tataran yuridis, sayangnya terdapat sejumlah peraturan pelaksanaan yang saling tumpang tindih dalam mengatur tata perizinan manning agent. Namun demikian, pemerintah saat ini telah mengundangkan Undang-undang Nomor 11 Tahun 2020 (UU Ciptaker) yang mempunyai semangat penyederhanaan perizinan berusaha dan telah mengubah sejumlah Undang-Undang yang berkaitan dengan manning agent. On the one hand, the steps taken pose a considerable risk because two of the three combined Islamic banks will lose their status as legal entities. The research will describe the urgency of the merger policy towards state-owned Islamic banks, which will then be analyzed in a juridical manner related to the implementation of the merger. This research is a type of normative legal research or normative juridical research because this research focuses on library materials, using the Statute Approach. Based on the results of the research, the authors conclude that the implementation of the merger carried out by the government against the three state-owned Islamic banks is in accordance with the mechanism regulated in the regulations. However, the merger of these state-owned Islamic banks will have legal consequences for PT. Bank Mandiri Syariah Tbk., PT. Bank BNI Syariah Tbk., because after the merger or amalgamation, the status of the merging Islamic banks is declared terminated by law or by law. Another possible legal consequence, according to the author, is that in the near future Bank Syariah Indonesia (BSI) will not be able to achieve market share in the national banking industry, because it is still focused on improving management and the process of shifting customers after the merger. One form of democracy that is often done by the community is demonstration. However, democracy is often interpreted as unlimited freedom, even though the freedom of association and assembly, expressing thoughts verbally and in writing which are our human rights as humans are indeed guaranteed and protected by law, even as stated in Article 28 of the 1945 Constitution of the Republic of Indonesia and specifically regulated in the Law Number 9 of 1998 concerning Freedom to Express Opinions in Public, so that basically, demonstrations are legally permitted, but must be carried out in a civilized manner and not by violating the law. Related to this, how the effectiveness of the role of the police as a rule of law institution which is a means of social control in carrying out democratic values will be studied in this study, with the aim of analyzing it. The research method used is the juridical-normative method, with the assessment using a conceptual and case approach. The results of this study explain that the role of the police is still not effective, especially as a means of social control. In this case, preventive measures to prevent demonstrations that lead to anarchy, such as holding educational activities and legal socialization, have so far been lacking, both in intensity and creativity. AbstrakSebagai lembaga penegak hukum, kepolisian memiliki tugas dan tanggung jawab dalam mewujudkan dihidupinya nilai-nilai demokrasi oleh masyarakat. Salah satu bentuk cara berdemokrasi yang sering dilakukan oleh masyarakat adalah demonstrasi. Namun, demokrasi seringkali dimaknai sebagai kebebasan tanpa batas, padahal kemerdekaan berserikat dan berkumpul, mengeluarkan pikiran dengan lisan dan tulisan yang merupakan hak asasi kita sebagai manusia memang dijamin dan dilindungi oleh hukum, bahkan tercantum pada Pasal 28 UUD NRI Tahun 1945 dan secara khusus diatur dalam Undang-Undang Nomor 9 Tahun 1998 Tentang Kemerdekaan Menyampaikan Pendapat di Muka Umum, sehingga pada dasarnya, demontrasi diizinkan secara hukum, namun harus dilakukan dengan cara-cara yang beradab dan tidak dengan melanggar hukum. Terkait hal tersebut, bagaimana efektivitas peran kepolisian sebagai lembaga rule of law yang merupakan sarana kontrol sosial dalam mengemban nilai-nilai demokrasi akan dikaji dalam penelitian ini, dengan tujuan menganalisis hal tersebut. Metode penelitian yang digunakan yaitu metode yuridis-normatif, dengan pengkajian menggunakan pendekatan konseptual dan kasus. Adapun hasil penelitian ini menjelaskan bahwa peran kepolisian masih belum efektif, khususnya sebagai sarana kontrol sosial. Through the application of the good governance pattern for the government system, it is very necessary to use the principle of transparency and or the principle of openness as mandated by Article 26 paragraph 4 letter (f) of Law Number 6 of 2014 concerning Villages with Article 24 of Law Number 6 of 2014 concerning Villages. However, these two articles are in conflict The potential for misappropriation of these funds will be more open, namely in the case of corruption so that there is a need for control through the pattern of good governance. The purpose of this paper is to analyze and examine the normative problem of conflicting norms on the principle of transparency and the principle of openness in the pattern of good governance based on e-government which affects the management of village income sources. The research method used is normative research. Then use statute approach and the conceptual approach. The principle of good governance can be used as an embodiment of the concept of transparency and openness which tends to have conflicting norms. This includes the use and obligation in every government system even at the village level to use the e-government pattern in achieving good governance. The management of village income sources carried out by applying the principles of good governance is very relevant to the era of bureaucratic reform which is currently being programmed by the government because it is considered to have many benefits because it is in accordance with e-government policies in the Indonesian government system. AbstrakSentra kekuasaan politik lokal yang dibumikan dengan terbitnya Undang-Undang Nomor 6 Tahun 2014 tentang Desa yang dipersonifikasi melalui Kepala Desa dan perangkatnya dikatakan sebagai Pemerintahan Desa. Melalui penerapan pola good governance bagi sistem pemerintahan maka sangat perlu menggunakan prinsip transparansi dan atau prinsip keterbukaan sebagaimana amanat Pasal 26 ayat 4 huruf (f) Undang - Undang Nomor 6 Tahun 2014 tentang Desa dengan Pasal 24 Undang-Undang Nomor 6 Tahun 2014 Tentang Desa. Namun kedua pasal ini mengalami pertentangan. Kekhawatiran ini muncul ketika Kepala Desa dengan segenap kewenangannya dimana salah satunya adalah diberikan kewenangan untuk mengelola sumber keuangan desa untuk mengembangkan sumber pendapatan desa sebagaimana yang tertuang dalam Pasal 26 ayat (1) Undang–Undang Nomor 6 Tahun 2014 tentang Desa. Potensi untuk melakukan penyelewengan terhadap dana tersebut akan semakin terbuka yakni dalam kasus korupsi sehingga perlu adanya kontrol melalui pola good governance. B3 waste is the result of industrial residues or human activities which are very dangerous and toxic.Though its hazardous nature, it must be processed so it doesn’t contaminate the environment and threaten the sustainability of life. Concerning the processing of B3 waste, business activities or communities that can’t do the processing may ask third parties to process the waste which are produced. The purpose of this study is to determine the urgency of B3 waste management and the responsibility of third parties providers of B3 waste treatment services. This study uses a normative juridical method with a statutory, conceptual approach and literature review. The material used in this method is secondary dat material sourced from the legislation on B3 waste and library materials. The results showed that B3 waste had a negative impact on humans, animals, and other living things. Humans can be endangered directly or indirectly and the food chain can become toxic and endanger other animals. Therefore, B3 waste treatment is a must so as not to harm the environment and living things. B3 waste treatment services is tasked with managing waste based on an agreement with businessman or the community. If in its duties the B3 waste processing company causes B3 waste pollution, it must be responsible civilly with the principle strict liability through the provision of compensation or criminally with imprisonment as stipulated in UUPPLH AbstrakUndang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup (UUPPLH) telah berupaya untuk melindungi dan memelihara lingkungan dari segala pencemaran termasuk limbah B3. Limbah B3 merupakan hasil sisa industri atau kegiatan manusia yang sangat berbahaya dan beracun. Oleh karena sifatnya yang berbahaya maka harus dilakukan pengolahan agar tidak mencemari lingkungan dan mengancam keberlansungan makhluk hidup. Tentang pengolahan limbah B3, pelaku usaha atau masyarakat yang tidak dapat melakukan pengolahan dapat meminta pihak ketiga untuk mengolah limbah yang dihasilkannya tersebut. Adapun tujuan dari penelitian ini adalah untuk mengetahui urgensi dari pengelolaan limbah B3 dan pertanggungjawaban pihak ketiga penyedia jasa pengolah limbah B3. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan, konseptual serta penelaahan kepustakaan. Bahan yang digunakan dalam metode ini adalah bahan data sekunder yang bersumner dari peraturan perundang-undangan tentang limbah B3 serta bahan kepustakaan. Hasil penelitian menunjukkan bahwa limbah B3 telah berdampak negatif bagi manusia, hewan, dan makhluk hidup lainnya. Manusia dapat terancam keselamatannya secara langsung maupun tidak serta rantai makanan dapat menjadi beracun dan membahayakan hewan lainnya.
