This paper aims to discuss the task of The People Consultative Assembly (Majelis Permusyawaratan Rakyat/MPR) to absorb community aspiration and involve public participation. The analysis was conducted based on Law No. 17 of 2014 concerning the People’s Consultative Assembly (Majelis Permusyawaratan Rakyat/MPR), House of Representatives (Dewan Perwakilan Rakyat/DPR), Regional Representative Council (Dewan Perwakilan Daerah/DPD) and Regional People’s Representative Assembly (Dewan Perwakilan Rakyat Daerah/DPRD) (MD3). This study uses research methods with a qualitative approach. The law stipulates that one of the tasks of the MPR is to review the constitutional system, the Constitution, and its implementation, as well as absorb the aspirations of the people and regions regarding the implementation of the Constitution. The MPR, as a people’s deliberation institution, must be able to respond to the dynamics of aspirations and strengthen people’s sovereignty. This research is also to provide a breakthrough in the optimal management of community aspirations through technology-based change projects. The conclusion of the study found that to be able to achieve these goals; key success factors must be implemented, such as commitment and support from leaders and stakeholders, discipline in time management related to the implementation of the change project agenda that has been made, as well as the adoption and adaptation of best practices of the innovation of existing complementary-collaborative policies.\u0000Abstrak\u0000Keberadaan aspirasi masyarakat dan daerah sangat penting dalam rangka pelaksanaan konsolidasi demokrasi menuju pemerintahan yang demokratis dan konstitusional, sehingga sebagai unsur pendukung teknis dan substansial perlu disusun strategi pengelolaan aspirasi masyarakat dan daerah untuk meningkatkan partisipasi masyarakat secara optimal. MPR sebagai lembaga permusyawaratan rakyat harus mampu menjawab dinamika aspirasi, sekaligus memperkuat kedaulatan rakyat. Oleh karena itu, penelitian ini mencoba memberikan terobosan dalam pengelolaan aspirasi masyarakat secara optimal melalui proyek-proyek perubahan berbasis teknologi. Perbuatan pidana yang dapat merugikan keuangan negara atau perekonomian negara sudah seharusnya dan tepat bila dikategorikan sebagai suatu tindak pidana korupsi, sebagaimana Pengertian Tindak Pidana Korupsi Menurut Undang-Undang Tentang Pemberantasan Tindak Pidana Korupsi. Permasalahan, 1) Bagaimanakah penegakan hukum pidana di bidang pajak, 2) Mengapa tindak pidana di bidang pajak dapat dikategorikan sebagai tindak pidana korupsi. Berdasarkan permasalahan yang diteliti maka jenis penelitian adalah metode penelitian hukum normatif. Metode penelitian hukum normatif dilakukan dengan cara meneliti bahan pustaka yang ada. Penelitian yang dilakukan juga bersifat deskriptif. Di dalam metode penelitian hukum normatif terdapat tiga macam bahan pustaka yang dipergunakan oleh penulis yakni : bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa penegakan hukum pidana di bidang pajak di Indonesia saat ini dilakukan berdasarkan pada peraturan perundang-undangan dibidang perpajakan yang berlaku sebagai Hukum yang Khusus (Lex Spesialis) dibidang Perpajakan, namun jika tidak cukup diatur dalam peraturan perundang-undangan dibidang perpajakan, maka diberlakukan ketentuan sebagaimana diatur dalam Kitab Undang-Undang Hukum Pidana sebagai Hukum yang Umum (Lex Generalis) berdasarkan Pasal 103 Kitab Undang-Undang Hukum Pidana (KUHP).\u0000Abstract\u0000A crime in the field of taxation is an act that violates tax laws and regulations that causes losses to state finances where the perpetrator is threatened with criminal penalties. Criminal acts that can harm state finances or the country's economy should be categorized as a criminal acts of corruption, as defined in the definition of criminal acts of corruption according to the law on eradicating criminal acts of corruption. In addition, this group has proven to be resistant to various kinds of shocks from the economic crisis. It is very important to strengthen the SME group that involves many parties because the SME sector contributes greatly to employment. The criteria for businesses included in SMEs have been regulated under the legal umbrella based on the law, especially Law No. 20 of 2008 concerning SMEs. This study aims to determine the role of banking in empowering SMEs by using the empowerment principle as stated in Law No. 20 of 2008 concerning SMEs. Law No. 20 of 2008 concerning SMEs provides a foundation and an important role for banks and financial institutions in funding and empowering SMEs. In accordance with the principle of empowerment, a broader effort is needed to foster a business climate by establishing laws and policies covering aspects of funding. From an empowerment perspective, banks indirectly play a role in driving the community's economy by channeling funds to the real sector in society. Further, the development of the SME sector will be able to absorb more workers, improve the welfare of the working community the workforce, reduce unemployment, and ultimately alleviate poverty.\u0000Abstrak\u0000Dalam perekonomian, Usaha Kecil dan Menengah (UKM) merupakan kelompok usaha yang memiliki jumlah pelaku usaha terbesar. Selain itu, kelompok ini terbukti tahan terhadap berbagai macam goncangan akibat krisis ekonomi. Penguatan kelompok UKM yang melibatkan banyak pihak ini sangat penting karena sektor UKM memberikan kontribusi besar dalam penyerapan tenaga kerja. Kriteria usaha yang termasuk dalam UKM telah diatur dalam payung hukum berdasarkan undang-undang, khususnya Undang-Undang Nomor 20 Tahun 2008 tentang UKM. Penelitian ini bertujuan untuk mengetahui peran perbankan dalam pemberdayaan UMKM dengan menggunakan prinsip pemberdayaan sebagaimana tertuang dalam UU No. 20 Tahun 2008 tentang UMKM. Undang-Undang Nomor 20 Tahun 2008 tentang UKM memberikan landasan dan peran penting bagi bank dan lembaga keuangan dalam pembiayaan dan pemberdayaan UKM. Sesuai dengan asas pemberdayaan, diperlukan upaya yang lebih luas untuk menumbuhkan iklim usaha dengan menetapkan peraturan perundang-undangan dan kebijakan yang mencakup aspek pendanaan. Dari sisi pemberdayaan, dengan menyalurkan dana ke sektor riil di masyarakat, secara tidak langsung bank berperan dalam menggerakkan perekonomian masyarakat. However, it should be remembered that law enforcement through military courts is the last resort (ultimum remidium) when disciplinary law enforcement by superiors fails to overcome the existing problems. Military Courts are regulated in Article 10 of Law No. 31 of 1997, that Courts under Military Courts are authorized to try crimes committed in the jurisdiction of defendants, including units in their jurisdiction. The protection of judicial independence is usually considered to cover various aspects that operate at different levels, in this case, external and internal independence and institutional and individual independence. External independence refers to the independence of the judiciary from political branches (Executive and Legislative powers), as well as other non-judicial actors. However, there must be a relationship between the judiciary and political power (especially the executive). The importance of the independence, impartiality, and competence of military courts is recognized by all experts. In a number of presentations, it was noted that, in some countries, the issue of command interference and lack of institutional independence remains a source of concern. Regarding the personal jurisdiction of military courts, the Human Rights Committee has discussed this issue, stating that civilians should not submit to the jurisdiction of military courts except in exceptional circumstances. Setelah di kaji lebih dalam menunjukan bahwa ganti rugi dalam pengadaan tanah untuk kepentingan umum merupakan amanat konstitusional dan sebagai kompensasi atas potensi ekonomi tanah yang dimiliki masayarakat. Kemudian pastikan dokumen-dokumen adalah dokumen asli yang diakui oleh negara.\u0000Abstract\u0000Procurement of land for the public interest must ensure justice for the community in acquiring land for the implementation of development, including the provision of compensation for land acquisition for the benefit of the construction of toll roads. In practice, the question arises, why does land acquisition for the public interest need compensation? What is the form of compensation given to the owner of land rights based on the legislation? What efforts should be made by the community to overcome obstacles for the community to get compensation? According to applicable regulations? The methods used in this study include normative juridical, descriptive analysis; types and sources, namely primary and secondary data, qualitative. After further review, it shows that compensation in land acquisition for the public interest is a constitutional mandate and is compensation for the economic potential of the land owned by the community. Compensation can be given as money, replacement land, resettlement, share ownership, or other forms agreed upon by both parties. Efforts that the community must make to obtain compensation are to visit official sources of information such as the Office Village and Subdistrict. Penelitian ini adalah penelitian Yuridis normatif dengan pendekatan yang dilakukan berdasarkan bahan hukum utama dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian. Hasil analisis disajikan secara Kualitatif. Data di lapangan diambil melalui wawancara dengan Pihak Yayasan dan Notaris yang membuat akta sewa menyewa tersebut. Hasil Penelitian ini adalah peran Notaris dalam peralihan aset tersebut adalah Notaris berperan sebagai pembuat perjanjian sewa menyewa atas tanah milik PT Husada kepada Rumah Sakit Khoirunissa. Mekanisme proses peralihan aset Yayasan Rumah Sakit kepada Rumah Sakit yang berbentuk PT adalah melalui perjanjian sewa menyewa. PT Husada menyewakan assetnya berupa tanah dan disewa oleh Yayasan Khoirunisa yang diatasnya didirikan sebuah Rumah Sakit Yayasan bernama RSIA Umi Barokah.\u0000Abstract\u0000UU No. 28 of 2004 concerning Amendments to Law No. 16 of 2001 concerning Foundations, Article 5 paragraph (1) explains that the Foundations' assets are prohibited from being transferred or distributed directly or indirectly. There is a hospital from a foundation that, because of the need to improve hospital management, the foundation which manages the hospital business unit formed a PT to manage the hospital business unit. The formulation of the problem in this research is: 1) What is the role of the Notary in the process of transferring the assets of the hospital foundation to the hospital in the form of PT; 2) What is the mechanism for the transfer of assets from the Hospital Foundation to a Hospital in the form of a PT; 3) What is the legal responsibility of the foundation organs in the effort to transfer the assets of the Hospital Foundation to the hospital in the form of PT. The superiority of regulating human rights in the constitution provides a very tight guarantee because amendments and/or deletion of one of the articles in the constitution, such as in the Indonesian constitution, experience a very difficult and lengthy process, while the weakness is that what is regulated in the constitution only contains rules that are still global in nature. The purpose of this research is to find out and understand the existence of the principle of legality in the applicable laws and regulations in Indonesia, restorative policies in law enforcement against human rights violations in the legal context in Indonesia, and find the ideal legal concept in law enforcement against human rights violations. The type of research to be used is included in the normative legal research group, namely legal research on legal principles, legal systematics, legal synchronization, comparative law, and legal history. So, research or study of legal norms is the legal system’s contents. The results of the study found that the legality principle in Indonesian laws and regulations still needs to be maintained because the essence of the legality principle is to create legal certainty and justice. Retroactive policies in law enforcement against human rights violations in the context of Indonesian law need to be carried out to uphold justice because there are general or greater benefits than protecting the rights of perpetrators that are partial. Apart from functioning as a catalyst for national development, this law also functions to manage spatial planning. This law is also related to land conversion and spatial planning, namely Law No. 26 of 2007 concerning Spatial Planning. Transfer of functions and spatial planning activities need to be synchronized in law to balance the need for land and to control the transfer of functions properly and in accordance with the spatial plan. Consequently, if there is a violation of the spatial plan that is not in accordance with its designation, both the permit giver and the user of the space, criminal sanctions must be applied to minimize the occurrence of land conversion. The Spatial Planning Law is ideal for realizing a safe, comfortable, productive, and sustainable national space based on the archipelago concept and national resilience. It is hoped that the dream of spatial planning can be achieved through the realization of harmony between the natural environment and the built environment, integration of the use of natural resources and artificial resources with due regard to human resources, and protection of spatial planning functions and prevention of negative impacts on the environment due to space utilization.\u0000Abstrak\u0000Pertambahan penduduk, perkembangan industri dan infrastruktur nasional membuat pemerintah mengundangkan Undang-Undang Nomor 2 Tahun 2012 tentang Pengadaan Tanah Untuk Pembangunan Untuk Kepentingan Umum. Selain berfungsi sebagai katalisator pembangunan nasional, undang-undang ini juga berfungsi untuk mengatur tata ruang.
