Tujuan studi ini adalah untuk menganalisis eksistensi restorative justice dalam Rancangan Undang- Undang Kitab Undang-Undang Hukum Pidana (RUU KUHP), dan membedah dasar hukum bagi konsep restorative justice sebagai landasan bagi para penegak hukum untuk bisa dilaksanakan dalam sistem peradilan pidana di Indonesia. Penelitian ini disusun dengan menggunakan jenis penelitian yuridis normatif, penelitian yang difokuskan untuk mengkaji penerapan aturan atau norma dalam hukum positif. Keadilan restoratif tidak diatur secara rinci dalam sistem peradilan pidana tetapi merupakan konsep orientasi baru dalam konsep pemidanaan. Penanganan terhadap pelaku tindak pidana tidak hanya dilakukan secara prosedural dan formalitas baku yang kaku dan terbatas dalam sistem peradilan pidana konvensional. Para penegak hukum diharapkan tidak hanya menghadirkan hukum yang represif, tetapi juga melakukan tindakan hukum yang responsif sebagai hukum yang dicita-citakan (ius constituendum).\u0000Abstract\u0000This research seeks to conceptualize the application of restorative justice in the decency article and also fundamentally needs to reform the law by incorporating the concept of restorative justice into the codification of material criminal law so that it will be more widely involved in the role of the community, perpetrators, and victims in settlement of criminal acts. The purpose of this study is to analyze the existence of restorative justice in the Draft of the Criminal Code (RUU KUHP) and to dissect the legal basis for the concept of restorative justice as a basis for law enforcers to be implemented in the criminal justice system in Indonesia. This research was compiled using normative juridical research, research that is focused on examining the application of rules or norms in positive law. Restorative justice is not regulated in detail in the criminal justice system but is a new orientation concept in the concept of punishment. Handling of perpetrators of criminal acts is not only carried out in a standard procedure and standard formalities that are rigid and limited in the conventional criminal justice system. In accordance with the mandate of Article 24C paragraph (1) of the 1945 Constitution, it stipulates that one of the powers of the Constitutional Court is to decide disputes over election results, which means that this includes post-conflict local election disputes. In this context, the Constitutional Court performs its role to maintain the purity of the people’s voice if there is a voting dispute in the election process. Upholding the constitution is a form of protecting the constitutional rights of citizens and is a consequence of the adherence to the notion of constitutionalism that the 1945 Constitution chose. In this context, the constitution becomes a living constitution in the life of the nation and state. Constitutional values and norms will always be ‘alive’ in the sense that they are constantly developing and enriched with new values and systems based on the practice of the constitution itself and real experiences in everyday life. To maintain the election process in order to achieve the expected results, it cannot rely on only one or two institutions. It requires the cooperation of all state organs, including KPU, Bawaslu, DKPP, police, prosecutors, courts, and the Constitutional Court. All these state organs must work together to make the local elections a success to maintain the sovereignty of the people.\u0000Abstrak\u0000Melalui UU No. 32 Tahun 2004 tentang Pemerintahan Daerah, pemilihan kepala daerah (Pilkada) secara langsung akhirnya dapat diwujudkan. Sesuai amanat Pasal 24C ayat (1) UUD 1945 menetapkan salah satu kewenangan Mahkamah Konstitusi adalah memutus sengketa hasil pemilu, yang berarti di dalamnya termasuk pula sengketa pemilukada. Dalam konteks inilah Mahkamah Konstitusi melakukan perannya, yaitu untuk menjaga kemurnian suara rakyat jika terdapat sengketa suara dalam proses pilkada. Penegakan konstitusi merupakan wujud dari perlindungan hak atas konstitusional warga negara, dan merupakan konsekuensi dari dianutnya paham konstitusionalisme yang dipilih oleh pembentuk UUD 1945. Dalam konteks inilah, konstitusi menjadi “a living constitution”, dalam kehidupan berbangsa dan bernegara. Nilai dan norma konstitusi akan selalu ‘hidup’, dalam arti senantiasa berkembang dan diperkaya dengan nilai dan sistem baru, berdasarkan praktek konstitusi itu sendiri, dan pengalaman nyata dalam kehidupan sehari-hari. Untuk menjaga proses pilkada agar mencapai hasil sesuai yang diharapkan, tentu tidak dapat disandarkan kepada satu atau dua lembaga saja, dibutuhkan kerjasama seluruh organ negara, diantaranya KPU, Bawaslu, DKPP, kepolisian, kejaksaan, pengadilan, serta Mahkamah Konstitusi. Karena tidak ada undang-undang yang mengatur tentang hak milik, pelaksanaan hak ulayat mengalami masalah, pengabaian hak bisa terjadi terhadap masyarakat adat. Kondisi tersebut menunjukkan bahwa tidak ada kemauan politik dan itikad baik dari pemerintah untuk mengakui hak-hak masyarakat adat. Meninggalkan hak ulayat dengan asumsi tergantung perkembangan zaman. Penelitian ini menggunakan metode penelitian normatif atau penelitian kepustakaan (library research) yang menggunakan pendekatan yuridis normatif. Penggunaan metode ini dimaksudkan untuk memperoleh data tentang pengetahuan dasar dan teori-teori yang dibahas secara tertulis dengan melakukan kajian hukum normatif yang digunakan untuk memberikan gambaran tentang realitas atau fenomena pengakuan Hak Ulayat oleh Negara sebagaimana diatur dalam Pasal 3 Undang-Undang Pokok Agraria yang kemudian dianalisis guna menjelaskan keberadaan hak ulayat hingga saat ini. Hasil penelitian menunjukkan bahwa dalam peraturan perundang-undangan keberadaan hak ulayat masih lemah. Selain itu, dalam rangka pembangunan sistem hukum tanah nasional, selain mengatur kedudukan hak ulayat, perlu diatur pula pengertian hak ulayat, subyeknya, bendanya, ciri-cirinya, batas-batasnya, hak dan kewajibannya yang melekat pada ulayat tersebut.\u0000Abstract\u0000The rights of indigenous peoples must be recognized in Article 56 of the Basic Agrarian Law (BAL), that the rights of indigenous peoples will be regulated in laws that have not been implemented. Because no law regulates property rights, implementing customary rights has problems for indigenous peoples. This condition shows that the government has no political will and good faith to recognize indigenous peoples' rights. Leaving Ulayat rights with the assumption that it depends on the times. This study uses a normative or library research method, which uses a normative juridical approach. This use is to obtain data about and theories discussed in writing by conducting a normative legal study which is used to provide an overview of the reality or phenomenon of knowledge of the recognition of Ulayat Rights by the State as regulated in Article 3 of the Basic Agrarian Law which is then analyzed to explain the existing customary rights to date. The results of the study indicate that in the legislation, customary rights are still weak. Kearifan lokal penataan ruang MHA perlu digali melalui penelitian dan pengkajian yang mendalam dalam rangka penataan ruang nasional dan daerah, guna sinergitas dan meminimalisasi perebutan ruang yang seringkali terjadi akibat pelaksanaan pembangunan yang tidak populis dan demokratis. Penataan ruang MHA Arfak Papua Barat, pada jaman dahulu dilakukan oleh para leluhur melalui ritual guna mendapat petunjuk dari sang penguasa jagad dalam rangka keberlanjutan dan keseimbangan kosmis. Saat ini dalam konteks pembangunan nasional, proses dan bentuk penataan ruang itu dilakukan berdasarkan musyawarah MHA dengan pertimbangan tanah, hutan adalam ibu (mama) dan pertimbangan ekologis, berupa kawasan lindung, kawasan produksi dan kawasan budidaya.\u0000Abstract\u0000Indigenous Law Communities (Masyarakat Hukum Adat/MHA) in Indonesia, especially MHA Arfak West Papua, have local wisdom about spatial planning. Local wisdom of MHA spatial planning needs to be explored through in-depth research and assessment in the context of national and regional spatial planning to synergize and minimize space struggles that often occur due to unpopular and democratic development implementation. The spatial arrangement of the MHA Arfak West Papua, in ancient times, was carried out by the ancestors through rituals in order to get instructions from the ruler of the universe in the context of cosmic sustainability and balance. Sejak dimulainya era reformasi sistem ketatanegaraan dan kelembagaan negara, MA sudah merespons adanya perubahan tersebut. Hal ini dapat dilihat dari visi, misi, dan cetak biru MA 2010-2035, yang dilakukan tahap demi tahap. Semua ini dalam rangka penanganan atau penyelesaian perkara yang efektif dan efisien melalui sarana dan prasarana teknologi informasi. Merealisasikan asas peradilan sederhana, cepat, dan biaya ringan bukan lagi hanya slogan semata dalam sistem peradilan saat ini. MA telah membuktikan hal ini, dari setiap laporan tahunan dari tahun ke tahun mengalami peningkatan kinerja (penyelesaian perkara) yang signifikan. \u0000  \u0000Abstract \u0000A simple, fast and low-cost trial is expected to be able to answer the needs of economically weak justice seekers. \"The principle of a simple, fast and low-cost judiciary means that the judiciary must open up wide space for access to justice, especially for those who are economically weak and socio-politically vulnerable. For this reason, courts are required to assist justice seekers in order to receive fair treatment. Law Number 48 of 2009 concerning Judicial Power, Article 2 paragraph (4) states: \"Judicial are carried out simply, quickly and at low cost\" and Article 4 paragraph (2) states: \"The court assists justice seekers and tries to overcome all obstacles and obstacles to a simple, fast, and low-cost trial can be achieved”. A good legal verdict is a legal decision resulting from structural interactions between the arguments of attorneys, lawyers, advocates, witnesses, expert testimonies, and other parties regulated in certain Acts related to the legal cases filed in the court. However, the good process of social interaction requires the accommodation of social forces (social value) and cultural forces (cultural value) of the community where the case occurs. Lately, the response has developed in the midst of a society where the legal verdict by judges in Indonesia does not reflect justice. Justice in society can only be fulfilled in the legal verdict-making process. The question to be asked is whether or not the judge discovers the legal values implemented in society. Discovering the legal values that live in such a society in accordance with legal and normative theories is also regulated in Article 5, paragraph 1 of Judicial Power Act No. 48/2004.\u0000Abstrak\u0000Tulisan ini bertujuan untuk menjelaskan akomodasi kekuatan sosial dan budaya dalam proses pengambilan keputusan hukum oleh hakim di Indonesia. Putusan hukum yang baik adalah putusan hukum yang dihasilkan dari interaksi struktural antara dalil-dalil para kuasa hukum, advokat, advokat, saksi, keterangan ahli, dan pihak-pihak lain yang diatur dalam undang-undang tertentu yang berkaitan dengan perkara hukum yang diajukan di pengadilan. Akan tetapi, proses interaksi sosial yang baik memerlukan akomodasi kekuatan sosial (social value) dan kekuatan budaya (cultural value) masyarakat di mana kasus tersebut terjadi. In relation to the development of the Pancasila ideology, the formulation of the problem is how to arrange policies for the development of the Pancasila ideology to strengthen national resilience in terms of management aspects. Indonesia's national resilience is the dynamic condition of the Indonesian nation, which includes all aspects of integrated national life containing tenacity and resilience, which contains the ability to develop national strength in facing and overcoming all challenges, threats, obstacles, and disturbances coming from outside and from within. To ensure the nation's and state's identity, integrity, survival, and the struggle to achieve its national goals. Aspects of governance in structuring policies fostering Pancasila ideology on national security have a significant influence. Advances in information technology shape the character of the millennial generation, namely wanting to be fast, practical, to the point, and attached to social media. The inculcation of Pancasila values in the millennial generation must be done in a short, solid, and clear way using visual media. The millennial generation has advantages in understanding information technology and smart thinking logically, rationally, and critically. From the normative side, it is clear that alternative dispute resolution is given a wide space to solve disputes between citizens and citizens and the state, especially regarding sharia economic disputes. Law No. 30 of 1999 concerning Arbitration and Alternative Case Resolution regulates dispute resolution outside the Court through Consultation, Negotiation, Mediation, Conciliation, and Expert Assessment. Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution can be said to be the most real and more specific manifestation of the state’s efforts to apply and socialize the institution of peace in sharia business disputes. This law also states that the state gives freedom to the public to resolve their sharia business disputes outside the court, either through consultation, mediation, negotiation, conciliation, or expert judgment. The law is intended to regulate dispute resolution in sharia business disputes outside the court forum by providing the possibility and right for the disputing parties to resolve disputes or differences of opinion between the parties in a forum that is more in line with the parties’ intentions. This forum is expected to accommodate the interests of the disputing parties, especially in terms of sharia economic disputes.\u0000Abstrak\u0000Cara penyelesaian konflik (perselisihan) antar individu dalam masyarakat selama ini, cenderung lebih banyak dilakukan melalui jalur konvensional yaitu penyelesaian perkara melalui litigasi (pengadilan). Sehingga banyak orang ingin mencari cara lain atau lembaga lain dalam penyelesaian sengketa di luar pengadilan melalui alternatif penyelesaian sengketa. Saat ini penyelesaian sengketa atau konflik sudah mulai bergeser ke penyelesaian non litigasi yang dikenal dengan Alternative Dispute Resolution (ADR). Undang-Undang No. 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Perkara mengatur penyelesaian sengketa di luar Pengadilan. yaitu melalui Konsultasi, Negosiasi, Mediasi, Konsiliasi, dan Expert Assessment. Undang-Undang No. 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa dapat dikatakan sebagai wujud paling nyata dan lebih spesifik dari upaya Negara menerapkan dan mensosialisasikan pranata perdamaian dalam sengketa bisnis. Undang-undang ini juga menyatakan bahwa Negara memberikan kebebasan kepada masyarakat untuk menyelesaikan sengketa bisnisnya di luar pengadilan, baik melalui konsultasi, mediasi, negosiasi, konsiliasi, maupun penilaian ahli. Metode yang digunakan yaitu pendekatan kualitatif, dengan teknik pengumpulan data studi kepustakaan, dan teknik analisis data melalui teknik deskriptif analitis kualitatif. Berdasarkan penilaian melalui Instrument Institutional design and governance, Actual autonomy in exercising its mandate dari Westminster Foundation For Democracy (WFD) terdapat beberapa penilaian independensi dan akuntabilitas yang rendah, yaitu pada: (1) sufficiency of financial resources for performing its functions; (2) extent of autonomy to generate its own financial revenues; (3) security and stability of budget during past three years; dan (4) stability of staff and extent of staff turn-over. Ke depan ORI harus memperbaiki beberapa skor rendah independensi dan akuntabilitas dengan relasi kelembagaannya kepada DPR.\u0000Abstract\u0000This paper discusses the independence and accountability of the Ombudsman of the Republic of Indonesia (ORI) in carrying out their duties regarding potential intervention from the People’s Representative Council (DPR). A method is a qualitative approach, with library research data collection techniques and data analysis techniques through qualitative analytical descriptive techniques. Based on an assessment through the Instrument Institutional design and governance, Actual autonomy in exercising its mandate from the Westminster Foundation For Democracy (WFD), there are several assessments of independence and low accountability, namely on: (1) sufficiency of financial resources for performing its functions; (2) the extent of autonomy to generate its financial revenues; (3) security and stability of the budget during the past three years; and (4) stability of staff and extent of staff turn-over. Metode pendekatan yang dipergunakan dalam penelitian ini adalah dengan menggunakan metode pendekatan yuridis empiris. Hasil penelitian menunjukkan kebijakan Ahok sangat kontroversi dengan tidak menerapkan konsep konsolidasi tanah dan terus mendapat penolakan keras dari para warga masyarakat, menjadi sorotan publik dan mendapat kontra dari masyarakat luas di Indonesia karena melakukan penggusuran paksa dan merelokasi warga ke beberapa rusun. Sementara itu, kebijakan Gubernur Provinsi DKI Jakarta Anies Baswedan, yang akan membangun shelter, hunian sementara bagi eks warga di tempat itu yang dahulu tergusur dan berencana menata ulang kawasan tersebut dengan konsep konsolidasi tanah secara konsisten, berkeadilan dan berkesinambungan.\u0000Abstract\u0000This study aims to find out about the policies of the Governor of Jakarta Province, held by Basuki Tjahaja Purnama (a.k.a Ahok) and Anies Baswedan in managing the Aquarium Village Area, North Jakarta. The approach method used in this study is to use an empirical juridical approach. The results of the study show that the policy of Ahok is very controversial because by not applying the concept of land consolidation and continues to receive a strong rejection from the community, it becomes the public spotlight and gets contra from the wider community in Indonesia for carrying out forced evictions and relocating residents to several flats.
