{"title":"Policijas izziņas teorētiskais diskurss un tās īstenošanas problemātika Latvijā starpkaru periodā","authors":"Signe Skutele","doi":"10.22364/juzk.81.39","DOIUrl":"https://doi.org/10.22364/juzk.81.39","url":null,"abstract":"In the interwar period of the Republic of Latvia, with the adoption of the amendments to the Criminal Procedure Law in 1939, legalisation of the inquiry was performed, equating it to the information acquired within preliminary investigation. However, before the implementation of the reform in the Republic of Latvia, information obtained within the framework of the inquiry was already legitimised and used as evidence in the preliminary investigation and court proceedings. Although the reasons for the reform were the improvement of the effectiveness and high qualification of the police, taking into account the theoretical discourse of the police inquiry, it can be established that the implemented reforms strengthened the inquisitorial criminal process without addressing the problems existing in practice. The terms of the rental agreement must comply with the existing practice in civil law circulation and they cannot be excessively short or long. At the end of the transition period from open-ended rental agreements to fixed-term rental agreements, amendments to the law should be considered, as is the case elsewhere in foreign countries, allowing open-ended rental agreements with the right of unilateral withdrawal by either party within a reasonable period of time. Thus, the private autonomy of individuals to choose to enter into open-term residential rental agreements would not be restricted. {"title":"Izvarošana un seksuāla vardarbība: jēdzienu problemātika un tās aktualitāte","authors":"Elīna Zivtiņa","doi":"10.22364/juzk.81.35","DOIUrl":"https://doi.org/10.22364/juzk.81.35","url":null,"abstract":"This article provides an analysis of the usage of terms “rape” and “sexual violence”’ in Criminal Law of Latvia, as well as their compliance with international, grammatical and theological standards. The author analyses whether Article 159 of Criminal Law of Latvia covers all forms of rape, as well as examines the issue of Article 160 of the Criminal Law, its grammatical and theological conformity. In addition, regulations of several European Union Member States are analysed to evaluate how other legal systems deal with the sensitivity of this topic, while justly providing the necessary protection. In the author’s opinion, states are obliged to consider the international definitions of crimes, especially when it comes to rape. Thus, there are four distinctive groups of unlawful transactions: contrary to law, circumventing the law, contrary to good morals, and contrary to religion. The prohibition of unlawful transactions is a restriction of private autonomy. Sometimes transactions have been wrongly considered as unlawful by Latvian courts only because of minor dubious aspects of a transaction. The use of subsidiary sources of law is affected by their availability. One of the subsidiary sources of law is the decision on the contested administrative act. This article analyses the issue of these decisions and making available thereof. It is concluded in the article that the decision on the contested administrative act is not publicly available, and this is an obstacle for its use in making of new decisions. Since the approaches to the matter in hand differ not only between US and Europe, but also amongst the EU countries, there is systemic inconsistency regarding the right of publicity (publicity right) and the right to personality (personality right). Latvia needs to introduce appropriate legal term analogical to publicity right, which describes the right of an individual be protected against unauthorised use of person’s likeness (photo or video) with a commercial or an otherwise public purpose. It is a natural right that arises from the fact of being born. While the right to life seems self-evident today, it still remains an open question whether it also encompasses the right to die, hence – the right to euthanasia. International law does not regulate euthanasia, it is left to the discretion of each state. In this article, the author analyses the compatibility of euthanasia with the Latvian legal system. The article examines whether and how the human right to life can be legally restricted.
