These aspects are considered in connection with the intrusion of a foreign power into the church, subjecting it to destruction, the position of the clergy in relations with the power in the process of sovietisation of the church, providing support to the faithful, earning recognition of the entire nation with their works. Only a church that is secure and strong in its identity can offer its balanced and reasonable vision of our shared values, which a democratic modern society and the state expect from it. {"title":"Atsevišķi problēmjautājumi saistībā ar līgumu izpildi","authors":"Aleksandrs Fillers","doi":"10.22364/juzk.81.10","DOIUrl":"https://doi.org/10.22364/juzk.81.10","url":null,"abstract":"The article analyses two topics that have been rarely discussed in Latvian legal literature. Firstly, like most continental legal systems, the Latvian Civil Law recognizes the so-called exceptio non adimpleti contractus. This is a defence that allows a party to a contract to withhold its performance, if the counterparty does not perform its part of the contract. The article analyses how this defence applies, if the counter-performance is provided but turns out to be defective. Secondly, the article deals with the problem of creditor’s default (mora creditoris). The Latvian Civil Law provides an option for the debtor to terminate the original obligation, if the object of the contract is tangible and the creditor refuses to accept it. The debtor can deposit the object or sell it. However, it does not contain a similar rule for other types of obligations, most notably – services. The legal doctrine also distinguishes actio duplex claim, which is regarded as a claim that may be joined by the defendant without a counterclaim. Such a situation competes with the dispositive principle in civil procedure. Throughout the world, arbitration laws typically aim to provide parties with extensive freedom to tailor arbitration procedure to their specific dispute. The Arbitration Law of Latvia radically diverges from this model, as its rules significantly and disproportionally restrict party autonomy. The most notable deviation pertains to the selection of arbitrators. All the permanent arbitration institutions in Latvia must maintain a mandatory list of arbitrators. Parties are only permitted to select arbitrators from those lists. The authors argue that this restriction is disproportionate and does not promote impartial arbitration. In Latvia, such competence of administrative courts is recognised. However, there is no uniformity in the case law as to whether the court deals with this issue as one of the issues to be decided in an action for the cessation of a real action or an action for a declaration that a real action is unlawful, or whether the court treats it as an action for taking a real action. Rodiņa, Annija Kārkliņa","doi":"10.22364/juzk.81.24","DOIUrl":"https://doi.org/10.22364/juzk.81.24","url":null,"abstract":"Only in 1998, the Constitution of the Republic of Latvia – Satversme, which has been adopted more than a hundred years ago and is one of the oldest constitutions in Europe, was supplemented with a new chapter concerning the regulation of fundamental human rights. Until the adoption of Chapter 8 of the Satversme, only a few fundamental human rights could be found in the Constitution. The article discusses the development of the regulation of fundamental rights in the Satversme, the importance of fundamental rights in a democratic state, as well as reflects the catalogue of fundamental rights. In the article, the authors, looking at the catalogue of fundamental rights included in the Satversme, analyses fundamental rights by dividing them in groups, i.e. civil, political, social, economic, cultural and solidarity rights. The publication outlines the most characteristic features of each group of fundamental rights, points out content of those rights and looks into the recent case law of the Constitutional Court. The article includes evaluation of two practical elements determined by paragraph 1 and 3 (d) of Article 6 of the European Convention of Human Rights, the right to question witnesses in pre-trial investigation and the right to rely on assistance by private experts. The pre-trial stage of proceedings in the Republic of Latvia is not held according to the principle of adversarial proceedings. Therefore, the article will address a question, whether rights of the defence and principle of equality of arms grant the suspect the right to interrogate witnesses and rely on assistance by experts in pre-trial investigation of criminal proceedings.
