{"title":"JUSTICE OF COMPENSATION FOR APPROPRIATION FOR THE PURPOSE OF OPENING ROADS IN JORDANIAN LAW (A COMPARATIVE STUDY)","authors":"Mamdouh Mosleh Mamdouh Alsarayreh","doi":"10.26668/businessreview/2024.v9i4.4656","DOIUrl":"https://doi.org/10.26668/businessreview/2024.v9i4.4656","url":null,"abstract":"Objective: This study aims to define the concept of fair compensation, and how the Jordanian constitution gives the ordinary legislator the authority to determine the nature of fair compensation so that he may stipulate deducting part of the property free of charge, or did the constitutional legislator grant the ordinary legislator the authority to determine how to estimate the value of fair compensation as stated in Comparative legislation. \u0000  \u0000Theoretical Framework: The study employs a theoretical framework rooted in distributive justice theory, particularly drawing upon the perspectives of Rawls, Nozick, and Sen, the study evaluates the principles underlying fair compensation and its practical application in legal systems. \u0000  \u0000Design/Methodology/Approach: This study follows a comparative analytical descriptive approach in dealing with the position of comparative legislation on fair compensation in the first requirement, and we will devote the second requirement to the position of the Jordanian legislator on fair compensation stipulated in Jordanian legislation. \u0000  \u0000Result: The results of the study showed that appropriation for the public benefit has become recognized in constitutions and comparative legislations, as these legislations have defined the procedures for obtaining real estate to be appropriated in order to achieve the public benefit, and these legislations also included the principle of the owner's right to receive fair compensation that compensates the damage caused as a result of appropriation. \u0000  \u0000Research, Practical & Social Implications: The study concluded that the legislations have differed in how to estimate fair compensation, some of which stipulate that the compensation must be complete without taking into account the impact of ownership on the remaining parts of the property and neighboring properties, and some of which introduced the concept of a free quarter such as the Jordanian law of ownership in the acquisitions of roads. The incivility experienced is closely associated with low job satisfaction and sub-optimal employee performance, high levels of stress and burnout, and a strong desire to leave the job. Perceived supervisor support refers to the perception among employees of how much their supervisors value their contributions and care about their well-being.\u0000 \u0000Design/Methodology/Approach: Determination of the sample using purposive sampling method involving employees who work in the renewable energy industry in Jakarta as many as 210 respondents. Analysis tool is Structural Equation Modeling (SEM) using AMOS version 22.0.\u0000 \u0000Findings: It was found that Workplace Incivility does not affect Organizational Identification but, Perceived Supervisor Support and Job Satisfaction have an influence on Organizational Identification. The implication of Organizational Identification has an influence on Employee Performance and Turnover Intention, but Employee Performance does not affect the Turnover Intention of employees working in renewable energy in Jakarta.\u0000 \u0000Research, Practical & Social Implications: From the results of this study, management can get used to the culture that superiors should pay more attention to the performance of employees. In addition, management can consider that employees are part of the company, with this, employees will be more confident in their identity in the company which will increase Organizational Identification. High Organizational Identification is proven to improve Employee Performance and reduce Turnover Intention of employees.\u0000 \u0000Originality/Value: The addition of turnover intention variables is the difference between this research and the previous one. The research was conducted in renewable  energy company in Jakarta, Indonesia. This approach seeks to identify and address burnout risks comprehensively.\u0000 \u0000Theoretical Framework: Drawing from burnout theories alongside Bayesian networks and fuzzy logic, this research establishes a robust foundation for understanding burnout complexities and evaluating the efficacy of the proposed hybrid approach.\u0000 \u0000Method: The methodology encompasses a model development phase utilizing OpenMarkov and FisPro to integrate Bayesian networks and fuzzy logic. Data collection involved a multifaceted approach including surveys, expert interviews, and a thorough review of literature focusing on workload, work environment, psychology, and other pertinent factors influencing burnout.\u0000 \u0000Results and Discussion: Findings indicate that burnout tends to manifest at lower levels in scenarios characterized by weak communication, high workload, and low obstacles, while it escalates in situations marked by weak communication, occasional workload spikes, and moderate obstacles, among other contributing factors. These results are analyzed within the context of the theoretical framework, emphasizing their implications for individual well-being and organizational success.\u0000 \u0000Research Implications: This study provides actionable insights for companies, particularly human resources managers, to bolster employee psychological support systems and advance organizational objectives. Proactively addressing burnout risks can enhance both employee well-being and overall organizational performance.\u0000 \u0000Originality/Value: By proposing a hybrid methodology that merges Bayesian networks and fuzzy logic to comprehensively tackle burnout risks, this research contributes to the existing literature. This study also examines the mediating effect of engagement between variables. \u0000  \u0000Methodology: Data were collected from survey using existing variable measurements and gathered 200 responses from Indonesian workers. Partial least squares structural equation modeling (PLS-SEM) was employed to examine the study model using SmartPLS 4. \u0000  \u0000Findings: Recognition and employee engagement significantly impact intention to stay, while work environment doesn't. Work environment influences intention through engagement, while recognition directly influences it without mediation. Generation only moderates the effects of engagement on intention to stay. \u0000  \u0000Originality/Value: The study highlights the complex interaction between recognition, work environment, employee engagement, and generation in influencing intention to stay. El interés de la enseñanza de estrategias reside en la potencialidades que se le da al sujeto para controlar y regular sus procesos mentales de aprendizaje, lo que le permitirá mejorar su rendimiento y sobre todo su capacidad de aprender autonomamente a partir de sus propios recursos. El próposito del desarrollo de habilidades de estudio y de aprendizaje escolar es lograr el éxito académico a través del dominio de técnicas y adoptar recursos e instrumentos por los estudiantes.\u0000 \u0000Método: El método aplicado es de enfoque cualitativo, de alcance descriptivo, diseño no experimental. Para la obtención de datos se aplicó un test de habilidades de estudio que considera tres dimensiones: organización, técnica y motivación escolar, estudio aplicado a una muestra de 294 estudiantes universitários.\u0000 \u0000Resultados y Discusión: De los resultados obtenidos se observa un déficit considerable en las habilidades de estudio en los universitarios al no contar con un método específico, se identifica la necesidad de adoptar una técnica de estudio, debido al comportamiento de atención, distracciones y falta de motivación de estudio. Dejan en segundo lugar la práctica de actividades escolares, lo que deja como resultado un bajo rendimiento académico e insatisfacción personal. Algo favorable es, que el estudiante manifiesta la necesidad de adoptar un plan de mejora para su vida escolar que debe ser implantado a través de la organización, la disciplina, el manejo del tiempo en la vida escolar.\u0000 \u0000Implicaciones de la Investigación: El estúdio deja de manifiesto que el desempeño y rendimento académico esta afectados no solo por la falta de habilidades de estudios sino tambien por la carencia de hábitos, disciplina, organización y motivación escolar que presenta el estudiante.\u0000 \u0000Originalidad/Valor: El estudio se remite a identificar las necesidades y deficiencias que se presentan en educación superior debido a la falta de habilidades y hábitos de estudios. The statistics used in the data analysis comprised descriptive statistics and structural equation model analysis. \u0000  \u0000Results and Discussions: The results showed that the maximum mean factors were online shopping behavior (mean=5.54, SD.= .681), intention to purchase (mean=5.52, SD.= .704), and subjective norms (mean=5.19, SD.=.924), respectively. The results of casual model analysis found that intention to purchase, and subjective norms affected the online shopping behavior of Y Gen consumers with statistical significance. However, the controllability factor was not statistically significant. \u0000  \u0000Research Implications: Therefore, consumers' perceptions of using technology through social media purchases are seemingly increasing. Accordingly, entrepreneurs in the e-market should use big data to analyze consumer behavior, communicate with consumers, and publicize information efficiently. Consumer groups want to try new things and challenges, and like using a convenient internet to save time, searching products, purchase, and make transactions on one platform via social media. \u0000  \u0000Conclusions: The retail industry has fully entered the digital age, which is evident by the vast number of consumers who use various online platforms. Further, this trend is continuously increasing due to the constant development of modern technology to facilitate consumers and increase the efficiency of commerce. At present, changing consumer behaviors affect various activities and consumption behaviors, especially in terms of consumers spending less time purchasing products in stores and spending more time buying goods and services online using various technological means. The aim of the study is to examine diversity in the workplace to achieve collective organizational commitment in public sector organizations in Nigeria.\u0000 \u0000Theoretical Framework: In this topic, the main concepts and theories that underpin the research are presented. The theory that is related to this work having reviewed some theories is the Social Identity Theory. Social identity theory is a social psychological theory that is utilized in organizations to obtain high employee performance. Social identity theory gives more understanding of diversity in terms of understanding the role of group divisions in organization.\u0000 \u0000Method: The study relied on a self-developed structured questionnaire as the instrument for data collection. Using SPSS version 20 software, descriptive statistics and multiple regression analysis were used to assess the data and statistically analysed the data that had been collected.\u0000 \u0000Results and Discussion: The findings revealed that job-related diversity has a significant effect on collective organizational commitment in public sector organizations in Nigeria (β=0.077, p<0.05), and that cultural diversity has no significant effect on collective organizational commitment in public sector organizations in Nigeria (β =0.030, p>0.05).\u0000 \u0000Originality/Value: Previous studies had focused on different types of diversity and their attributes, but have not adequately addressed the factors that can strengthen the relationships. This study to filled this gap by examining the impact of workplace diversity on organizational commitment in the Nigerian Public Sector Organizations. {"title":"HUMAN RESOURCES MANAGEMENT AND ORGANIZATIONAL BEHAVIOR: CASE STUDY IN A CONSULTATION COMPANY","authors":"Marina Fernandes, João Pedro Cordeiro","doi":"10.26668/businessreview/2024.v9i4.4458","DOIUrl":"https://doi.org/10.26668/businessreview/2024.v9i4.4458","url":null,"abstract":"Objective: To Analyze the relationship between human resources management and organizational behavior, in light of the analysis of high-performance work practices and workers' organizational commitment.\u0000Theoretical Framework: This study focuses on the “high performance work practices” (Pfeffer, 1998; Becker, et al. 2001) which refer to a set of practices that aim to select, develop, and retain workers, especially the most innovative ones, to maximize the organization's performance.\u0000Method: A case study was carried out in an innovation and technology consultancy organization, based on the application of a questionnaire survey on the components of organizational commitment (Nascimento et al., 2008) and the perception of workers regarding high performance work practices (Esteves, 2008). The sample is mainly composed of male professionals, between 26 and 34 years old and with a undergraduate or bachelor’s degree.\u0000Results and Discussion: The results show some consistency with previous empirical studies: high performance work practices are present in this type of organization; professionals are affectively committed to the organization; there are significant correlations between high performance work practices and organizational commitment, especially at the level of affective commitment.\u0000Research Implications: Assists in the design and implementation of practical human resources management strategies for managers, which contribute to the formulation of management systems focused on organizational commitment behaviors of professionals in the context of the consultancy sector.\u0000Originality/Value: It is a pioneering study developed in a national context on the two constructs in the consulting sector, contributing to the literature by highlighting the importance of a relational and reflective approach to the importance of organizational behavior. Furthermore, with the need for clean, safe food, organic agriculture is also receiving more attention from the government, consumers and businesses. This study aims to examine factors affecting supply chain cooperation based on a survey sample of 120 managers from businesses in the organic agricultural supply chain in Hanoi, Vietnam. From this analysis, we provide solutions to promote cooperation in the supply chain for the organic agriculture industry in Hanoi, Vietnam.\u0000 \u0000Design/Methodology/Approach: This article uses the research method of analyzing and synthesizing theories about cooperation in the supply chain, thereby providing a research model. Then we use quantitative methods, exploiting the random approach to analyze factors affecting cooperation in the organic agricultural supply chain through surveying subjects that involved in organic agricultural supply chains in Hanoi, Vietnam.\u0000 \u0000Findings: The research results describe the impact of factors affecting cooperation in the supply chain, showing the level of influence of these factors on cooperation. Through the level of impact, the authors propose solutions to enhance cooperation in the organic agricultural supply chain.\u0000 \u0000Originality/Value: To the author's knowledge, this study is original in describing the impacts of factors affecting the cooperation of organic agricultural supply chains in Hanoi, Vietnam.
