This research aims to analyze the validity of the notarial power of attorney deed used as collateral for debts and receivables, as well as examine the civil responsibility of the Notary for the power of attorney deed made before him. The research method is normative juridical, which is analyzed qualitatively with deductive logic. The type of data used is secondary data. The results of this research are: first, The sale of collateral objects by creditors themselves can be carried out as long as the provisions of Article 20 paragraph (2) UUHT are met. selling the object of collateral rights, this agreement between the creditor and the debtor is an agreement agreed upon after a default by the debtor. In the event that the power of attorney deed that has been prepared by the creditor is signed simultaneously at the time of signing the credit agreement between the creditor and the debtor, then the power of sale deed is contrary to Articles 6 and 20 UUHT, so that such power of sale deed does not legally have any legal standing. Second, the Notary's responsibility for the deed of power of sale in a debt and receivable agreement made before him can be borne by the Notary if the error comes from the Notary, for example in the case that the author examined where Notary SN, in making the deed of power of sale, committed an unlawful act because he directed the debtor to sign the deed. which is still blank without explaining the purpose of the deed. So then the debtor is disadvantaged by the existence of the power of attorney deed, because by using the power of attorney deed, the creditor secretly transfers the debtor's collateral to a third party at a very low price, even though the debtor is not in default. In this case Notary SN can be burdened with civil liability, namely Unlawful Actions Article 1365 of the Civil Code.","PeriodicalId":502776,"journal":{"name":"International Journal of Social Science and Human Research","volume":"4 5","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-05-04","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"141014467","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

In this research, the author analyzes what factors encourage investors to decide to invest in shares in the capital market. This research uses the Systematic Literature Review (SLR) method. This research comes from articles published in 2020-2023 found in Publish or Perish and Google Scholar. Data is collected, identified and assessed before being systematically reviewed with the aim of supporting further research. The results of this review show that during the Covid-19 pandemic, many investors made stock investment decisions in the capital market due to psychological factors. As a result of the economic problems that have arisen as a result of the Covid-19 pandemic, many people's perspectives have changed from previously preferring traditional investments such as deposits to looking for investment options that provide high returns such as mutual funds and shares with different investment objectives. This is also supported by the rapid development of digital and information technology during the Covid-19 pandemic, which has caused public participation in the capital market to increase. Many fintech companies that adopt automatic investment technology are able to remove obstacles for potential investors who lack investment literacy and limited capital without having to study and understand the entire investment scheme in the capital market. Apart from that, financial literacy is also mentioned as a factor that can determine stock investment decisions because the knowledge that comes from literacy will strengthen stock investment decisions.","PeriodicalId":502776,"journal":{"name":"International Journal of Social Science and Human Research","volume":"24 2","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-05-04","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"141014219","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The pattern of combating corruption has changed, law enforcement officials no longer only pursue criminal offenders and imprison them (follow the suspect), but also carry out efforts to trace, confiscate and for feit all assets that are the proceeds and instruments of criminal acts (follow the money). Various obstacles arise in efforts to seize assets that are the proceeds or instruments of criminal acts, one of which is the absence of legal rules governing the mechanism for the seizure of assets resulting from gratification crimes in cases that are stopped by law. The method used in this research is normative legal research, using a statutory approach (statue approach) and Court Decisions. This reserach aims to examine and formulate an ideal criminal law policy in the seizure of confiscated objects in the form of assets of gratification suspects whose cases are stopped for the sake of law in the future. The results in this research show that asset seizure in the eradication of corruption currently still places asset seizure as an additional crime so that asset seizure is still based on the defendant's guilt (conviction based asset forfeiture), in addition to through the criminal mechanism of asset forfeiture can also be done through civil mechanisms with the concept of non-conviction based asset forfeiture, but there is no rule governing the asset forfeiture mechanism proceeds of gratification in cases that are stopped by law. The criminal policy of asset seizure in the future based on the Asset Forfeiture Bill related to Criminal Acts with the concept (non-conviction-based asset forfeiture) has clearly regulated the mechanism for the seizure of assets belonging to Suspects or Defendants who died, escaped, became permanently ill, or whose whereabouts are unknown, so as to overcome the legal vacuum in terms of seizure of assets resulting from gratification crimes in cases that are stopped by law.","PeriodicalId":502776,"journal":{"name":"International Journal of Social Science and Human Research","volume":"105 31","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-03-26","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140380477","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

This research aims to examine the suboptimal implementation of the Restorative Justice process for children who are perpetrators of narcotics crimes. The effectiveness of prison sentences for children who abuse narcotics is weakened when the responsibility for their rehabilitation is not borne by law enforcement officials. The problems in this research include two main questions regarding what existing regulations relate to legal protection for children involved in drug abuse and how the application of Restorative Justice methods can improve legal protection for children involved in drug abuse. The research methodology used in this research is normative juridical, with qualitative descriptive data analysis techniques. Research findings show that legal protection for children involved in drug abuse in Indonesia is realized through the implementation of the Juvenile Criminal Justice System Law, the Narcotics Law, and the Child Protection Law. Problem solving for minors involved in drug abuse must be based on the principles of restorative justice, which emphasizes restoration of their original condition, and not imprisonment as a form of retaliation. From the perspective that the incorporation of a restorative justice framework must become an integral part of the criminal justice system, it is important to consider the restorative approach as a new paradigm that offers greater effectiveness compared to the punitive strategies used in dealing with cases of child drug abusers.","PeriodicalId":502776,"journal":{"name":"International Journal of Social Science and Human Research","volume":"119 50","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-03-26","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140380271","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

On the one hand, it brought an authentic experience of the sudden collapse of the economic cycle, on the other hand, it tested the strength, credibility and management skills of governments. The slowdown in economic activity as a result of the coronavirus pandemic, forced quarantines and emergencies showed a number of differences and specifics between countries. These are, among other things, the result of different approaches of individual governments and their ability to solve the crisis. The primary goal of this article is to analyze the political dimension of the pandemic crisis. In connection with the hypothesis of the political economic cycle, we ask the question to what extent the pandemic crisis affected its mechanism. Has the pandemic crisis become a limiting factor in the concept of the political-economic cycle? In the context of the relevant phases of the political cycle of two institutionally close countries, we analyze and compare the approach of their governments (the Czech Republic and the Slovak Republic) to solving the coronavirus crisis and examine whether governments can influence the performance of the economy in this extraordinary situation in accordance with the theoretical assumptions of the political economic cycle.","PeriodicalId":502776,"journal":{"name":"International Journal of Social Science and Human Research","volume":" 2","pages":""},"PeriodicalIF":0.0,"publicationDate":"2024-03-22","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"140216174","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":0,"RegionCategory":"","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
