In the current development of technology and global economic competition, patented technologies often serve as standards (Standard Essential Patent, or SEP). The implementation of SEP itself is possible as long as the patent holder agrees and adheres to the principles of fair, reasonable, and non-discriminatory terms, also known as FRAND (Fair, Reasonable, and Non-Discriminatory) principles. When the FRAND principles are not followed, for example, when the patent holder is unwilling to provide a license or sets the licensing fee too high, issues may arise. Adanya beberapa permasalahan yang bersumber dari adanya ketidaksamaan pemahaman atau tidak adaya unifikasi kebijakan dalam menetapkan status pelaku sebagai saksi pelaku yang bekerjasama atau justice collaborator oleh para penegak hukum. Selain itu, adanya permasalahan mengenai ketiadaan manfaat yang dialami oleh tersangka atau terdakwa dari penetapan saksi pelaku yang bekerja sama atau justice collaborator tersebut tentunya menimbulkan adanya ketidakpastian hukum dan juga tidak memberikan kemanfaatan atau utilitas bagi pihak yang ditetapkan sebagai saksi pelaku yang bekerja sama atau justice collaborator. Rumusan permasalahan dalam tulisan ini adalah bagaimana pengaturan tentang kebijakan penetapan saksi pelaku yang bekerjasama atau justice collaborator dalam perkara tindak pidana korupsi dan bagaimana rekonstruksi kebijakan penetapan Saksi Pelaku Yang Bekerjasama (Justice Collaborator) dalam perkara tindak pidana korupsi yang memberikan aspek kepastian hukum dan aspek kemanfaatan dalam sebuah sistem peradilan pidana terpadu. Tipe penelitian yang digunakan adalah normatif, dengan menggunakan pendekatan Undang-Undang dan regulasi lainnya. Sifat penelitian deskriptif, dengan menggunakan data sekunder. Analisis penelitian dilakukan dengan cara kualitatif dan metode penarikan kesimpulan secara deduktif. Pada prakteknya terdapat berbagai maca regulasi yang mengatur tentang tentang kebijakan penetapan saksi pelaku yang bekerjasama atau justice collaborator dalam perkara tindak pidana korupsi. Pengaturan tersebut mulai dalam bentuk Undang-Undang sampai dengan bentuk Peraturan Bersama dari lembaga penegak hukum dan Surat Edaran. Pengelolaan Hak Ekonomi atas suatu Ciptaan merupakan hak eksklusif bagi Pencipta untuk mendapatkan keuntungan ekonomi atas pemanfaatan karya ciptanya, Lalu bagaimana dengan suatu ciptaan yang tidak diketahui Penciptanya dalam pengelolaan hak ekonominya dipegang oleh Negara. Ketentuan Pasal 39 Undang- undang Nomor 28 Tahun 2014 tentang Hak Cipta belum mengatur secara teknis dengan peraturan dibawah undang-undang sehingga belum dapat dilaksanakan. Demikian pula dengan karya cipta yang tidak diketahui Penciptanya dan merupakan ekspresi budaya tradisional (kekayaan Intelektual Komunal) atau karya cipta yang sudah habis jangka waktu pelindungan hukumnya serta dilestarikan oleh masyarakat, belum diatur secara jelas. Negara Inggris telah melakukan pengaturan tentang pemaanfaatan atas pemberian izin atau lisensi terhadap karya cipta yang tidak diketahui Penciptanya atau yang disebut dengan Orphan works. Karya cipta yang tidak diketahui Penciptanya atau disebut dengan Orphan work adalah karya kreatif atau pertunjukan yang tunduk pada ketentuan Hak Cipta serta mendapatkan pelindungan hukum antara lain seperti buku harian, foto, film, atau karya musik, yang penciptanya atau pemegang haknya tidak diketahui atau tidak dapat ditemukan. Kantor Hak Cipta Inggris mengelola hak cipta atas ciptaan yang tidak diketahui Penciptanya yaitu memberikan lisensi atau penggunaan izin kepada para pihak pengguna yang akan melakukan pemanfaatan atau penggunaan atas Ciptaan tersebut. The research method employed is a comparative analysis, gathering data through literature review and analysis of elections in Indonesia. The analysis reveals that the open electoral system is more proportional, as it excels in expanding public participation, enhancing political representation, and strengthening party accountability. However, challenges in vote calculation and potential vote splitting still need to be addressed. Pandangan masyarakat tentang malpraktik dokter adalah ungkapan tentang suatu kesalahan dokter yang tidak dapat ditoleransi kesalahannya. Walaupun saat sekarang praktik dokter berupa tatap muka secara online. Terdapat 298 pengaduan kasus sengketa medis sejak sejak 2016 sampai 25 Juni 2021. Dari hal tersebut timbul permasalahan tentang relevansi malpraktik medis saat ini dengan tindak pidana umum dalam perundang-undangan. Jenis penelitian yuridis normatif dengan pendekatan kepustakaan, pendekatan kasus dan pendekatan konseptual. Hasil penelitian ini dapat bermanfaat sebagai pedoman bagi semua penegak hukum dan atau badan peradilan dan atau organisasi induk dokter dan atau advokat medis. Ditemukan bahwa semua perundang-undangan yang ada saat ini belum mengatur keseluruhan tentang perbuatan atau peristiwa hukum dengan subjek hukum seorang dokter yang melaksanakan pekerjaan profesinya seperti tercantum pada Undang-Undang Nomor 29 Tahun 2004, Peraturan Menteri Kesehatan Nomor 2052 Tahun 2011, Undang-Undang Nomor 8 Tahun 1999, dan Kode Etik Kedokteran. Memaksakan kasus malpraktik medis menggunakan Kitab Undang-Undang Hukum Pidana dan menyetarakan sebagai tindak pidana umum.
