While numerous studies have examined its direct effect on children's substance use, less research has focused on the mechanisms through which parental imprisonment may indirectly increase this risk. Drawing from general strain theory and routine activities theory, this longitudinal study investigates two potential mediators in the relationship between parental imprisonment and children's substance use: victimization and depression. Using longitudinal data from a national study on adolescents and adults in the United States, we conducted a mediation path analysis with a bootstrapping technique. The results revealed a significant indirect association between parental imprisonment and youth substance use, mediated by victimization, but only for other illicit drug use. The data did not support a sequential mediation path via victimization and depression. These findings highlight important policy implications for disrupting the pathway from parental imprisonment to adverse child outcomes.</div></div>","PeriodicalId":48272,"journal":{"name":"Journal of Criminal Justice","volume":"99 ","pages":"Article 102460"},"PeriodicalIF":3.3,"publicationDate":"2025-06-27","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"144502590","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":1,"RegionCategory":"社会学","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Critics argue HALT increases carceral violence by limiting disciplinary discretion, while the NY Department of Corrections and Community Supervision (NYDOCCS) argues violence predates HALT. This study, drawing on interviews with 15 staff and 87 residents from two NY men's prisons, examines carceral violence and reform as threats to legitimacy through the lens of institutional theory. Interviewees reported heightened perceptions of violence, though few directly attribute it to HALT. Staff cited reduced disciplinary authority, while residents noted more punitive staff behavior. The findings reveal legitimacy crises for both staff and residents, as NYDOCCS faces pressures to rebuke HALT. Thus, HALT emerges as a scapegoat for persistent carceral violence, its potential hindered by entrenched routines and misperceptions. Addressing violence as a legitimacy issue is key to achieving meaningful and sustainable prison reform.</div></div>","PeriodicalId":48272,"journal":{"name":"Journal of Criminal Justice","volume":"99 ","pages":"Article 102463"},"PeriodicalIF":3.3,"publicationDate":"2025-06-26","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"144491803","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":1,"RegionCategory":"社会学","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Anonymous self-report data were collected from <em>N</em> = 8348 Swiss adolescents (<em>M</em><sub>age</sub> = 17.95 years, SD = 1.42; 48.5 % females) from 585 classrooms, part of a randomly selected national probability sample. Individual-level variables included background variables, immigrant status, low self-control, and deviance. School-level variables included classroom-level SES, immigrant composition, and low self-control, class size, school educational track, and school locale. Findings from multilevel model tests indicated that individual- and classroom-level variables accounted for unique variance in deviance. Low self-control and all other individual-level variables (except for SES) predicted deviance, and the associations varied across classrooms. Classroom immigrant composition and educational track predicted deviance. Classroom low self-control and immigrant composition, in particular, explained variation in the associations between individual factors and deviance. A higher proportion of immigrant youth in classrooms was associated with a higher level of deviance among male but not female adolescents, a novel immigrant paradox. Study findings provide important evidence for school contextual effects in understanding adolescent deviance.</div></div>","PeriodicalId":48272,"journal":{"name":"Journal of Criminal Justice","volume":"99 ","pages":"Article 102465"},"PeriodicalIF":3.3,"publicationDate":"2025-06-24","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"144366607","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":1,"RegionCategory":"社会学","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Using records of guns recovered in crime in California (2010–2021; <em>n</em> = 370,498), we examine rates of legal and illegal possession, and how they vary across offense types. Linking these “crime gun” records to firearm transactions in the state (2000−2021), we implement Cox Proportional Hazards models to identify characteristics associated with law enforcement recovery from an illegal versus legal possessor. We estimate separate models for violent crime recovery and conduct sex-stratified analyses. Among all recovered handguns, 61 % were illegally possessed, 24 % were legally possessed, and possession status was unknown for 15 %. Legal possession varied substantially by crime type: for example, 56 % of handguns recovered in threats were legally possessed, 37 % in homicides and assaults, and 20 % in robberies. Results from the survival analyses showed stolen firearms were associated with a 31-fold higher hazard of violent crime recovery with an illegal possessor compared to a hazard of 1.8 for legal possession recovery. Sex-stratified analyses revealed patterns consistent with straw purchasing: for example, female buyers with 12+ recent purchases had a 13-fold higher hazard of illegal possession recovery; there was no association with legal possession recovery. A purchaser's prior arrest history was associated with recovery, with larger hazards for legal possession. This study provides the first systematic examination of possession status by crime type. The considerable proportion of legally possessed crime guns, particularly in violent crimes, highlights the need for prevention strategies that address both legal and illegal acquisition pathways.</div></div>","PeriodicalId":48272,"journal":{"name":"Journal of Criminal Justice","volume":"99 ","pages":"Article 102457"},"PeriodicalIF":3.3,"publicationDate":"2025-06-24","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"144471573","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":1,"RegionCategory":"社会学","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

The distinction between these subtypes is based on whether a missed court appearance triggers a formal judicial response, which we interpret as a proxy for <em>willfulness</em>. To address potential selection bias, we apply inverse probability of treatment weighting (IPW) and estimate average treatment effects on the treated (ATT). Results indicate that financial release significantly reduces the likelihood of inconsequential FTA, associated with unwilful nonappearance (ATT = −0.16, <em>p</em> &lt; .001), but has no effect on consequential FTA, associated with willful nonappearance. Further analyses reveal no significant differences in these effects across self-reported racial/ethnic or sex categories. By bifurcating FTA into conceptually distinct subtypes, our findings suggest that the impact of financial release depends on the nature of court noncompliance and may outweigh concerns about demographic disparities in release decisions. These results offer guidance for reform efforts aimed at minimizing the collateral consequences of the pretrial process by limiting the use of financial conditions to incentivize appearance.</div></div>","PeriodicalId":48272,"journal":{"name":"Journal of Criminal Justice","volume":"99 ","pages":"Article 102458"},"PeriodicalIF":3.3,"publicationDate":"2025-06-23","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"144366606","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":1,"RegionCategory":"社会学","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Culturally shared prejudicial beliefs, known as ‘rape myths’, are widely reported to undermine the perceived credibility of complainants in jury deliberations. Most evidence of rape myths is abstracted from the interactional practices in which they are built. Adopting a Discursive Psychological approach, we examine how such ‘myths’ are embedded into jurors' accounts during deliberations. Employing conversation analysis we interrogate how ‘rape myths’ are used within 435 minutes of deliberations from a realistic live trial re-enactment. We describe jurors' use of, ‘discrediting contrastive devices’; used to discredit the complainant's testimony by contrasting their behaviour with what a “typical” person would do prior to, during, and following a rape. We explore rape myths not as social-cognitive states, but as interactional devices deployed while describing, arguing, and persuading, and that are to be supported, resisted, and reformulated by jurors. We argue that it is crucial to understand the circulation of ‘rape myths’ as cultural knowledge and logic <em>in use</em>. We offer further insight into the existence and impact of prejudicial rape myths within jury deliberations, contributing to ongoing debate in rape trial jury functionality and reform.</div></div>","PeriodicalId":48272,"journal":{"name":"Journal of Criminal Justice","volume":"99 ","pages":"Article 102461"},"PeriodicalIF":3.3,"publicationDate":"2025-06-21","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"144335772","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":1,"RegionCategory":"社会学","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}

Demonstrating measurement invariance provides evidence that items included in a proposed construct are responded to similarly by different groups of people. In this study we provide evidence of measurement invariance of a five-item measure of prison procedural justice across sex, race/ethnicity, age, time in prison, and security level. However, given data limitations, some questions remain regarding the applicability of the proposed measure across sex and security level, specifically females incarcerated in maximum-security facilities. As applications of procedural justice move beyond policing, it is important we understand how to reliably measure procedural justice in other criminal justice contexts and have measures empirically shown to be reliable and valid for future research. This study offers researchers with such a construct in the form of a short, reliable measure of people in prison's perceptions of correctional officer procedural justice.</div></div>","PeriodicalId":48272,"journal":{"name":"Journal of Criminal Justice","volume":"99 ","pages":"Article 102459"},"PeriodicalIF":3.3,"publicationDate":"2025-06-20","publicationTypes":"Journal Article","fieldsOfStudy":null,"isOpenAccess":false,"openAccessPdf":"","citationCount":null,"resultStr":null,"platform":"Semanticscholar","paperid":"144331421","PeriodicalName":null,"FirstCategoryId":null,"ListUrlMain":null,"RegionNum":1,"RegionCategory":"社会学","ArticlePicture":[],"TitleCN":null,"AbstractTextCN":null,"PMCID":"","EPubDate":null,"PubModel":null,"JCR":null,"JCRName":null,"Score":null,"Total":0}
