This regime is more convenient and accessible to the Citizens', and requires development of a legal framework that does not currently exist. Proactive public services algorithms legal regulation model is the purpose of this paper. The goal includes clarifying the concept and content of proactive public services, developing their typology, differentiating its legal regimes and designing a legal model for data processing. In order to achieve the goal, a set of methods was used: formal legal, the method of legal interpretation, as well as the comparative legal method. Research results suggest the typology of proactive services; proposals for differentiating the legal regimes of personal data processing and big data for the provision of proactive services, a legal model of data processing. {"title":"ANALYSIS OF STRATEGIES FOR DIGITAL TRANSFORMATION OF RUSSIAN REGIONS IN THE CONTEXT OF ACHIEVING NATIONAL GOALS","authors":"V. Abramov, V. The indicators are determined by the methodology of the Ministry of Digital Development, Communications and Mass Media of the Russian Federation. Based on these indicators, a planned index of digital maturity was determined for five key industries in each of the regions of Russia under consideration: education, healthcare, public administration, public transport and urban economy. It is shown that the expected rate of digital transformation in different industries will vary significantly. In the regions, there have been identified advanced, medium-high, medium-low and lagging regions in the field of digital transformation for the planned period. Based on the results of the study, the authors recommend creating a comprehensive federal program to help increase the digital maturity index in lagging industries, which will solve the problem of digital transformation imbalance and the problem of lagging regions. There are three main modes of operation in the Brazilian public administration:patrimonialism, bureaucratic and managerial. Even though reforms have taken some effect over the decades, all three modes subsist in different forms in the public organizations. After the democratization of the country, there has been a decentralization process and a growing influence of civil society on public affairs, but accountability is still low. Reforms were carried out by authoritarian and democratic governments from different political spectrums, but the quality of public administration and governance still suffers from ineffectiveness in the delivery of public services and patrimonialism, resulting in many cases of corruption and mismanagement. Analyzing modern public governance concepts ranging from participatory management to smart supervision, the authors conclude that, in the context of socio-technical convergence, public administration should combine the use of algorithmic control with the task of consolidating interests of stakeholders. The promotion of the concept will be determined by the stakeholder’s assessment of the role played by state digital platforms in public governance transformation. In 2021, a survey of experts was conducted to assess two aspects of their development: digital (involving the use of big data and algorithmic control) and network (based on the participation of citizens in the working-out, decision-making and implementation processes). The survey showed that authorities' use of state digital platforms to respond effectively to individual citizens' needs should be accompanied by involving them in solving socially significant problems. Therefore, the co-evolution of digital and network aspects of the functioning of public digital platforms becomes extremely important. Public decision-making should be developed in order to correct the technological bias in the digitization of public and municipal administration. The technological dimension of the digitization of public and municipal governance can be corrected through the development of public decision-making via digital platforms. The long-term waiting list for public housing is an acute problem of social policy in the country that requires new tools to be solved. Housing vouchers, or lump-sum social payments for the purchase of residential property, at the expense of the Russian regions’ budgets, are supposed to be one of them. The paper aims to evaluate the legal framework of the housing vouchers program from the perspective of opportunities and barriers it has for eliminating the problem. The study used data from the relevant laws and regulations covering all regions, where the housing vouchers were established from 2019 to 2023. The concept of performance-oriented social program and key factors influencing the access to public benefits constitute our theoretical framework. Within it, we examine the range of terms and conditions that should be met by applicants to successfully buy residential properties by means of the housing vouchers. Our findings show that the regulations concerning customer focus, providing lower thresholds for applicants, promoting awareness about the program and its entitlement criteria, and shortening the duration of administrative procedures are likely to contribute to the increase of program performance. Reputation is one of the tools for solving the principal-agent problem, which is typical for contractual relations. In line with the spread of New Public Management theory in public procurement, alternative methods of supplier selection are being developed, in particular, based on suppliers’ reputation. In contrast to the private sector, public buyers’ ability to consider reputation when choosing a supplier is highly regulated. It is shown that in the world practice of public procurement the reputation of suppliers is considered to varying degrees, there is no single approach to indicators, mechanisms for providing information and procedural aspects. Therefore, it is timely to analyse the arguments for and against expanding the possibilities of reputational considerations in public procurement. To answer this question, a separate block focuses on the effects of reputational considerations in public procurement in terms of barriers to entry, public procurement efficiency, and building trust between procurers and suppliers. Conclusions about the positive effects of reputational considerations are of interest to procurers who decide on the choice of supplier evaluation criteria. Relevant aspects of reputational considerations for Russian regulation concerning reputation indicators and mechanisms for providing information are identified. The article differs from existing reviews on the topic of reputation by focusing on the specificity of public procurement. An original classification of sources is presented in accordance with the following parameters: definitions and indicators of reputation, possibilities and limitations of reputational considerations and their effects in public procurement. {"title":"REPRESENTATIVE BUREAUCRACY AND INCLUSION: CITIZEN PARTICIPATION OF ETHNIC MINORITIES IN VIETNAM","authors":"","doi":"10.17323/1999-5431-2023-0-5-26-47","DOIUrl":"https://doi.org/10.17323/1999-5431-2023-0-5-26-47","url":null,"abstract":"In the context of Vietnam, with fifty-four ethnic minority groups and sixty-three provinces/municipalities, this study aims to fill a gap in the literature by looking at ethnic representation and its influence on citizen participation at the local level based on Representative Bureaucracy and Inclusion theory. We use the combination of three datasets the Public Administration Performance Index (PAPI), the Committee for Ethnic Minorities Affair, and the General Statistics Office of 63 provinces in Vietnam from 2012 to 2017. We run a panel data analysis random-effects model (REM) with White-Huber standard errors to correct heteroskedasticity in current years to estimate the effects. Findings support the research hypothesis that ethnic minority groups in Vietnam are negatively associated with citizen participation in the local government, particularly in civic knowledge. Additionally, the level of citizen participation is also negatively related to the urbanization, unemployment, and poverty rates of each province. However, it is positively associated with the education level of each province's population. For this purpose, the expert survey was conducted among the heads of small cities and towns and their deputies in charge of city development issues. The sample consisted of one representative from 33 small cities and towns in Russia. The survey used a questionnaire characterizing city branding objectives, stakeholders involved, decision-making, brand promotion measures, resources and effects. The questionnaire was developed based on the analysis of scientific and practical literature on city branding. As a result, it was revealed that, with some exceptions, branding practice in the studied cities is weakly related to the objectives of city development and has a short-term orientation. The administrations have a tendency to solve branding problems relying solely on their own resources, which leads to city branding resource constraints. These findings contribute to the city branding research by providing data on the implementation of branding practices in small cities and towns. Following this decree, public administration is becoming one of the areas where the implementation of digital technologies is very active. The Russian government has approved and is applying methods for assessing digital maturity. However, while both assessing and taking measures to further digitalize public administration, the opinion of citizens as its beneficiaries is not sufficiently taken into account. To address this gap, RANEPA developed an original methodology for a nationwide representative survey of citizens aimed at identifying their assessment of the effects and risks of the public administration digitalization. The survey focuses on citizens' views not only on public services and facilities (as is most often the case), but also on all types of digital interaction between citizens and the state. The survey was conducted in 2022 and 2023, and the paper compares the results. For example, according to the 2023 survey, in the last year, 86.0% of respondents used digital technologies when interacting with the state (2022: 88.2%). Citizens are also prepared for the use of digital technologies: 83.9% believe they are ready for possible digital interactions with government (2022: 81.7%). The participatory management strategy has been criticized for articulating the ideals of failed collaboration in the management of national parks. The implementation of a collaborative management strategy has provided significant opportunities and roles for civil society in the management of the national park, taking into account the social, economic, and cultural conditions and expectations of the local community. The aim of this study is to empirically examine the participation of civil society and challenges in the management of Tesso Nilo National Park in Riau Province. Using qualitative and quantitative approaches through snowball interviews and social network modeling, and conducting a case study analysis, our findings show that the community is still given a secondary role. The involvement of civil society in the collaborative management of Tesso Nilo National Park still needs to be strengthened. However, the institutional formation and the nature of their involvement in supporting and implementing activities still needs to be improved. In some cases, community empowerment has already begun.
