The model is intended to reinforce Sabin’s viewpoint on the “mechanics” of the ancient battle and to provide quite convincing reconstruction of the battle when the primary sources are often insufficient or contradictory. The main element of his model concerns testing variously the psychological state of the soldiers at different stages of the battle. The authors analyze the doctrinal and practical issues of assessing the actions (inaction) of subjects who carry out hazardous production activities, are equally responsible for compliance with safety regulations and are required to clearly perform their functions in the division of labor. At the same time, as a result of such joint actions, the death of one of the participants in the process occurs. In this case, is the consequence of death causally related to the behavior of the survivor, to what extent should he be responsible for the actions (inaction) of the deceased. The paper indicates that with a detailed analysis of the situation, it is possible to talk about the absence of criminal negligence and the presence of innocent harm. The possibility of foreseeing adverse consequences in this case is always mediated by the behavior of another person (persons) who jointly carry out a dangerous type of activity, unforeseen circumstances related to the actions of other responsible participants in the development of the situation may interfere in the chain of development of the causal relationship.","PeriodicalId":396792,"journal":{"name":"Vestnik Yaroslavskogo gosudarstvennogo universiteta im. The reason for this was the following phrase from the Controversions by Seneca the Elder: “Pollio was the first of all the Romans to have read his works to the invited public” (Contr. IV. praef. 2). Nowadays it is accepted by scholars that Pollio did not introduce public recitations, however, there is still no consensus on what exactly this innovation was. The magazine had not only literary but also artistic significance; prominent writers, poets and artists took part in its creation. Particular attention in the article is paid to the structure, design and content of the Satyricon. An attempt was made in the article, based on the analysis of the magazine’s publications, to look at the world of the everyman through the prism of satire and humor, to understand his interests and pressing problems. The author comes to the conclusion that the magazine «Satyricon» in one form or another reflected almost all aspects of everyday life of the everyman: culture, entertainment, fashion, showing not only its positive, but also negative sides. The grounds and procedure for compensation by the policyholder, as well as by the insured person (pensioner) for the amounts of real damage caused to the bodies of the Social Fund of the Russian Federation, in the form of overpaid insurance coverage, are analyzed. The relevance of the provisions of Chapter 60 of the Civil Code of the Russian Federation on unjust enrichment when resolving such disputes by courts is also noted, which is permissible due to the direct instructions of the law on insurance pensions. Unlike the insurer, the right of the insured person (pensioner) to compensation for losses is not legally established. However, the provisions of Article 15, Art. 393 of the Civil Code of the Russian Federation are in demand when collecting the amounts of an unassigned (unreceived) old-age insurance pension as lost profits from the policyholder or insurer. The need to apply civil legislation is due to the specific nature of the declarative nature of the right to old-age insurance. At the same time, this places the burden on the plaintiff to prove the completeness of the grounds for implementing this measure of legal liability, which reduces the effectiveness of the protection of pension rights. The attitude towards lemurs is ambivalent, they can act both as human helpers and as monsters that devour people. This norm is a novelty of the current domestic criminal legislation, in connection with which, in the author’s opinion, there are some shortcomings and technical gaps in it. The author gives a small retrospective analysis of the rule on responsibility for looting. When studying the composition of the crime in question, the author notes the excessive casuistics used by the legislator in the construction of the composition of looting. It is proposed to exclude the signs characterising theft from Part 1 of the article under study, as well as to exclude concretisation regarding the range of victims whose property may be stolen by a looter. The author considers it expedient to indicate in the disposition the rules on looting the features characterising: 1) extortion and 2) the place of commission of the crime, as the absence of these signs is a legal and technical error. A note to Article 356.1 of the Criminal Code of the Russian Federation, which contains quantitative characteristics of the damage caused to a person by looting actions, namely a large amount over 250 thousand rubles and a particularly large amount over one million rubles, also falls under the critical analysis. According to the author, these characteristics are overestimated and require adjustment, as the current norm will be «dead» due to the fact that it is difficult to imagine the amounts of money or other property fixed by the legislator that are with the victims of looting.
