{"title":"Exploring the Safe Harbor Principle and the Allocation of Platform Liability in the DMCA","authors":"Peixuan Wang","doi":"10.54691/bcpssh.v21i.3628","DOIUrl":"https://doi.org/10.54691/bcpssh.v21i.3628","url":null,"abstract":"The Digital Millennium Copyright Act's safe harbor clauses, which was established more than 20 years ago, are no longer able to reconcile the current widespread problem of copyright infringement in social media. Therefore, this paper examines the allocation of responsibilities between social media platforms, users and copyright owners in the event of digital copyright infringement in social media, the negative impact of the DMCA provisions on stakeholders in social media and possible solutions to the problem. The main problem with the current DMCA's safe harbor doctrine is that the exemptions provided shift too much responsibility and liability to copyright owners and social media users, fail to provide effective remedies, and place an extremely heavy burden on them to enforce their rights. This has had a negative impact on the development of social media and creative output. For this reason, Congress need to change the DMCA's upregulating to increase the bar for safe harbor designation and impose additional requirements on platforms. {"title":"Prejudice in Films in Cross-Cultural Context: Take the Example of Mulan","authors":"S. Therefore, this paper would analyze the live-action film Mulan, a Chinese story told by Disney that reflects the stereotypes of Chinese culture from the Western perspective. Due to the cultural differences between China and the U.S. (such as the different pursuit of individualism and collectivism), the filmmakers’ misunderstanding of the story, especially the important plot of Mulan replacing her father in the army, Disney sets the core viewpoint of the story as Mulan pursuing proving herself, instead of the traditional Chinese culture’s understanding that Mulan makes the decision to take her father’s place in the army for the sake of her family and the country’s collective interests. There are many other stereotypes in the film, these stereotypes have caused dissatisfaction of Chinese audiences with the film. The paper gives some suggestions to improve the acceptance of cross-cultural film and television works in the local market, like investors can choose local market cultural figures as the film’s main producer. The film producer should be rigorous in the examination of local culture and it is better to choose the local language for the dubbing of cross-cultural films. After its domestic reform in 1986 (Doi Moi), it continuously deepened its integration into the world economy and achieved great economic development. This paper takes neoliberalism and neorealism as theoretical approaches to analyze two international organizations, the World Trade Organization (WTO) and the Asian Infrastructure Investment Bank (AIIB). Specifically, the analysis focuses on how International Organizations (IOs) affect the course of development in Vietnam. This study aims to provide some references for Vietnam's future economic development and how to seek further development in international organizations. This study finds that by joining WTO, Vietnam achieved remarkable economic growth through trade liberalization. Most importantly, Vietnam gained the ability to negotiate problems on an equal basis with developed countries through the dispute settlement mechanism provided by WTO. The AIIB, on the other hand, gives Vietnam good access to infrastructure loans, but it also raises concerns about Vietnam's balance of power and security in the region. Due to the complexity of the impact of IOs on Vietnam's development, Vietnam needs to optimize its economic structure and relevant institutions rationally and make decisions to balance diverse interests to achieve long-term development and better face possible external crises. Queer theory has been utilized by feminists as a significant theoretical framework in art criticism, with cinemas taken as a representation system and cultural practice for the manifesto of gender identity and gender equity. This research will take the prestigious lesbian cinema Blue is the Warmest Color as an exemplification to analyze the embodiment of queer theory, especially gender performativity and body writing, with the methodologies of case study and analysis of the representation of screen images from the perspective of semiotics. The research findings confirm the association between cinematic techniques and representation and the construction of gender identity from the perspective of queer theory and representation theory. Meanwhile, the research explores the expansion and application of body writing in the cinematic field, clarifying several intentions of the large proportion of the explicit and straight representation of women’s bodies in sex scenes. It used to belong to the USSR like Ukraine, which shares some similarities with Kazakhstan in the aspect of history, the relation with Russia and so on. After the 24th of February in 2022, when the Russia Ukraine war has begun, whether Kazakhstan could be the next Ukraine has become a topic under debate. In this article, the possibility and Kazakhstan’s condition as well as its foreign policy are analysed. Furthermore, realism, one of the three main theories in the international relations is used to explain and predict the behaviour of Kazakh’s government. Result indicates that Kazakhstan is less possible for it to be involved in a war like Russia Ukraine war. The fundamental focus of these challenges is the defense of human rights, notably environmental rights. The main topic of this essay is China's protection of environmental rights in light of foreign investment. These issues are mostly seen in the light punishments, particularly administrative fines, the challenge of reconciling the amount of fines with real losses, and the rigorous examination of plaintiffs' eligibility for environmental public interest lawsuits. The inadequate environmental regulatory systems and policy objectives, as well as the lack of coherence between statutory requirements and enforcement procedures, are further factors contributing to the recurring violations of environmental rights.
