Research design, data and methodology : This study calculated the manufacturing specialization and diversification agglomeration index according to the region in Korea for 17 regions and 25 manufacturing fields in Korea from 2013 to 2019. Considering the impact of manufacturing agglomeration on carbon emissions, the non-linear effect of manufacturing agglomeration on carbon emissions was examined using a semi-parametric model for the effect of manufacturing agglomeration on carbon emissions. In addition, considering the spatial fluidity of carbon emissions and policy imitation of neighboring regions, this study constructed a semi-parametric spatial autoregressive model considering the spatial interactions between individuals. Results : An analysis of the carbon emission reduction effect according to the manufacturing cluster type showed that, the effect of a specialized cluster on carbon emission was an N-shaped structure. In the early stages of specialization integration, the action of promoting carbon emission is weakened as the level of integration increases and gradually suppresses carbon emission. The effect of the diversification of the manufacturing industry on carbon emissions was found to be a distinct inverted U-shaped structure. In the early stages of diversification and integration, carbon emissions increased strongly, and carbon emissions were gradually suppressed as the level of integration increased, Diversification agglomeration in the manufacturing industry had a greater effect on suppressing carbon emissions than specialization agglomeration. Conclusions : Attention should be paid to the relationship between the expansion of production scale and carbon emission in large and relatively mature manufacturing specialization clusters. The expansion of the production scale mat weaken the eco friendly effect of technological progress. In the early stages of diversification and agglomeration in the manufacturing industry, attention should be paid to improving resource use efficiency and reducing carbon emissions. While diversifying the agglomeration areas, it is necessary to promote the rational use of existing resources by improving public infrastructure within the industrial complex. Research design, data and methodology : Article 125 of the Korean Commercial Code says that the term carrier means a person who engages in the business of carrying goods or passengers by land or on lakes and rivers, and in ports and bays. This paper studied Article 125 and the Articles of the Code concerning the carriage of goods by sea. Results : Comparative analysis of some issues in the scope and application of carriage by sea or carriage by inland waterways suggests that maritime carriage provisions of the Korean Commercial Code should be applicable to inland waters. Conclusions : This paper reviewed and analyzed issues in the scope of maritime carriage and inland waterways transport under the Korean Commercial Code by examining the theories, regulations, and practical viewpoints. Results : After all, Korea's competitiveness is slightly higher than that of Japan, but it can be seen that China has the highest competitiveness among the three countries. Ocean Reef, the 11th Circuit Federal Court of Appeals stated that only the Supreme Court had the privilege of overturning its decision and, unlike some commentators, could not dismiss Wilburn Boat on the grounds that it might disagree with Wilburn Boat. In Travelers v. Ocean Reef, will prove fascinating enough to tell you what the Supreme Court thinks about Wilburn Boat today. \u0000Conclusions : Considering the possibility that the law of the United States, which is popularly referred to as a major power in litigation, will affect Korea's trade officials, it is even more so. In Docket No.2018Da204018, there was a dispute as to the validity of switch B/L which was issued by the freight forwarder at the request of the intermediary without authority from the original B/L’issuer as the carrier. The supreme court of Korea ruled that this B/L can not be regarded as valid B/L under the Korean Law. This article analyses Docket No.2018Da204018 according to the English law, and proposes some recommendations for the carrier, when he issues the switch B/L. \u0000Research design, data, methodology : This article adopts the legal methodology which utilizes textbooks, journal articles, electronic resources, UK COGSA(1992), and several cases from the English court. \u0000Results : This article finds that, under the English law, three requirements for an effective switch B/L are a proper requester, a proper issuer, and a legitimacy reason for issuing the switch B/L. Thus, this article concludes that the switch B/L in Docket No.2018da204018 shall not be recognized as a valid B/L, because it clearly lacked the second requirement naming a proper issuer. \u0000Conclusions : The carrier potentially has greater liability over issuing the switch B/L than the requester. An analysis of demographics was implemented by utilizing IBM's SPSS v. 25.0. The test hypothesis was implemented by building a structural equation model utilizing SmartPLS. \u0000Results : First, from testing hypothesis 1, we determined that a GSCM capacity had a significant effect on green self-efficacy. Second, from testing hypothesis 2, we found that green self-efficacy had a significant effect on both environmental and financial performance. Finally, from testing hypothesis 3, we found that green self-efficacy played a significant mediating role in both GSCM competency and environmental and financial performance. \u0000Conclusions : According to recent environmental changes, SCM implementation considering the environments of logistics companies is an important matter directly related to survival and competitiveness. The data were analyzed under structural equation modeling(SEM) for hypothesis verification. \u0000Results : First, we found that job demands had a significant positive effect on job burnout, and did not have a significant negative effect, job resource had a significant positive effect on job burnout. Quantitative data were evaluated by using Importance-Performance Analysis(IPA), leading to categorizing the IMO measures into three groups of strategies. The evaluation is further interpreted by qualitative interview data. \u0000Results : Measures to improve the energy efficiency of ships and operations as well as market-based measures fall into a “keep up the good work” strategy owing to high importance and performance. {"title":"A Study on the improvement of GVC Competitiveness and Value Chain Upgrading through RCEP Agreement: Focusing on Rules of Origins","authors":"Min-jae Kim","doi":"10.18104/kaic.2022.37.2.301","DOIUrl":"https://doi.org/10.18104/kaic.2022.37.2.301","url":null,"abstract":"Purpose : This study analyzes how the Regional Comprehensive Economic Partnership (RCEP) acts as a driving force for value chain upgrading and how it will affect Korea's global value chain (GVC) competitiveness and stabilization of the supply chain. \u0000Research design, data and methodology : The number of items per country under the rules of origin under the RCEP and ASEAN+1 FTAs is analyzed. Unification of the rules of origin is analyzed through each FTA standard. A literature review on accumulation is conducted. \u0000Results : A unified standard can be achieved for the rules of origin under the RCEP that facilitates exports and stabilizes the supply chain in 15 countries.
