Over de band van het zorgvuldigheidsbeginsel heeft de bestuursrechter in de loop der jaren rechtsregels ontwikkeld die de bewijsverzameling, -levering en -waardering normeren. Vaak bestaan daarbij overeenkomsten met bewijsregels uit andere rechtsgebieden, al worden die in de rechtspraak weinig nadrukkelijk gelegd. In het toezicht en de handhaving ligt het voor de hand naar de normering in het strafrecht te kijken.
