Prokofyeva","doi":"10.52623/2227-4383-3-45-13","DOIUrl":"https://doi.org/10.52623/2227-4383-3-45-13","url":null,"abstract":"The article discusses the issue of the validity of the criminalization of evasion from repayment of accounts payable, provided for in article 177 of the Criminal Code of the Russian Federation. Noting that the question of the expediency of criminalizing acts in the sphere of economic activity is one of the most debatable in modern criminal law in Russia, the authors cite different views of scientists and practitioners. The problem of applying article 177 of the Criminal Code of the Russian Federation is identified due to the absence of the concept of malicious evasion from repayment of accounts payable in the current legislation. The methods of committing this crime are considered. In addition, the data of judicial practice on cases of debt collection on accounts payable are presented. Attention is drawn to the issues of the effectiveness of the norm provided for in article 177 of the Criminal Code of the Russian Federation. The results of the study indicate in favor of leaving malicious evasion from repayment of accounts payable in the criminal law system. The author notes the relevance of obtaining objective information about the state of the quality of the educational process and the search for means to ensure effective management of its quality. Attention is drawn to the fact that monitoring can become such a means, since it provides ample opportunities for managing the quality of education, and it is pedagogical monitoring, which includes didactic and educational elements. The article presents various interpretations of the concept of «educational monitoring». The main methods of pedagogical monitoring are highlighted, the advantages and disadvantages of testing, portfolio and rating system of accounting for educational achievements of students as methods of pedagogical monitoring are revealed. Methods of modeling the spread of infectious diseases have been studied since the beginning of the twentieth century. In the classical SIR model, the entire population was divided into three parts: «susceptible – infected – recovered». In the 1980s, the intermediate state – «infected, but not yet infectious» was added to the classical model. This model is called SEIR. The spread of the epidemic in both models is described by a system of differential equations, which is solved using numerical methods. \u0000Significantly new simulation modelling approaches are necessary to forecast evolution of the coronavirus pandemic. This study based on the classical SEIR model («susceptible – infected but not yet infectious – infected – recovered») suggests several methods for developing models: with a long plateau, with two or more waves. The author analyzes scientific approaches to determining the grounds for criminalization of acts and analyzes the factors that gave rise to the formation of a criminal law ban. Taking into account the above approaches, the author identifies the following criteria for establishing a criminal law ban: public danger, its prevalence, compliance with the norms of current legislation, the impossibility of achieving the goals by the norms of other branches of legislation and the presence of forces of an objective possibility of the proof process. The analysis of the historical continuity of the legislation of the Russian Federation on the issue of criminal liability for illegal production and turnover of alcoholic beverages is carried out. The structure of cybercrimes is mainly represented by property abuse, in particular, «contactless» thefts committed via the Internet, mobile communications, using bank cards. The specificity of these crimes lies in the fact that non-cash, electronic money is the subject of theft. The main difference from the traditional understanding of the subject of theft is its incorporeal essence. The opinion is substantiated that the conceptual and categorical apparatus of theft of someone else's property due to the inclusion in its volume of digital, electronic money (cryptocurrencies, bitcoins) has somewhat expanded. It is this feature that affects the impossibility of using the «generally accepted» model for conducting a pre-investigation check and making a decision to initiate a criminal case. For risk assessment, the methodology that provides for the calculation of integral indicators of the level of risk by its main types was used and it is based on the use of quantitative and qualitative methods of risk assessment, ta king into account the assessment of the probability of risk occurrence, as well as the amount of expected damage. The essence of this  approach is the fundamental novelty of the control structure, which is only a parametric representation of the existing one. It is necessary to change the entire methodological map of this structure, transfer it to a virtual information map. \u0000It is noted that the property function P is a modulated indicator of the economic state of the producing organization, which determines its stability in competitive conditions. The author examines the economic situation in which the Holy Roman Empire found itself as a result of the Thirty Years' War. New customs and road taxes were introduced and old customs tariffs were raised. All continental trade was paralyzed. The decisions of the Westphalian Congress were based on the concept of freedom of trade. All customs duties, taxes and other restrictions that were arbitrarily introduced without the consent of the emperor and the electors were abolished. Even before the outbreak of the war, debt obligations had reached significant proportions. For the period of the signing of the Peace of Westphalia, moratoriums were introduced for 5 years on the payment of interest and repayment of debts. However, the problem of interaction of legal culture in the formation of the rule of law remains unresolved, which determines the relevance of further study of this issue. The article analyzes such categories of law as the concept, signs, types, levels and significance of legal culture in the process of forming a legal state. The author draws attention to such objects of research as the principles of the formation of the rule of law, its interaction with civil society institutions, which act as indicators of the legal consciousness of both individuals and their collectives, and society as a whole. The author draws conclusions about the influence of the legal culture of individual groups of citizens, the individual and society in the formation of the legal state.
