In Law No. 22 of 2002 concerning Clemency, it does not specifically explain the category of crimes that can or cannot be granted clemency. Also, the Clemency Law does not specify the reasons that can be used by the applicant. There are two main problems in this study, namely (1) What is the mechanism for granting clemency to narcotics convicts? and (2) How is the legal politics of granting clemency by the president to convicts of narcotics cases in the future? This study uses a normative research method with a statutory approach, an analytical and legal conceptual approach, and a case approach. Based on this research, it can be concluded that the mechanism for granting clemency to narcotics convicts based on Law No. 22 of 2002 concerning clemency is the same as the mechanism for granting clemency in general or there is no special classification for certain crimes. Then the researcher recommends to revise the clemency law by adding the classification of extraordinary crimes in this case drugs as an exception from granting clemency. In the Public Private Partnership scheme, risk allocation is a difficult thing. The transfer of risk to the private sector has an impact on the price of the project. Likewise, allocating risk to the public sector which in practice tends to reduce Value For Money. In addition, project risk is dynamic and changes throughout the life of the project so it cannot be predicted with certainty. This normative research aims to examine the guiding principles for increasing the effectiveness of risk allocation and maximizing Value For Money from existing regulations in Indonesia and Government Cooperation agreements with Business Entities based on best practices in several other countries. The approach used in this paper uses a conceptual and comparative approach. The results obtained from this paper are that it is necessary to identify and anticipate risks including alternative solutions that are adjusted to the principle of risk allocation to minimize risk, as well as adjustments to the matrix that have been made by PT PII, risk allocation principles, best practices and related regulatory frameworks in Indonesia. Result, risks in KPBU projects are often an obstacle in the success of KPBU implementation in Indonesia. To minimize the risks that will be faced or may be faced, it is necessary to identify and anticipate risks including alternative solutions that are adjusted to the principle of risk allocation. In developing an effective risk matrix, innovative thinking is needed that is adapted to the characteristics of the KPBU project and the principles of risk management. This must also be adjusted to the matrix that has been made by PT PII, the principles of risk allocation, best practices and related regulatory frameworks in Indonesia are used as references. ASEAN dan Africa Union (AU), di anggap sebagai representatif perlindungan HAM di kawasan regional akan tetapi berbeda dengan AU, ASEAN masih jauh tertinggal secara konsep hal ini di buktikan masih kuatnya prinsip kedaulatan negara dan prinsip non-intervensi di kawasan ASEAN. Adapun yang menjadi rumusan masalah yaitu adanya diskursus terkait penerapan prinsip non intervensi, kedaulatan negara dan intervensi kemanusian yang menjadi inti permasalahan penegakan HAM di ASEAN. Penelitian ini menggunakan Metode Penelitian Hukum Normatif, menggunakan pendekatan konsep dan pendekatan perbandingan. One of the principles recognized and in line with the research, in this case, is the territorial principle, which is a useful principle in determining the limits of validity of criminal law provisions based on place or location. This study aims to analyze the application of the territorial principle to perpetrators of pedophilia crimes committed by foreign nationals. The method used in this study is a normative type of research that uses the law approach and case studies. The results of this study indicate that should be based on the principle of criminal law, namely the territorial principle, Indonesian law will be applied to anyone who commits a crime in Indonesia, including in this case foreign citizens who commit pedophilia crimes, especially a sovereign state has exclusive jurisdiction in the environment. the territory itself is called territorial sovereignty so that the state has full jurisdiction to punish people who commit crimes against the law in the territory of the country. Artikel ini akan membahas dua rumusann masalah yang pertama, bagaimana pengaturan sui generis bagi pemanfaatan GSO terhadap negara ekuator menurut Hukum Internasional? dan yang kedua bagaimana kedudukan Indonesia sebagai negara yang berada di jalur khatulistiwa dan urgensinya dalam pemanfaatan Geostasionary Orbit?. Tujuan penulisan artikel ini adalah mengetahui dan menganalisis pengaturan sui generis bagi pemanfaatan GSO terhadap negara ekuator menurut Hukum Internasional dan kedudukan Indonesia sebagai negara yang berada di jalur khatulistiwa dan urgensinya dalam pemanfaatan Geostasionary Orbit. Adapun metode penelitian yang digunakan adalah metode penelitian normatif. Subtansi isi rezim khusus ( sui generis ) usulan negara berkembang, negara khatulistiwa maupun negara lainnya intinya memiliki tuntutan yang relatif sama bahwa pengaturan penggunaan GSO menjadi wewenang UNCOPUOS dan penggunaan GSO dapat diterapkan secara adil dan memperhatikan kepentingan negara-negara khususnya negara yang memiliki karateristik alamiah yang unik dengan GSO, untuk alokasi penggunaan spektrum frekuensi dilakukan secara adil yang berdasar pada ketentuan dalam ITU. Sebagai suatu Negara yang berada di bawah garis khatulistiwa terpanjang membuat Indonesia menjadi negara yang memiliki posisi yang panjangnya sama dengan segment GSO yang terdapat di atas wilayah Indonesia. Dalam ketentuan Pasal 2 ayat (2) Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi disebutkan bahwa Dalam hal tindak pidana korupsi sebagaimana dimaksud dalam ayat (1) dilakukan dalam keadaan tertentu, pidana mati dapat dijatuhkan. Dalam penjelasan Pasal 2 ayat (2) , yang dimaksud dengan keadaan tertentu adalah keadaan yang dapat dijadikan alasan pemberatan pidana bagi pelaku tindak pidana korupsi yaitu apabila tindak pidana tersebut dilakukan terhadap dana-dana yang diperuntukkan bagi penanggulangan keadaan bahaya, bencana alam nasional, penanggulangan akibat kerusuhan sosial yang meluas, penanggulangan krisis ekonomi dan moneter, dan pengulangan tindak pidana korupsi. Dalam ketentuan Pasal maupun Penjelasan Pasal tersebut terdapat kata atau frasa yang menimbulkan ketidakpastian hukum karena memiliki makna ganda yakni kata “dapat” dan frasa “bencana alam nasional” yang masih tidak jelas. Sehingga argumentasi yang dibangun oleh penegak hukum yakni didasarkan bahwa penerapan sanksi pidana mati tidak dapat dijatuhkan bagi pelaku tindak pidana korupsi jika tidak ada status bencana alam nasional. Jenis Penelitian yang digunakan peneliti adalah jenis penelitian normatif, adapun pendekatan yang digunakan dalam penelitian ini antara lain: Pendekatan Perundang-Undangan (Statue Approach) dan Pendekatan Kasus (Case Approach). Hasil penelitian menggambarkan bahwa pelaksanaan diskriminasi ras dan etnis masih kerap terjadi dalam masyarakat. Indonesia sendiri sudah mempunyai aturan yang dinilai bagus untuk menangani dan menghapus kasus diskriminasi rasial dan etnis namun masih banyak yang belum mengetahui dan mendengar tentang aturan tersebut. Maka dari itu, aturan yang ada dinilai kurang populer karena kurangnya sosialisasi sehingga implementasi terjadi hanya seputar penindakan namun masih lemah pada aspek pencegahan. Maka dari itu pemerintah harus lebih banyak memberikan edukasi terhadap rakyat tentang adanya peraturan mengenai penghapusan diskriminasi rasial dan etnis ini. Jenis Penelitian yang digunakan oleh peneliti dalam menyusun Penelitian ini adalah jenis Penelitian normatif-empiris, Adapun pendekatan yang digunakan oleh peneliti dalam menyusun penelitian ini adalah, antara lain: Pendekatan Perundang-Undangan (Statue Approach); Pendekatan kasus (case approach). Hasil Penelitian ini menujukkan: Pertama, bahwa Perlindungan Hukum Jaminan Kesehatan dan Keselamatan Kerja (K3) Terhadap Tenaga Kerja Konstruksi di Provinsi Gorontalo. sampai dengan saat ini berdasarkan temuan penelitian yang didapatkan dari narasumber telah berjalan dengan baik, sebab hampir sebagian besar perusahaan konstruksi telah memenuhi kewajibannya untuk memberikan jaminan asuransi kepada para pekerjanya. Kemudian terkait dengan implementasi K3 dalam aspek pemenuhan standar keselamatan kerja melalui alat pelindung diri (APD) semuanya disediakan oleh pihak perusahaan kepada para pekerjanya. Dengan demikian dapat ditarik kesimpulan bahwa sejauh ini jaminan perlindungan hukum terkait dengan kesehatan dan keselamatan kerja (K3) berjalan dengan baik di provinsi Gorontalo. Kedua, bahwa Faktor Penghambat Perlindungan Hukum Jaminan Kesehatan dan Keselamatan Kerja (K3) Terhadap Tenaga Kerja Konstruksi di Provinsi Gorontalo. Berdasarkan hasil kajian artikel ini menyimpulkan bahwa podcast digolongkan dalam layanan konten audio Over The Top , bukan penyiaran. Karakteristik podcast yang hampir sama dengan radio, tetapi tidak serta merta disebut sebagai suatu penyiaran sebagaimana yang diatur dalam Pasal 1 angka 2 UU Penyiaran. Hal ini berimplikasi pada pengaturan podcast yang tidak dapat diatur dalam Undang-undang Penyiaran. Oleh karena itu tujuan penulisan ini untuk menguraikan pentingnya bentuk perlindungan hukum kepada korban penipuan transaksi jual beli online dilihat dari perspektif Undang-Undang Informasi dan Transaksi Elektronik sekaligus untuk mendeskripsikan apakah ganti rugi sebagai pidana tambahan dapat ditetapkan sebagai upaya melindungi korban penipuan melalui transaksi jual beli online. Metode penelitian yang digunakan dalam tulisan ini adalah penelitian yuridis normatif dengan menggunakan pendekatan konseptual dan pendekatan perundang-undangan. Hasil penelitian dalam tulisan ini menunjukan bahwa Undang-Undang Informasi dan Transaksi Elektronik hanya mengatur tentang pidana pokok terhadap pelaku tindak pidana penipuan transaksi jual beli online dan tidak secara tegas mengatur tentang ganti rugi yang mestinya didapatkan oleh korban dari tindak pidana penipuan melalui transaksi jual beli online. Pentingnya ganti rugi dalam bentuk restutusi sebagai pidana tambahan agar supaya ganti rugi tidak hanya menjadi opsi untuk melindungi korban tetapi menjadi kewajiban untuk dipenuhi oleh setiap pelaku tindak pidana ketika tindak pidana yang dilakukannya berakibat kerugian bagi korban penipuan transaksi jual beli online. Abstract Obligation to compensate victims basically could be said as a fulfillment of restorative justice which is the concept of justice that is being achieved in the renewal of criminal law in Indonesia. Therefore , the purpose of this paper is to describe the importance of legal protection for victims of online trading transaction fraud from the perspective of the Information and Electronic Transaction Law, also to describe whether compensation as an additional crime can be determined as an effort to protect victims of fraud through online trading transactions. The research method used in this paper is juridical normative, used a conceptual and statute approach. The results of this study indicate that the Electronic Information and Transaction Law only regulated the principal crimes against the perpetrators of fraudulent acts of online trading transactions and did not explicitly regulate the compensation that should be obtained by victims of fraudulent criminal acts through online buying and selling transactions.
