Land registration aims to provide legal certainty and protection for the land rights holders as mandated in the constitution and laws. The certificate of ownership, referred to as hereditary, strongest, and fullest right in the UUPA (Land Law), in reality, has the potential to overlap with certificates of ownership or other types of land rights registered in the name of third parties. The purpose of this research is to analyze the legal certainty of the certificate of ownership and the legal protection provided to land rights holders. This study uses a normative juridical research method which is explained in a descriptive-analytical manner. The data used in this research are secondary data obtained through literature studies. This research uses legislative approaches, case approaches, analytical approach, and conceptual approaches. The results of this research indicate that the applicable regulations does not provide absolute legal certainty to land rights holders, with the limitation that the government guarantees the accuracy of physical and juridical data in the certificate as long as it is not proven otherwise. Therefore, people are given the right to file for the annulment of land ownership certificates containing administrative and/or juridical defects, either through administrative efforts or judicial efforts. Dispute resolution conducted by the government provides preventive and/or repressive protection to land rights holders.Bahasa Indonesia Abstrak: Sertipikat merupakan produk hukum pendaftaran tanah yang diterbitkan oleh Pejabat yang berwenang sebagai bukti kepemilikan yang sah. Pendaftaran tanah bertujuan untuk memberikan kepastian dan perlindungan hukum bagi pemegang hak atas tanah, sebagaimana diamanatkan dalam konstitusi dan peraturan perundang-undangan. Sertipikat hak milik yang disebut sebagai hak yang turun temurun, terkuat, dan terpenuh dalam UUPA, nyatanya berpotensi mengalami tumpang tindih dengan sertipikat hak milik maupun dengan jenis hak atas tanah lainnya yang terdaftar atas nama pihak ketiga. Tujuan penelitian ini adalah menganalisis kepastian hukum sertipikat hak milik dan perlindungan hukum yang diberikan kepada pemegang hak atas tanah. Penelitian ini menggunakan metode penelitian yuridis normatif yang dijelaskan secara deskriptif analitis. Data yang digunakan dalam penelitian ini adalah data sekunder yang didapatkan melalui studi kepustakaan. Penelitian ini menggunakan pendekatan perundang-undangan, pendekatan kasus, pendekatan analisis dan pendekatan konseptual. The making of a notarial deed refers to Law Number 30 of 2004 as amended by Law Number 2 of 2014 concerning the Notary Occupation (UUJN). One of the requirements that shall be fulfilled in order that an authentic deed drawn up by a notary has perfect evidentiary power is the affixing of a signature by the appearer, this has also been regulated in Article 44 UUJN. Not affixing a signature can reduce the evidentiary power of the deed. The notary also has the responsibility of conducting the precautionary principle when assisting appearer without fingerprints in giving valid legal approval in addition to affixing signatures and fingerprints. According to interviews and legal data analyzed by the author, the affixing of the signature and fingerprint stamp can be replaced by surrogate. Surrogate is a sentence written at the end of the deed to clearly explain the reasons for not being able to affix a signature. This is also in line with Article 44 paragraph (2) UUJN. The notary also has the responsibility to apply the precautionary principle in making the surrogacy/surrogate by using clear sentence formulations and supported by a doctor's certificate from the appearer which strengthens the reasons for using the surrogate.Bahasa Indonesia Abstrak: Sebuah akta autentik yang dibuat oleh notaris memiliki persyaratan tertentu yang perlu dipenuhi dalam pembuatannya. Pembuatan akta notaris mengacu kepada Undang-Undang Nomor 30 Tahun 2004 sebagaimana telah diubah dengan Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris (UUJN). Salah satu persyaratan yang harus dipenuhi agar suatu akta autentik yang dibuat oleh notaris memiliki kekuatan pembuktian sempurna ialah dengan dibubuhkannya tanda tangan oleh penghadap, hal ini telah diatur pula dalam Pasal 44 UUJN. Tidak dibubuhkannya tanda tangan dapat menurunkan kekuatan pembuktian akta tersebut. Notaris juga memiliki tanggung jawab yaitu penerapan prinsip kehati-hatian ketika membantu penghadap tanpa sidik jari dalam memberikan persetujuan hukumnya yang sah selain pembubuhan tanda tangan dan cap sidik jari. Menurut wawancara dan data-data yang dianalisis oleh Penulis, pembubuhan tanda tangan dan cap sidik jari tersebut dapat digantikan dengan surogasi/surrogate. Surogasi/surrogate merupakan kalimat yang dituliskan pada akhir akta untuk secara jelas menerangkan alasan tidak dapat dibubuhkannya tanda tangan. Hal ini telah sejalan pula dengan Pasal 44 ayat (2) UUJN. Before death, a person can make a will. This research discusses the arrangement for granting a will in terms of the Civil Code and the responsibility of a Notary to the making of a will which was canceled for violating Legitime Portie (Case Study Decision Number 225/Pd.G/2017/PN.Sby). The method in this legal research is empirical normative juridical, namely obtaining data through literature study plus limited interviews. The result of this research is that in making a will, it is necessary to pay attention to the requirements in making a will, which must meet the requirements in making a will. Making a will in a state of serious illness can be said to be incompetence to make will (Article 895 of the Civil Code). In addition to having to pay attention to the competence in making wills, they must also pay attention to the Legitime Portie of their heirs (Article 914 of the Civil Code), because in making a will through the appointment of an heir, the heirs must not be harmed (Article 881 Paragraph (2) of the Civil Code). A general will is made before a Notary by witnessing 2 (two) witnesses. The Notary's responsibility for making a will that has ignored the law, then according to Article 84 and Article 85 of UUJN, a violation committed by a Notary or a deed becomes null and void by law can be a reason for parties who suffer losses to demand reimbursement of costs, compensation, and interest from the Notary.Bahasa Indonesia Abstrak: Ketika seseorang meninggal dunia maka akan menimbulkan akibat hukum bagi ahli warisnya yakni dikenal dengan istilah pewarisan. Seseorang sebelum meninggal dunia dapat membuat suatu surat wasiat. Penelitian ini membahas tentang pengaturan pemberian wasiat ditinjau dari Kitab Undang-Undang Hukum Perdata dan tanggung jawab Notaris terhadap pembuatan akta wasiat yang dibatalkan karena melanggar Legitime Portie (Studi Kasus Putusan Nomor 225/Pd.G/2017/PN.Sby). Metode dalam penelitian hukum ini adalah yuridis normatif empiris, yakni memperoleh data melalui studi kepustakaan ditambah dengan wawancara terbatas. Hasil penelitian adalah dalam membuat surat wasiat harus memperhatikan syarat dalam pembuatan wasiat, yakni harus memenuhi syarat-syarat dalam membuat surat wasiat. Membuat surat wasiat dalam keadaan sakit keras dapat dikatakan tidak cakap membuat suatu wasiat (Pasal 895 KUHPerdata). Selain harus memperhatikan kecakapan dalam membuat wasiat, juga harus memperhatikan Legitime Portie dari para ahli warisnya (Pasal 914 KUHPerdata), karena dalam membuat wasiat melalui pengangkatan waris tidak boleh merugikan para ahli warisnya (Pasal 881 ayat (2) KUHPerdata). In carrying out their positions, Notaries are subject to UUJN and the Notary’s Code of Ethics, and their supervision is carried out by the Notary Supervisory Council. Notaries are required to behave neutrally or impartially in making the deed, but in reality this is still found by the Notary Supervisory Council. By making a deed not impartially before a Notary, it can cause harm to other parties. Therefore, the purpose of this study is to find out the authority of the Notary Supervisory Council against Notaries who are proven to have taken partisan action and how the Notary's responsibility to the injured party is. The research method used is normative research. The authority of the Notary Supervisory Council against a Notary who is proven to have taken a unilateral action is regulated in Article 73 of the UUJN and Article 24-27 of the Permenkumham No. 16 Year 2021, which in this study imposes sanctions in the form of a written warning and the Notary's responsibility to the aggrieved party is from the administrative side, civil liability and criminal liability if it can be proven that a criminal act has been committed. Bahasa Indonesia Abstrak: Notaris diangkat langsung oleh Menteri sebagai pejabat umum, berwenang dalam hal pembuatan akta autentik. Dalam menjalankan jabatannya, Notaris tunduk pada UUJN dan Kode Etik Notaris, serta pengawasannya dilakukan oleh Majelis Pengawas Notaris. Notaris wajib berperilaku netral atau tidak berpihak dalam pembuatan akta, tetapi pada kenyataannya hal tersebut tetap ditemukan oleh Majelis Pengawas Notaris. Dibuatnya akta secara berpihak di hadapan Notaris dapat menimbulkan kerugian bagi pihak lain. Oleh karena itu tujuan penelitian ini untuk mengetahui bagaimana kewenangan Majelis Pengawas Notaris terhadap Notaris yang terbukti membuat akta secara berpihak dan bagaimana tanggung jawab Notaris terhadap pihak yang dirugikan. Metode penelitian yang digunakan adalah penelitian yuridis normatif. In this case, the Notary Supervisor Assembly examines reporter and reported party, examines the legal facts, and makes legal considerations to decide the sanctions to be given. As in the decision of the Notary Center Supervisor Assembly (MPPN) Number 02/B/MPPN/X/2018, the Notary is reported for alleged violations that are detrimental to the reporter party. This is a solid reason to examine the role of the Notary Supervisor Assembly in handling complaints and the legal consequences of decisions issued. Therefore, a research was conducted to examine this issue. The reseacher applied normative law with a statute approach. The data used is secondary data supported by primary data. The secondary data obtained from library materials, while primary data obtained through interviews. Data analysis was examined with quantitative approach which resulted in descriptive analysis. The results of this study shows that the role of the Supervisory Assembly on public reports is regulated in UUJN P Article 70 letter G and the Regulation of the Minister of Law and Human Rights Number 15 of 2020 concerning Procedures for Examination of the Supervisory Assembly on Notaries. The legal consequence of the decision of the Regional Assembly is a verbal warning to the notary. Meanwhile, the legal consequence of the decision of the Center Supervisory Assembly is to strengthen the decision of the Regional Supervisory Assembly, so as to produce a final decision.Bahasa Indonesia Abstrak: Dalam hal adanya laporan masyarakat terhadap dugaan pelanggaran yang dilakukan oleh Notaris, maka Majelis Pengawas Notaris mempunyai peran penting dalam menerima penanganan pengaduan tersebut berdasarkan prinsip-prinsip penanganan pengaduan berdasarkan ketentuan perundang-undangan yang berlaku. Dalam hal ini Majelis Pengawas Notaris memeriksa antara pelapor dan terlapor, menemukan fakta-fakta hukum, dan membuat pertimbangan hukum untuk memutuskan sanksi apa yang akan diberikan kepada Notaris. Seperti pada putusan Majelis Pengawas Pusat Notaris (MPPN) No. 02/B/MPPN/X/2018, dalam putusan tersebut Notaris dilaporkan atas dugaan pelanggaran yang merugikan pelapor. In the practice of buying and selling land, it is possible for there to be disputes resulting in the Sale and Purchase Deed (AJB) being filed for cancellation. The formulation of the problem to be examined by the author is the result of the cancellation of the Land Sale and Purchase Deed made based on the simulation agreement by the judge. The research method used is normative juridical research with descriptive analytical data analysis and using data collection of secondary and primary data. The legal consequence arising from the Sale and Purchase Deed which was canceled by the Judge is that all conditions must be returned to their original state when no legal action has taken place in the relevant deed. So that other parties in the agreement who have already received achievements from other parties are obliged to return them. Regarding the sale and purchase deed which was canceled by the judge, the Land Deed Making Officer will provide a note on the Minutes of the Deed that the deed has been canceled by a Court Decision or by attaching the Court Decision to the Minutes of the Deed in question. Lastly, for certificates that have been renamed, one of the parties will submit a cancellation of the certificate to the National Land Agency, and then the National Land Agency will cross out and change the name of the owner of the land rights that has been determined in the District Court Decision on the books of land, but regarding the replacement of certificates there are no clear provisions.Bahasa Indonesia Abstrak: Tanah merupakan objek penting dalam kehidupan manusia dapat dialihkan dengan cara diperjualbelikan. Praktik jual beli tanah kenyataannya memungkinkan adanya sengketa yang mengakibatkan Akta Jual Beli (AJB) bisa diajukan pembatalan. Rumusan masalah yang akan diteliti oleh Penulis adalah akibat dari pembatalan Akta Jual Beli Tanah yang dibuat berdasarkan Perjanjian Simulasi oleh hakim. Metode penelitian yang digunakan yaitu penelitian yuridis normatif dengan analisa data secara deskriptif analitis dan menggunakan alat pengumpulan data yaitu data sekunder dan primer. Akibat hukum yang timbul terhadap Akta Jual Beli yang dibatalkan oleh Hakim adalah semua keadaan harus dikembalikan pada keadaan semula ketika belum terjadi perbuatan hukum dalam akta yang bersangkutan sehingga pihak lain dalam perjanjian yang telah terlanjur menerima prestasi dari pihak lain wajib mengembalikannya. Therefore, research is needed so that the legal position of SPPHAT as the basis for proof of ownership of land rights is clearer and can be understood by the community. This research was conducted in a normative juridical manner with a legal and conceptual approach. Based on the result, it is concluded that according to land law, land status with SPPHAT evidence is state land. Therefore, efforts to process land rights applications and land registration are still needed. So that a land certificate is issued as proof of ownership of the land.Bahasa Indonesia Abstrak: Masih banyaknya status tanah di Indonesia yang belum memiliki sertipikat hak atas tanah khususnya di wilayah-wilayah pedesaan. Menjadi salah satu faktor memunculkan banyak sengketa tanah yang terjadi. Salah satunya tanah yang masih berstatus Surat Pernyataan pelepasan hak atas tanah (SPH) dianggap memiliki kedudukan yang sama kuatnya dengan bukti sertipikat hak atas tanah. Faktor penyebab utamanya adalah masih terdapat kebingungan di masyarakat perihal pengaturan terhadap bukti kepemilikan hak atas tanah dan syarat-syarat serta mekanisme untuk memperolehnya. Oleh karena itu diperlukan penelitian agar kedudukan hukum SPH sebagai dasar bukti kepemilikan hak atas tanah semakin jelas dan dapat dipahami oleh masyarakat. Penelitian ini dilakukan secara yuridis normatif dengan pendekatan undang-undang dan konseptual. Dari penelitian ini disimpulkan bahwa secara hukum pertanahan, status tanah dengan bukti SPPHAT merupakan tanah negara. Oleh karenanya, masih diperlukan upaya proses permohonan hak atas tanah dan pendaftaran tanah. Land certificates can be issued when a person or legal entity submits an application for land registration. Land registration is an activity that aims to provide legal certainty for land owners. Land registration activities for the first time can be carried out sporadically by land owners while systematic land registration is carried out simultaneously by the government. One of the systematic land registration activities carried out by the government is the complete systematic land registration (PTSL). Land registration is one of the ways the state does to create legal protection related to land ownership and land owners. In fact, when the state implements a complete systematic land registration (PTSL) program to create legal certainty, maladministration occurs when land certificates overlap between one piece of land and another. Overlapping of land rights certificates has been a case in administrative courts and that is the object of this research. The research was conducted using the juridical-normative method. The purpose of this research is to analyze the legal protection of land rights certificate holders. A land certificate with a systematic land registration program which is declared to have no legal force by the court.Bahasa Indonesia Abstrak: Sertipikat hak atas tanah adalah bukti kepemilikan bagi seseorang atau badan hukum yang terkait dengan tanah. Sertipikat tanah dapat diberikan ketika seseorang atau badan hukum yang mengajukan permohonan pendaftaran tanah. Pendaftaran tanah merupakan kegiatan yang bertujuan untuk memberikan kepastian hukum bagi pemilik tanah. Kegiatan pendaftaran tanah pertama kali dapat dilakukan secara sporadik yang dilakukan oleh pemilik tanah sedangkan pendaftaran tanah secara sistematik yang dilakukan secara serentak oleh pemerintah. Kegiatan pendaftaran tanah secara sistematik yang dilakukan oleh pemerintah salah satunya yaitu pendaftaran tanah sistematis lengkap (PTSL). Pendaftaran tanah merupakan salah satu cara yang dilakukan negara untuk menciptakan perlindungan hukum terkait kepemilikan tanah dan pemilik tanah. Pada kenyataannya, ketika negara melaksanakan program pendaftaran tanah sistematis lengkap (PTSL) untuk menciptakan kepastian hukum terjadi maladministrasi ketika sertipikat tanah tumpang tindih antara sebidang tanah dan sebidang tanah lainnya. Tumpang tindih sertipikat hak atas tanah telah menjadi kasus di pengadilan administrasi dan itulah objek penelitian ini. Penelitian dilakukan dengan metode yuridis normatif. Tujuan penelitian untuk menganalisis perlindungan hukum pemegang sertipikat hak atas tanah. Additionally, PPAT accuracy must be considered, particularly in the administration of their office. This research discusses PPAT's responsibility for the forgery of letters performed by their employees, and the judge's consideration in the decision on case No. 16/Pid.B/2018/PN.MTR. The author employs a normative juridical research method in this study. The research findings in terms of PPAT's responsibility for employee letter forgery; administrative responsibility, subjected to a sanction of suspended of written warning by head of land office; civil law responsibility, subjected to a sanction caused of unlawful act; criminal responsibility, can’t be charged for responsibility; PPAT must always pay attention to the regulations applicable to their positions to avoid mistakes and sanctions. PPAT supervision and guidance must still be carried out properly in order to build better quality of PPAT.Bahasa Indonesia Abstrak: Pejabat Pembuat Akta Tanah (PPAT) memerlukan karyawan untuk membantu menjalankan jabatannya, namun PPAT juga harus memperhatikan setiap tindakan yang dilakukan oleh karyawannya dalam menjalankan pekerjaannya, selain itu juga ketelitian PPAT perlu diperhatikan terutama terhadap administrasi kantornya. Rumusan masalah dalam penelitian ini adalah mengenai pertanggungjawaban PPAT terhadap perbuatan pemalsuan surat yang dilakukan oleh karyawannya; dan pertimbangan hakim dalam Putusan No. 16/Pid.B/2018/PN.MTR. Dalam penelitian ini penulis menggunakan metode penelitian yuridis normatif. Hasil penelitian dalam hal pertanggungjawaban PPAT terhadap perbuatan pemalsuan surat yang dilakukan oleh karyawannya; tanggung jawab secara administrasi dapat dikenakan sanksi teguran tertulis; tanggung jawab secara perdata dapat dibebankan perbuatan melawan hukum atas kelalaian yang mengakibatkan kerugian; tanggung jawab secara pidana tidak dapat dibebankan. The Panama Papers scandal triggered the principle of recognizing the beneficial owner, so many countries have subsequently committed to implementing this principle. The implementation of recognizing the beneficial owner is carried out to prevent the occurrence of criminal acts of money laundering and terrorism financing (ML-TF). Entrepreneurs often carry out ML-TF by hiding the actual BO in a company (done with a layering structure). The implementation of the principle of recognizing the BO is carried out in Singapore and Indonesia. However, in practice, there are some similarities and differences. The purpose of this study is to explain the regulation and its implementation of recognizing the beneficial owners of a private limited liability company in Singapore and Indonesia, as well as to find out the roles and responsibilities of those who report the beneficial owner information. This study uses an empirical normative legal research method assisted by a comparative law approach. This research shows that the reporting party in both countries is the board of directors, but in Singapore, the other party obliged to report is the Corporate Secretary, while in Indonesia, it can also be reported by a notary based on a power of attorney. This difference in roles results in different responsibilities for the reporting party. According to the author, Indonesia can create a profession such as the corporate secretary to identify and verify the BO. This is because the identification is an obligation that is material proof, so it cannot be imposed on a notary who only has a formal evidentiary responsibility.BAHASA INDONESIA ABSTRACT:Beneficial Owner atau Pemilik Manfaat pada Perseroan Terbatas tertutup (Perseroan) adalah orang perseorangan yang kepemilikan sahamnya lebih dari 25% atau memiliki kendali di Perseroan. Prinsip mengenali Pemilik Manfaat ini dipicu dari skandal Panama Papers, sehingga banyak negara yang kemudian berkomitmen untuk menerapkan prinsip tersebut. Penerapan mengenali Pemilik Manfaat dilakukan dengan tujuan untuk mencegah terjadinya tindak pidana pencucian uang dan pendanaan terorisme (TPP-PT). TPP-PT sering ditemukan dilakukan oleh para pengusaha dengan cara menyembunyikan Pemilik Manfaat yang sebenarnya dalam suatu Perseroan (dilakukan dengan struktur layering).
