In Indonesia, criminal acts of corruption are regulated in Law Number 31 of 1999 concerning Eradication of Corruption Crimes. The problem of corruption is part of the problem of legal politics. Legal politics itself can simply be formulated as legal expertise (Legal Policy) that will be or has been implemented nationally by the government, including the understanding of how politics influences law by looking at the configuration of the forces behind and law enforcement. The purpose of conducting this research is to provide an overview of the role of legal politics in eradicating corruption in Indonesia. The method used in this research is descriptive analysis method, namely by collecting data in accordance with the actual data then compiled, processed and analyzed to be able to provide an overview of the existing problems. \u0000Keywords: Corruption, Crime, Legal Politics \u0000 \u0000Abstrak \u0000Persoalan korupsi di Indonesia saat ini merupakan pesoalan yang kronis. Di Indonesia tindak pidana korupsi diatur dalam Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi. Permasalahan korupsi merupakan bagian dari persoalan politik hukum. Politik hukum sendiri secara sederhana dapat dirumuskan sebagai keahlian hukum (Legal Policy) yang akan atau telah dilaksanakan secara nasional oleh pemerintah, mencakup pula pengertian bagaimana politik mempengaruhi hukum dengan cara melihat konfigurasi kekuatan yang ada di belakang dan penegakan hukum itu. Tujuan dari diadakannya penelitian jni yakni untuk memberi gambaran mengenai peran politik hukum dalam pemberantasan korupsi di Indonesia. Based on regulations, the workforce is governed by an employment agreement system which is divided into fixed-term employment agreements (PKWT) and indefinite-term employment agreements (PKWTT). Further regulations regarding fixed-term employment agreements are stipulated in Article 56 and 57 of Law No. 13 of 2003 on employment. Based on these regulations, it is known that a fixed-term employment agreement (PKWT) must be made in writing and must use the Indonesian language and Latin letters. However, in practice, there are still business operators who employ workers without complying with the existing regulations. A dispute arose between PT. SRIKANDI INTI LESTARI as the employer and the workers named Sentosa, Sukardi Oloan, Sholikin, Tumpal Marsaor Pangihutan, Baos Albert Silalahi, Akhiar, Nurwedi, and Arse, who are employees working at PT. SRIKANDI INTI LESTARI. It was found that the workers worked under a contract status as fixed-term employees (PKWT) continuously and sustainably for more than 3 (three) years without any break. Among the employment contracts, some of them were not made in writing, but were only agreed upon orally. \u0000 Keywords: Workforce, employment agreement, fixed-term employment agreements, Regulation \u0000 \u0000 Abstrak \u0000 Tenaga kerja merupakan bagian penting dalam suatu perusahaan tanpa adanya tenaga kerja maka perusahaan tidak dapat berjalan. Berdasarkan pada peraturan perundang-undangan, tenaga kerja diatur dengan sistem perjanjian kerja yang dikelompokkan menjadi perjanjian kerja waktu tertentu (PKWT) dan perjanjian kerja waktu tidak tertentu (PKWTT). Pengaturan mengenai perjanjian kerja waktu tertentu lebih lanjut diatur di dalam UU No 13 Tahun 2003 tentang ketenagakerjaan pada pasal 56 dan 57, berdasarkan peraturan perundang-undangan tersebut diketahui bahwa suatu perjanjian kerja waktu tertentu (PKWT) dibuat secara tertulis serta harus menggunakan Bahasa Indonesia dan huruf latin. Namun pada praktik kenyataanya masih saja didapati pelaku usaha yang mempekerjakan pekerja dengan tidak sesuai ketentuan peraturan perundang-undangan yang ada. Seperti perselisihan yang terjadi antara PT. Untuk mencapai tujuan tersebut penulis menggunakan metode pendekatan yuridis normatif, Sumber data adalah data sekunder sebagai data utama yang meliputi bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Data yang diperoleh dianalisa secara kualitatif. Kesimpulan: Berdasarkan hasil penelitian dan pembahasan tentang kedudukan akta hibah yang dibuat oleh Notaris untuk anak angkat secara normatif adalah Akta Hibah Nomor 19/2008 tertanggal 28 april 2008 yang dibuat dihadapan Notaris Jhonni M Sianturi, SH sah dan mempunyai kekuatan hukum, karena telah memenuhi syarat dalam perjanjian hibah baik \u0000 \u0000secara formil maupun materiil. Kekuatan pembuktian akta notaris sebagai alat bukti adalah kekuatan pembuktian yang sempurna, karena keistimewaan dari suatu akta autentik terletak pada kekuatan pembuktiannya. Suatu akta autentik memberikan para pihak beserta ahli warisnya atau orang-orang yang mendapat hak darinya suatu bukti yang sempurna. Suatu akta autentik memiliki kekuatan pembuktian sedemikian rupa yang dianggap melekat pada akta itu sendiri, artinya akta autentik merupakan suatu bukti yang mengikat karena apa yang tertulis dalam akta itu harus dianggap benar adanya dan dipercaya oleh hakim. Akta autentik juga memiliki kekuatan pembuktian yang sempurna karena tidak memerlukan penambahan alat bukti lainnya dengan kata lain akta autentik memiliki kekuatan pembuktian secara lahiriah, Formal dan materiil sesuai ketentuan berdasarkan Pasal 1886 KUHPerdata. This research uses sociological juridical research methods. The collection of research data was carried out by means of field interviews and observations supported by literature studies. Data analysis in this study is descriptive qualitative. Based on the results of research and discussion, it can be concluded that Iimplementation of Banyumas Regency Regional Regulation Number 19 of 2014 concerning Protection and Services for Persons with Disabilities (Especially Protection and Fulfillment of Health Rights for Persons with Multiple Disabilities) has been implemented by The Banyumas Social and Community and Village Empowerment Office (Dinsospermasdes) with the existence of social rehabilitation and community participation of the Paguyuban Peduli Disabiltas Ganda (PPDG) through its work program that handles 95 people with multiple disabilities with a percentage of 11% of the number of people with multiple disabilities in Banyumas Regency. In the implementation of the fulfillment of health rights, there are obstacles that must be faced, namely the limited professional or competent human resources owned, data on persons with disabilities in Banyumas Regency have not been updated thoroughly, the limited budget available for the implementation of the fulfillment of the right to k health of persons with disabilities, lack of family awareness of the rights of persons with disabilities due to shame and they prefer to hide their children, limited access to information from and for people with disabilities. \u0000Keywords: Implementation of Local Regulations, Persons with Multiple Disabilities, Fulfillment of Health Rights \u0000 \u0000Abstrak \u0000Penelitian ini bertujuan untuk mengetahui Implementasi Peraturan Daerah Kabupaten Banyumas Nomor 19 Tahun 2014 Tentang Perlindungan dan Pelayanan Bagi Penyandang Disabilitas (Khususnya Perlindungan dan Pemenuhan Hak Kesehatan Terhadap Penyandang Disabilitas Ganda), dan untuk mengetahui hambatan yang dihadapi dalam pelaksanaan pemenuhan hak atas Kesehatan bagi penyandang disabilitas ganda. Materially, the existence of a grant has something to do with inheritance. Provisions/rules regarding grants in Indonesia are still pluralistic. Basically, an owner of property has the right and freedom to give/grant to anyone, including his children, provided that the gift (grant) does not cover and does not reduce other rights as heirs. If the conditions and pillars are met then the grant is valid. Giving grants according to Islamic law (Compilation of Islamic Law) is limited to a maximum of 1/3 (one third) of the total assets of the grantor. In the event that grants are made to their children (heirs), then the limitation is that grants must be made with the principle of justice. This grant limit is given to protect the rights of the heirs after the grantor dies. In addition to the maximum limits regulated in the Compilation of Islamic Law (KHI), customary law and the Civil Code also provide the same limits on grant grants. This is intended to protect the absolute rights of the heirs and to avoid losses suffered by the heirs whose share cannot be reduced according to law (legitieme portie). \u0000Keywords: Grants, conditions, restrictions \u0000 \u0000Abstrak \u0000Hibah merupakan pemberian seseorang kepada orang lain dimana sipemberi tersebut masih dalamkeadaan hidup. Secara materiil, eksistensi hibah ada hubunganya dengan kewarisan. Ketntuan/aturan tentang hibah di Indonesia sampai saat ini masih bersifat pluralistis. Pada dasarnya seorang pemilik harta kekayaan berhak dan leluasa memberikan/menghibahkan kepada siapapun, termasuk pula kepada anaknya dengan syarat pemberian (hibah) tersebut tidak menutup dan tidak mengurangi hak-hak yang lain sebagai ahli waris. Apabila syarat dan rukunnya terpenuhi maka hibah tersebut adalah sah. Pemberian hibah menurut hukum Islam (Kompilasi Hukum Islam) dibatasi maksimal 1/3 (sepertiga)dari keseluruhan harta pemberi hibah. Dalamhal pemberian hibah dilakukan kepada anak-anaknya (ahli waris),maka batasannya adalah penghibahan harus dilakukan dengan prinsip keadilan. Batasan pemberian hibah ini diberikan untuk melindungi hak-hak para ahli waris setelah pemberi hibah meninggaldunia. Selain batasan maksimal yang diatur dalam Kompilasi Hukum Islam (KHI) , hukum adat dan KUHPerdata juga memberikan batasan yang sama dalam pemberian hibah. Corruption can be carried out in all aspects of society, from the lower classes to the upper classes. Corruption has become a legal issue which is complicated to deal with, because corruption is related to political, economic, and socio-cultural aspects, which can endanger the stability, security of the state and its people. However, in the matter of corruption, it must be realized that it is not a matter of the large amount of state losses, or the increasingly sophisticated corrupt modus operandi or Indonesia's ranking as one of the countries with the most corruption, but the fact that the difficulty of eradicating corruption in Indonesia is revealed due to the powerlessness of law enforcement officials. in dealing with corruption cases. Legal politics is understood as choices regarding laws or regulations that are enforced and are intended to achieve state goals as stated in the Preamble to the Constitution of the 1945 Constitution of the Republic of Indonesia. The direction of legal politics for eradicating corruption should have to be continuously reflected and evaluation, whether the legal politics produces policies and legal products that are the ideals of the nation, or turn out to be an obstacle to the nation's aspirations to achieve prosperity. This study aims to find out how the application of legal politics in Indonesia in eradicating corruption and what factors hinder legal politics in eradicating corruption in Indonesia. The approach method used in this study is the normative juridical approach which is carried out by examining library materials, namely books, journals, official articles exploring legal doctrines and theories from various literature and applicable laws and regulations. related to the issues discussed. And Abandoned Dharmo Yuwono. Based on the results of the research and discussion, it can be concluded that the implementation of fulfilling the right to education for neglected children criteria for orphans at the Dharmo Yuwono Orphanage and Abandoned Social Foundation is in accordance with Article 31 paragraph (1) of the 1945 Constitution of the Republic of Indonesia which states that every citizens have the right to education and Article 34 which states that the poor and neglected children are protected by the state, in accordance with Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection and Regulation of the Minister of Social Affairs of the Republic Indonesia Number: 30/HUK/2011 which states that fulfilling the rights of neglected children, one of which is the right to education, is carried out by providing formal, non-formal and informal education. Obstacles in implementing the fulfillment of the right to education for neglected children according to the criteria for orphans at the Dharmo Yuwono Orphanage and Abandoned Social Foundation, namely the lack of awareness of foster children in carrying out their rights and obligations. \u0000Keywords: Implementation, Fulfillment of Rights, Education, Abandoned Children. \u0000Abstrak \u0000Penelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan Yayasan Sosial Panti Asuhan Yatim Piatu Dan Terlantar Dharmo Yuwono dalam pemenuhan hak pendidikan terhadap anak terlantar kriteria anak yatim piatu dan untuk mengetahui bagaimana kendala atau hambatan-hambatan yang dihadapi serta upaya yang dilakukan oleh Yayasan Sosial Panti Asuhan Yatim Piatu Dan Terlantar Dharmo Yuwono. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa Pelaksanaan pemenuhan hak pendidikan terhadap anak terlantar kriteria anak yatim piatu di Yayasan Sosial Panti Asuhan Yatim Piatu Dan Terlantar Dharmo Yuwono sesuai dengan Pasal 31 ayat (1) Undang-Undang Dasar Republik Indonesia tahun 1945 yang menyebutkan bahwa setiap warga negara berhak mendapatkan pendidikan dan Pasal 34 yang menyebutkan bahwa fakir miskin dan anak-anak terlantar yang dilindungi oleh negara, sesuai dengan Undang-Undang Nomor 35 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak dan Peraturan Menteri Sosial Republik Indonesia Nomor : 30/HUK/2011 yang menyebutkan bahwa pemenuhan hak terhadap anak terlantar salah satunya hak pendidikan dilakukan dengan memberikan pendidikan formal, non formal, dan informal. This study aims to find out the assistance by the Purwokerto Correctional Center for children who committed violence resulting in the death of the victim in decision number 3/Pid.Sus-Anak/2021/PN.Pbg and the constraints of the Purwokerto Correctional Center in assisting children which resulted in the death of the victim in decision number 3/Pid.Sus-Child/2021/PN.Pbg. The type of research used is empirical juridical with the main data source being primary data. The results of the research show that the Purwokerto Correctional Center has provided assistance since the RP was investigated at the police office, examination at trial until after the court decision. The obstacle faced by the Purwokerto Correctional Center in assisting RPs is the existence of RPs which are difficult for assistants to reach because their houses are in mountainous areas where communication facilities and road infrastructure are difficult for PKs to access. \u0000Keywords: Correctional Center Assistance (BAPAS), Criminal, Children \u0000 \u0000 \u0000 \u0000Pendampingan oleh Balai Pemasyarakatan Purwokerto terhadap anak pelaku RP (17 tahun) yang melakukan kekerasan hingga mengakibatkan matinya korban dilakukan sejak tahap Pra adjudikasi, Adjudikasi, Pos adjudikasi sesuai dengan ketentuan Undang-Undang nomor 11 Tahun 2012 tentang Sistim Peradilan Pidana Anak. Penelitian ini bertujuan untuk menqetahui pendampingan oleh Balai Pemasyarakatan Purwokerto terhadap anak yang melakukan kekerasan mengakibatkan matinya korban dalam putusan nomor 3/Pid.Sus-Anak/2021/PN.Pbg dan kendala Balai Pemasyarakatan Purwokerto dalam pendampingan terhadap anak yang mengakibatkan matinya korban dalam putusan nomor 3/Pid.Sus-Anak/2021/PN.Pbg. Jenis penelitian vang digunakan adalah yuridis empiris dengan sumber data pokoknya adalah data primer. Hasil penelitian menunjukan Balai Pemasyarakatan Purwokerto melakukan pendampingan sejak RP disidik di kantor kepolisian, pemeriksaan di persidangan sampai pasca putusan pengadilan. This study aims to find out the differences between the legal systems of Indonesia and the United States, as well as find out the similarities and differences of restorative justice in Indonesia and the United States. The research method used is normative juridical with a comparative approach. The results of the study show that the differences in the legal systems in Indonesia and the United States are influenced by the form of the state, Indonesia with the form of a republican unitary state that adheres to a civil law legal system, in which written legal regulations are used as laws and legal basis that must be obeyed by all citizens within the territory of the unitary Indonesia. Whereas the United States as a federal country that adheres to the common law legal system, has several laws that serve as its basis, federal law as the highest state law that applies to all states, and state law that only applies to each state. In the application of restorative justice, Indonesia and the United States have similarities, namely, its application is limited to minor crimes and applies to both juvenile and adult justice, the application of restorative justice aims as an effort to reduce inmates to prevent overcapacity in detention centers. The difference in the application of restorative justice in Indonesia is that laws regarding restorative justice apply to all communities and regions within the scope of the unitary state, whereas in the United States each state has different laws regarding the application of restorative justice, there are at least forty-five out of fifty states that have incorporated restorative justice into state laws. \u0000 \u0000Keywords: Comparative Study, Restorative Justice, Legal System \u0000 \u0000Konsep restorative jusctice semakin berkembang dan diadopsi oleh beberapa negara di dunia dengan penyebutan yang berbeda, Amerika Serikat menyebutnya victim offender mediation, sedangkan di Indonesia dikenal dengan konsep keadilan restoratif atau restorative justice. Penelitian ini bertujuan untuk mengetahui perbedaan sistem hukum Indonesia dan Amerika Serikat, serta mengetahui persamaan dan perbedaan restorative justice di Indonesia dan Amerika Serikat. Metode penelitian yang digunakan adalah yuridis normative dengan pendekata komparattif. Both the old and new Criminal Codes (KUHP) still regulate the death penalty, albeit in different concepts. This research aims to identify the differences between the death penalty in the old and new Criminal Codes and to understand and analyze the death penalty in the new Criminal Code from a human rights perspective. The research employs a normative juridical method. The findings indicate that the death penalty in the new Criminal Code is no longer the primary punishment as in old Criminal Codes and has been replaced with an alternative penalty. Under the new Criminal Code, those sentenced to death will undergo a probationary period of 10 (ten) years, and if they demonstrate good behavior during this period, the death penalty will be commuted to life imprisonment or imprisonment for 20 (twenty) years. This change is motivated by the perception that the death penalty constitutes a violation of human rights. \u0000 \u0000Keyword: death penalty, Indonesian new penal code, human rights \u0000 \u0000 \u0000Indonesia merupakan negara yang mengakui eksistensi Hak Asasi Manusia namun hal tersebut tidak membuat Indonesia menghapus hukuman mati dalam hukum positif di Indonesia. Baik KUHP lama maupun KUHP baru masih mengatur hukuman mati meskipun dalam konsep yang berbeda. Penelitian ini bertujuan untuk mengetahui perbedaan hukuman mati dalam KUHP lama dan KUHP baru serta mengetahui dan menganalisis hukuman mati dalam KUHP baru dalam perspektif hak asasi manusia. Penelitian ini menggunakan metode yuridis normatif. Hasil penelitian menunjukkan bahwa pidana mati dalam KUHP baru tidak menjadi pidana pokok sebagaimana dalam KUHP lama dan beralih menjadi pidana alternatif. Terpidana mati dalam KUHP baru akan menjalani masa percobaan selama 10 (sepuluh) tahun dan apabila selama masa percobaan terpidana terbukti berbuat baik pidana diubah menjadi penjara seumur hidup atau pidana penjara selama 20 (dua puluh) tahun.
