The research displays this topic in four chapters: demonstrative Pronouns, relative Pronouns, La \" no\" negation of gender, and the vocative style. The research has also examined Arabic references along the history of Arabic Syntax to detect their reviews and evidence. The thesis sometimes follows and sometimes denounces the inherited views. The thesis tries to show evidence seeking proof of its attitude. The researcher has selected a certain Hadith by prophet Muhammad (peace be upon him); the Hadith of Hateb Ibn Abi Balta'h's (May Allah be pleased with him) story where he was dispatched to the people of Mecca. The research has applied the inductive and analytical approaches where the researcher extrapolates the chain of narrators of the Hadith and its evidence then he analyzes its word and issues. The research runs through an introduction that highlights the title of the research، its main issue، its objectives، the general approach، the working plan and the procedures. The introduction is followed by two chapters; the first one contains the chain of narrators، the evidence and the final judgment. Then the chapter examines the word of Hadith in order to display its meaning. As for the second chapter، it is dedicated to display doctrinal issues such as the provision of adherence، interpretation/ misinterpretation... etc. In addition، the chapter handles other issues related to jurisprudential fundamentalism such as the provision of working as a spy، looking at a foreign woman and the other benefits from this Hadith. {"title":"تعقبات الإمام الشوکانی (1250هـ) على الإمام الزمخشری(538هـ) من خلال سورة آل عمران عرض ودراسة وتعلیق","authors":"محمد علي","doi":"10.21608/bfsa.2021.184735","DOIUrl":"https://doi.org/10.21608/bfsa.2021.184735","url":null,"abstract":"تعقب الإمام الشوکاني-رحمه الله- في کتابه «فتح القدير» آراء بعض من سبقه من المفسرين، وکان ممن تعقبهم الإمام الزمخشري-رحمه الله- في تفسيره «الکشاف». وفي هذا البحث قمت بتتبع تعقبات الإمام الشوکاني على الإمام الزمخشري –رحمهما الله- في سورة آل عمران، وذلک من خلال استخراجها من مظانها، ودراستها؛ لأبين أي الرأيين أقرب لتوضيح المراد.  وکان الهدف من البحث معرفة فقه الخلاف الذي يفتح باب الحوار الهادئ بين المتأخرين والمتقدمين، وهذا يجعل انتقاد الأکابر يکون بالأدب الجم، وينبئ عن مدى الوعي الکامل، والاعتراف بالسبق في ميدان تفسير القرآن. ومن أهداف البحث أيضا أن الکتابة في مثل هذه الموضوعات تصقل الباحث من الناحية العلمية، حيث إنه يدرس الرأي والرأي الآخر، ويقارن بينهما، ويرجح ما يراه راجحا بالدليل، فهذا يصقله ويقويه علميا. والمنهج المتبع في البحث هو المنهج التحليلي، والنقدي؛ حيث قمت بجمع تعقبات الإمام الشوکاني على الإمام الزمخشري الواردة في سورة آل عمران، وعنونت لها بعنوان يناسبها، وذکرت الراجح فيها بالدليل، وقد أثبت في البحث الآيات القرآنية، وجعلت الآية بين معکوفين ﴿﴾ وذکرت اسم السورة ورقمها، ورقم الآية في الهامش، کما خرجت الأحاديث النبوية والآثار، مکتفيا بذکر أشهر من أوردها من أئمة الحديث، مع ذکر الکتاب، والباب، والجزء، والصفحة، ورقم الحديث، وعزوت الأبيات الشعرية إلى مصادرها ونسبتها إلى قائليها، ووضحت الألفاظ الغريبة والمصطلحات؛ بالرجوع إلى المعاجم اللغوية، وترجمت الأعلام الوارد ذکرهم- عدا الصحابة- لأول مرة؛ ترجمة مختصرة تزيل اللبس عنهم، وتدعو القارئ إلى الاقتداء بهم، وإلى نشر مآثرهم، وذيلت البحث بفهرسين؛ فهرس للمصادر والمراجع، ملتزما في ترتيبه حروف المعجم، وفهرس الموضوعات؛ على حسب ترتيبها في البحث. وقد سلکت في هذا البحث المنهج العلمي دون أي تجريح، وکانت غايتي هي معالجة الأقوال دون التفات إلى شخصية قائلها، وقد خلصت في بحثي إلى أن الإمام الشوکاني قد أصاب في بعض تعقباته على الإمام الزمخشري، وجانبه الصواب في البعض الآخر. \u0000Imam Shawkani's (1250 A.H.) They also include some gestures to training for this and some of the most outstanding professional jobs in the time of Prophet Muhammad peace be upon him. The research has also discovered some of the matters that serve the process of training for professional work so as to enable the Muslim to work in accordance with the prophetic guidance concerning this kind of career. The researcher has extrapolated the Hadiths related to this topic then he documented and authenticated them according to the rules of Hadith. The research is divided into three divisions; the first division is devoted to handling the Hadiths that deal with earning living and professional work. The second division deals with the narrations around the industries and professional jobs that existed in the time of prophethood. Whereas the third division highlights leaning and training for earning one's living and professional work. The researcher has traced the industries and professional jobs identified by prophet Muhammad and existed in his time. They were around eighteen jobs. This comparison intends to show what conforms to the Sunnah and what does not. The research applies the comparative approach due to the nature of the study. It also tries to satisfy four requirements; the first one deals with the concept of physical violence in the light the prophetic Sunnah and the social perspective. Whereas the second investigates the causes of physical violence according to the Sunnah and the social perspective. As for the third requirement, it focuses on the aftermath of physical violence in both the Sunnah and the social perspective. Concerning the fourth requirements, it examines the social theories that interpret physical violence in the light of the prophetic Sunnah. Finally, the conclusion sums up the findings of this research which have proved that the prophetic Sunnah and the social perspective largely agree to the causes and aftermath of physical violence. Due to the fact that the Word of Allah is the best and has no match, this research intends to discuss the gemstones revealed in Surat Al- An'am which includes a great deal of innate and mental evidence of the existence of Allah; the only creator, Lord of the worlds and the Disposer of all creatures. The research highlights these attributes as achieving monotheism and proving the existence of Allah constitutes the way to achieve the objective beyond crating mankind which is worshipping the Only One; Allah, Glory be to Him. The Holy Qur'an uses a variety of techniques to prove the existence of Allah. Those techniques include mental clues which rely on logical persuasion, meditation, thinking of the selves, innate discourse, addressing one's conscience through advice and reminding. All these reasons are quite clear in Surat Al- An'am and that's why the research resorts to this chapter of the Holy Qur'an seeking persuasive responses for the pleas of those who denounce the existence of Allah. Consequently, the system of commercial concession has been identified for its great importance and its large influence on economy. The research follows the inductive approach where the researcher extrapolates the sayings of the jurists concerning the issue of selling objects before receiving their prices and highlighting their methodologies of handling the issues through examining their words and texts. The approaches of deduction and critical analysis are also utilized by the researcher as he refers to the sayings of the jurists regarding the jurisprudential issues supported by clues connected to each saying and the researcher discusses them scientifically till the preponderant saying related to the issue is settled. The researcher is keen on clarifying the linguistic and idiomatic meanings of the right and religion as well clarifying the relationship between the right and the judiciary، and the concept of right for the jurists. Then the researcher highlights some lawful financial transactions. The purpose of stating some lawful transactions is showing how right and religion are closely connected to lawful financial transactions which constitute the most likely fields where the importance of right، religion and judiciary come to the ground. Generally speaking، people do never conflict over acts of worship but instead they conflict over business transactions. The research also emphasizes the peril of monopoly and the great harm it causes to economic state something that made the legislator understand this matter and keep up with what has been revealed by Almighty Allah concerning monopoly as it is in controversy with the objectives of Sharia. Almighty Allah said \" And [mention, O Muhammad], when your Lord said to the angels, \"Indeed, I will make upon the earth a successive authority.\" (al- Baqarah, 30) Being the successive of Almighty Allah on His earth has qualified man to work and be keen on earning money in various fields of life that are made lawful by Allah. Since work in ancient times meant enslavement, dependency and it may also mean disgrace and dishonor, the prophetic Sunnah has clarified the workers' rights and their duties to preserve the rights and dignity of the worker. The Sunnah is also keen on providing the worker with a kind of decent life, letting him recognize his duties for the sake of establishing a kind of stable relationship in between the workers and their employers. Accordingly, justice prevails, and people live in a safe and secure atmosphere. The researcher has applied the inductive, descriptive and analytical approaches where he extrapolated the textbooks and some interpretations of Hadiths so as to specify the prophetic traditions that dealt with the workers' rights and duties. Then, he researcher has resumed his descriptions, analysis, exposition and explanation.
