Abstract

حقوق العمال وواجباتهم في ضوء السنة النبوية "دراسة موضوعية" عصام أبو اليزيد محمد عبد الله قسم الحديث وعلومه، کلية أصول الدين والدعوة الإسلامية، جامعة الأزهر – فرع المنوفية، مصر. الإيميل الجامعي: Essam22@azhar.edu.eg الملخــــــص إن الإنسان هو خليفة الله في أرضه قال تعالى:ﭽ ﭑ ﭒ ﭓ ﭔ ﭕ ﭖ ﭗ ﭘ ﭙﭼ[البقرة :30] ولما کان الإنسان هو خليفة الله في أرضه فقد أهله ذلک للعمل والسعي على الکسب في شتى مجالات الحياة المختلفة مما أحله الله تعالى ولما کان العمل في العصور القديمة يعني الرق والتبعية وقد يعني الذل والهوان لذلک فقد جاءت السنة النبوية المطهرة مبينة لحقوق العمال وواجباتهم حتى تحفظ للعامل حقه وکرامته وتوفر له الحياة الکريمة وتعرفه بواجباته فتستقيم العلاقة بين العمال وأرباب الأعمال ويتحقق بذلک العدل ويشيع الأمن والأمان بين الناس هذا وقد سميت البحث بــــ " حقوق العمال وواجباتهم في ضوء السنة النبوية" دراسة موضوعية، وقد اتبعت في کتابته المنهج الاستقرائي والمنهج الوصفي التحليلي حيث قمت باستقراء کتب المتون وبعض الشروح الحديثية للوقوف على الأحاديث النبوية التي تناولت حقوق العمال وواجباتهم ثم قمت بالوصف والتحليل والبيان والشرح ومن ثم يبرز ريادة السنة النبوية في معالجة القضايا المعاصرة، والله الموفق.         Workers' Rights and Duties in the Light of the Prophetic Sunnah An Objective Study    By: Essam Abu Al- Yazeed Muhammed Abdallah Department of Hadith and its Sciences Faculty of Osoul Al- Deen and Islamic Da'wah Azhar University- Menofia Branch   Abstract  Man is the successive of Allah on His earth. Almighty Allah said " And [mention, O Muhammad], when your Lord said to the angels, "Indeed, I will make upon the earth a successive authority." (al- Baqarah, 30) Being the successive of Almighty Allah on His earth has qualified man to work and be keen on earning money in various fields of life that are made lawful by Allah. Since work in ancient times meant enslavement, dependency and it may also mean disgrace and dishonor, the prophetic Sunnah has clarified the workers' rights and their duties to preserve the rights and dignity of the worker. The Sunnah is also keen on providing the worker with a kind of decent life, letting him recognize his duties for the sake of establishing a kind of stable relationship in between the workers and their employers. Accordingly, justice prevails, and people live in a safe and secure atmosphere. The researcher has applied the inductive, descriptive and analytical approaches where he extrapolated the textbooks and some interpretations of Hadiths so as to specify the prophetic traditions that dealt with the workers' rights and duties. Then, he researcher has resumed his descriptions, analysis, exposition and explanation. Finally, the researcher has highlighted the primacy of prophetic Sunnah in tackling modern issues.
