In general, victims of sexual harassment are children and adolescents who are under 18 years of age, only in some cases of sexual harassment where the victim is an adult woman. As for one of the legal efforts made by the Banda Aceh Police Criminal Unit by using the Child Protection Law related to the case of children as victims of sexual harassment. The formulation of the problem in this research is what is the position of the Child Protection Law against children as victims of sexual harassment in Aceh and why Polri investigators apply the Child Protection Law instead of the Qanun in enforcing law enforcement. The aim of this research is to find out and explain the position of the Child Protection Law against children as victims of sexual harassment in Aceh and to find out and explain that Police Investigators apply the Child Protection Law compared to Qanun in enforcing law enforcement. This research is a field research (field research) using qualitative methods that collect data through observation and interviews. When viewed from the use of laws used by investigators of the Banda Aceh Police Criminal Investigation Unit from 2018 to September 2020 with a total of 45 cases both completed and in the process of investigation and investigation, all using the Child Protection Law, none. using both the Qanun  and the Criminal Code. If the investigator applies the Qanun  for perpetrators of sexual violence against children and it is feared that a potential conflict or problem will occur between the victim and the perpetrator if the investigator continues to use the Qanun, that perpetrators of sexual violence against children will be sentenced to imprisonment instead of being punished by caning so that This is considered to provide a sense of justice for the victim and will have a deterrent effect on the perpetrator.\u0000 \u0000Artikel ini dilatarbelakangi oleh banyaknya kasus pelecehan seksual yang terjadi di Provinsi Aceh saat ini yang dialami oleh anak-anak dan remaja khususnya perempuan. Pada umumnya korban pelecehan seksual adalah anak-anak dan remaja yang berusia di bawah 18 tahun, hanya pada beberapa kasus pelecehan seksual dimana korbannya adalah wanita dewasa. Adapun salah satu upaya hukum yang dilakukan oleh Satuan Reserse Kriminal Polres Banda Aceh dengan menggunakan UU Perlindungan Anak terkait kasus anak sebagai korban pelecehan seksual. Artikel ini menguraikan tentang bagaimana progresifitas hakim dalam menetapkan beban akibat perceraian bagi suami terhadap istri yang diceraikan. Tulisan ini bersifat literer yang bersumber dari Direktori Putusan Mahkamah Agung pada Tingkat Pertama, Tingkat banding, dan Tingkat Kasasi. Tulisan ini akan menguraikan tentang bagaimana hakim pada badan Peradilan Agama khususnya Mahkamah Agung dalam melakukan upaya melindungi hak-hak perempuan pasca perceraian. Tulisan ini akan menganalisa tentang putusan hakim yang membebankan suami untuk  memenuhi kewajiban kepada istri berupa pembayaran nafkah iddah, nafkah madliyyah, dan mut’ah. Like other disciplines, which also try to approach the sacred text with their own reasoning and specialization. During widespread disagreements over various interpretations of a text, the maqashid sharia reasoning approach as one of ijtihad reasoning, has a very urgent position, of course, to reason problems in a unique way. There is no longer a sanction, that by continuing to turn on maqashid reasoning, as one of the important tools in legal formulation, it is a necessity that every juris (mujtahid) must have. By using several main sources on the science of maqashid sharia, this paper tries to present a maqashid perspective across generations, from the classical era to the modern era. Since the era of al Hakim Tirmidhi to Jaser Audah and other contemporary scholars who continue to spread the knowledge of maqashid. The various cases that occurred and covered the life of the mukallaf (legal subject), from the early days of Islam to the present and future generations, became an important orientation in every legal formula that must be presented. This is nothing but to make Shari'a an entity that continues to live across ages. The benefit of the mukallaf, which is an important point in the descent of the Shari'a, must always be a consideration in every legal formulation.\u0000 \u0000Penelitian ini merupakan sebuah upaya untuk menbedah diskursus maqashid syariah, sebagai salah satu pisau analisis (tools of analysis) terhadap teks atau sumber hukum Islam. Sebagaimana disiplin ilmu yang lain, yang juga mencoba mendekati teks suci dengan nalar dan spesialisasinya masing-masing. Di tengah maraknya silang pendapat akan berbagai interpretasi suatu nas, pendekatan nalar maqashid syariah sebagai salah satu nalar ijtihad, memiliki posisi yang sangat urgen, tentunya untuk menalar problematika dengan caranya yang khas. Tidak sanksi lagi, bahwa dengan terus menghidupkan nalar maqashid, sebagai salah satu piranti penting dalam formulasi hukum, menjadi keniscayaan yang harus dimiliki oleh setiap juris (mujtahid). Dengan menggunakan beberapa sumber pokok tentang ilmu maqashid syariah, makalah ini mencoba untuk menghadirkan perspektif maqashid lintas generasi, sejak era klasik sampai era modern. Sejak era al Hakim Tirmidzi sampai Jaser Audah dan ulama kontemporer lain yang terus mengibarkan ilmu maqashid. Sidik","doi":"10.22515/alahkam.v6i1.3993","DOIUrl":"https://doi.org/10.22515/alahkam.v6i1.3993","url":null,"abstract":"The discourse of mass organization dismissal of Hizbut Tahrir Indonesia (HTI) by the government through the Government Regulation in Lieu of Law No. 2/2017 (Perppu), that now has been officially being the mass organization regulation, causes pro and contra.This article analyses the substance of the differencies of HTI, NU, and Muhammadiyah opinion about violant attack (makar) and Perppu as its rule to protect it. It also analyses the rationale and reason of their opinion. This article finds two points: First, HTI noted that their activities were not a violant attack but the religious proselytizing (dakwah) so that the dimissal act through Perppu, according to them, was not appropriate. Meanwhile, NU said that HTI activities were a violant attack and they supported itsdismissal through Perppu. Whereas Muhammadiyah argued that the contradiction toward national idology is a violant attack but it dimissal has to be constitutional. Second, based on the social dialectic theory, this article notes that the differencies of these mass organization opinion were influenced by their different conception on nation that internalized when they looked at the problem of violant attack and Perppu. According to the political identity theory, each mass organization brings religious knowledge identity that fitted together, especially concerning Perppu.\u0000 \u0000Diskursus terkait penonaktifan organisasi massa (ormas) Hizbut Tahrir Indonesia (HTI) oleh pemerintah melalui Peraturan Pemerintah Pengganti Undang-Undang No. 2 tahun 2017 (Perppu Ormas), yang kemudian disahkan menjadi UU Ormas, memunculkan pro-kontra. Artikel ini mengkaji bagaimana substansi perbedaan pandangan HTI, Nahdhatul Ulama (NU), dan Muhammadiyah (MU) tentang makar dan Perppu sebagai payung hukum pencegahannya. Lantas, apa sebenarnya yang melandasi perbedaan pandangan tersebut. Kajian ini menemukan beberapa hal. Pertama, HTI berpandangan bahwa aktivitas mereka bukan makar melainkan aktivitas dakwah sehingga pembubarannya melalui Perppu dinilai tidak beralasan. Sementara NU memandang aktivitas HTI adalah makar dan mendukung pembubarannya melalui Perppu. Adapun Muhammadiyah berpandangan bahwa yang bertentangan dengan ideologi negara adalah makar, tapi pencegahannya harus secara konstitusional. While it was confirmed to be WIB at around 11:40 WIB. Based on the schedule of Religion Ministry in the Republic of Indonesia, start of Zuhur time on October 20, 2019 was 11:25 WIB. There is any differences 15 minutes from it of Indonesia with the Zuhur prayer time schedule in the Tegalsari Mosque. Futhermore, the old Istiwa’ clock is organizer of Tegalsari Mosque every day. This thesis aims to find out the analysis of the use, calculation and accuracy of the bencet clock in Tegalsari Mosque at Jajar Village, Laweyan Subdistrict, Surakarta City with analyzing the accuracy by using Accurate Times Software and Muslim ProApplications. The kind research is qualitative in the form of field research for proving the data in the field. The object of this research are the use, calculation and accuracy of the bencet clock in Tegalsari Mosque by observation, interviews and documentation. Data sources in this research are primary data sources and secondary data sources, including Acccurate Times software data and Muslim Pro applications. The results of research is showing that in the use and calculation of the bencet clock in Tegalsari Mosque only turn out by looking at the position of the Sun's shadow without using a formula, however the bencet clock has met the physical requirements as a horizontal sundial but it less spesific clock pointer. The accuracy of the bencet clock by using the Accurate Times software and the Muslim Pro application are accurate, but it should be noted that the accuracy of the use ihtiyath time must be consistent with 3-4 minutes. In order to increase the accuracy of the bencet clock.\u0000 \u0000Jam bencet di Masjid Tegalsari ini terindikasi tidak akurat, karena pada tanggal 20 Oktober 2019 ada penambahan kehati-hatian jam bencet dari 12.04 menjadi 12.20 WIS (waktu ihtiyath lebih dari 4 menit). Sedangkan dikonfirmasikan menjadi WIB sekitar pukul 11.40 WIB. Padahal dalam jadwal Kementerian Agama Republik Indonesia, awal waktu Zuhur pada tanggal 20 Oktober 2019 yaitu 11.25 WIB. Terdapat selisih 15 menit dari jadwal yang dibuat Kementerian Agama Republik Indonesia dengan jadwal waktu salat Zuhur di Masjid Tegalsari. Muhammadiyah and Nahdlatul Ulama are two largest Islamic community organizations in this country, so the way on managing the society is always interesting to study, including FIQH (ISLAMIC JURISPRUDENCE) of coping the disaster.\u0000Based on the reasons above, the backgrounds of the study are how do muhammadiyah and nahdhatul ulama apply their fiqh (islamic jurisprudence) to cope with disaster? and why do they apply their fiqh?\u0000This study is library research using qualitative design and comparing between the two fiqhs from both Muhammadiyah and Nahdatul ulama. The researcher applies Philosophical approaches, through the term epistemilogi bayani, burhani dan irfani as instruments to clarify the content of both fiqhs to find the answer for both research problems above.\u0000The findings are the guideline and methodhology used both Muhammadiyah and Nahdatul ulama covered in both fiqhs; there are several differences on the Basic conceptions related to beliefs and Aqida; ethical and moral formulations and practical things.\u0000Muhammadiyah Fiqh explained in details regarding with practical procedures and steps of worship in coping with disaster, while Nahdlatul Ulama Fiqh explained only practical guidelines in coping with disaster.\u0000The other finding is related to the triple epistimology. The point of bayani on both fiqhs are relatively similar, same level and size. The point of burhani on Muhammadiyah fiqh gave deeper understanding than Nahdlatul Ulama fiqh. And the point of irfani neither muhammadiyah nor Nahdlatul Ulama seem to use it. The hadith صَفْقَتَيْنِ فِي صَفْقَةٍ cannot be understood through textual because the purpose of this hadith is explained in another hadith. One of the prohibited buying and selling regarding this hadith is the difference between the purchase price of cash and credit. For example, buying and selling socks at 2 prices, ten thousand rupiah in cash or fifteen thousand rupiah in credit. The buyer has received the goods but there is no certainty whether the cash agreement or credit agreement. This is forbidden because it contains gharar (uncertainty, in this case the method of payment). Gharar / taghrir is forbidden in Islam because it causes one party to suffer a loss while the other party gets benefits, so that the purpose of buying and selling is the same willing between the seller and the buyer is not achieved. Kafa’ah etik-religius bersifat mutlak, permanen dan universal dimana berlakunya  tidak terbatas pada ruang dan waktu. Sementara kafa’ah pada dimensi status sosial dan material bersifat relatif dan lokal. Kafa’ah berupa status sosial tidak memiliki dasar yang jelas dari al-Qur’an maupun sunnah Nabi SAW dan bertentangan dengan ajaran Islam yang memandang bahwa derajat seseorang tidak ditentukan dengan status sosial tetapi dengan aspek ketakwaannya. Dalam hal ini, status sosial sebagai kriteria  kafa’ah dalam penikahan dipengaruhi kefanatikan kultur budaya Arab yang berkembang pada waktu Islam di Arab. Begitu pula ulama ketika menformulasikan  kriteria kafa’ah dalam penikahan tidak lepas dari pengaruh kultur Arab. Karena itu, kafa’ah ini jelas bersifat fanatik kearaban yang bersifat temporal dan lokalitas yang tidak mungkin bisa diimplementasikan secara totalitas yang dibatasi  ruang dan waktu. By using mixed-methods within analysis descriptive legal qualitative: a case study and empiric legal method, The findings showed that the judge's decision regarding the rights of women were concluded as follows; 1) the contested or talaq/ divorce cases by verdict judgment could assign or guarantee legally the women rights after divorcing such as Mut'ah, child custody, property rights if not being the charge materials in which judges presumption should not decide the case on the outside of the charge materials (ultra-petition) as long as the judges had legal standing to do so. 2) The judges of Religious and District Court in Purwokerto had the ex officio rights in determining the wife’s rights whether requested or not. The judges were just in case of the cause of divorce where the husband and wife were not willing to be divorced. So, the judges utilized their ex officio rights to punish the husbands for providing Mut'ah according to their ability and feasibility. In that act, every micro-finance institution that operating its business must choose between a cooperative or limited liability company (PT) as a legal entity. According to the act on cooperative and act on the micro-finance institution, Sharia cooperative can be supervised by Finance Service Authority (OJK) or cooperative and micro-medium enterprise service. This dualism makes differences in how to determine controlling institutions for sharia cooperative. One of the contributing factors is the differences in controlling regulation between act on cooperative and act on the micro-finance institution. The result of this research shows that there are differences in controlling between act on cooperative and act on the micro-finance institution. The way of controlling, according to act on cooperative emphasizes principles to give autonomy, independency, and leniency to a cooperative.
