Benyaich","doi":"10.1016/j.etiqe.2024.08.002","DOIUrl":"10.1016/j.etiqe.2024.08.002","url":null,"abstract":"<div><div>L’avènement de la transplantation d’organes en tant que révolution médicale a suscité une profonde réflexion, imprégnée d’une dimension morale et religieuse quant à sa compatibilité avec les diverses traditions spirituelles. Ce progrès médical a engendré un débat significatif parmi les oulémas, les éminents juristes islamiques, à la fois dans chaque pays musulman et au sein des institutions inter-islamiques. Animés par le devoir d’interpréter les enseignements de l’Islam face à cette nouvelle réalité médicale, ils ont entrepris une analyse rigoureuse des sources doctrinales de la religion. Et après interrogation des sources doctrinales de l’Islam, ces oulémas – ou du moins la plupart d’entre eux – ont convergé vers une conclusion unanime : le don et le prélèvement d’organes, qu’ils concernent des cadavres ou des individus vivants, sont non seulement justifiables mais également en parfaite conformité avec les principes fondamentaux de l’Islam. Cette conclusion souligne l’adaptabilité de la jurisprudence islamique face aux progrès médicaux, démontrant ainsi la capacité de la religion à évoluer tout en préservant ses valeurs essentielles.</div></div><div><div>The emergence of organ transplantation as a medical revolution has sparked profound reflection, imbued with moral and religious considerations regarding its compatibility with various spiritual traditions. This medical advancement has engendered significant debate among the ulema, the eminent Islamic jurists, both within each Muslim country and among inter-Islamic institutions. Driven by the duty to interpret Islamic teachings in light of this new medical reality, they have undertaken a rigorous analysis of the religion's doctrinal sources. And after scrutinizing the doctrinal sources of Islam, these ulema – or at least most of them – have converged on a unanimous conclusion: organ donation and transplantation, whether involving corpses or living individuals, are not only justifiable but also in perfect accordance with the fundamental principles of Islam. Floret","doi":"10.1016/j.etiqe.2024.12.003","DOIUrl":"10.1016/j.etiqe.2024.12.003","url":null,"abstract":"&lt;div&gt;&lt;div&gt;L’approche dite à « &lt;em&gt;double-perspective&lt;/em&gt; » (&lt;em&gt;Two-Eyed Seeing&lt;/em&gt;), originaire du Canada, postule l’égalité et la complémentarité des savoirs et modes de connaissance autochtones et occidentaux. Ce faisant, elle postule l’égalité et la complémentarité, non seulement de la conception que les humains peuvent avoir de leurs réalités objectives, mais aussi de la réalité de leurs conceptions subjectives, puisque toute vision du monde reflète le monde qui se donne à voir tel qu’il est, en même temps qu’elle l’institue dans un processus dialectique. L’approche à double-perspective s’inscrit, à cet égard, dans une démarche décolonisatrice susceptible de contribuer à changer radicalement la manière d’appréhender le concept de santé et de faire de la recherche en santé, substituant à l’universalisme de l’objectivité et au réductionnisme de la science de tradition positiviste un universalisme de la subjectivité et une complexité riches en questionnements ontologiques, épistémologiques, et méthodologiques. La portée effective de l’approche à double-perspective dépend, toutefois, de la prise en compte de sa dimension fondamentalement éthique : en appelant à se décentrer pour s’ouvrir à la plénitude de l’altérité culturelle, elle laisse en effet aux chercheurs la responsabilité d’opérer l’indispensable travail réflexif sur eux-mêmes pour être en mesure de réparer à leur niveau les injustices historiques produites par leur profession. Une approche potentiellement fertile, dans le contexte français, pour poser les jalons de sociétés plus inclusives dans les territoires d’outre-mer ayant des populations autochtones, tels que la Nouvelle-Calédonie ou la Guyane.&lt;/div&gt;&lt;/div&gt;&lt;div&gt;&lt;div&gt;The “&lt;em&gt;Two-Eyed Seeing&lt;/em&gt;” approach, originating from Canada, postulates the equality and complementarity of Indigenous and Western knowledge and ways of knowing. In doing so, it postulates the equality and complementarity, not only of the conception that humans can have of their objective realities, but also of the reality of their subjective conceptions, since any vision of the world reflects the world which is visible as it establishes at the same time its own world in reality in a dialectical process. In this regard, the Two-Eyed Seeing approach is part of a decolonizing process likely to contribute radically to changing the way of understanding the concept of health and of carrying out health research by replacing the universalism of objectivity and the reductionism of positivist science with a universalism of subjectivity and a complexity both rich in ontological, epistemological, and methodological questionings. Pour les soulager on peut se questionner sur la place que pourrait avoir l’IA, dont les derniers progrès sont fulgurants. Face aux difficultés rencontrées, les réanimateurs seraient-ils prêts à être aidés par l’IA ? Pour répondre à cette question, nous avons effectué une étude exploratoire monocentrique, basée sur les réactions émotionnelles avec des entretiens semi-directifs, auprès de dix médecins anesthésistes-réanimateurs. Nous avons utilisé le logiciel d’analyse textuelle TROPE et la base EMOTAIX qui permet de rechercher, d’analyser et de catégoriser les émotions automatiquement, selon leur valence (positive, négative, neutre). Les résultats obtenus montrent un nombre total d’émotions positives plus important que le nombre d’émotions négatives. Identiquement pour le genre et l’âge, un nombre plus important d’émotions positives est retrouvé chez les hommes par rapport aux femmes, ainsi que chez les plus jeunes par rapport aux plus âgés. L’analyse par catégories d’émotions positives « &lt;em&gt;Sang-froid, Bienveillance, Bien-être&lt;/em&gt; » et d’émotions négatives « &lt;em&gt;Mal-être, Malveillance, Anxiété&lt;/em&gt; », retrouve le même résultat. Cette valence positive majoritaire pourrait être un facteur positif de l’acceptabilité des réanimateurs. Cette première étude pilote basée sur une approche exploratoire, nécessite d’être étayée auprès d’un nombre de professionnels beaucoup plus important pour conforter et valider nos hypothèses.&lt;/div&gt;&lt;/div&gt;&lt;div&gt;&lt;div&gt;Resolving ethical dilemmas in resuscitation imposes a significant moral burden on doctors. To help relieve them, one could question the place that Artificial Intelligence (AI) could occupy, whose latest advances are remarkable. In view of the difficulties encountered, would the resuscitators be ready to accept the help of AI? To answer this question, we conducted a monocentric exploratory study with ten resuscitators, based on emotional responses using semi-directional interviews. We used the TROPE textual analysis software and the EMOTAIX database that allows you to search, analyse and categorize emotions automatically according to their value (positive, negative, neutral). The results showed that the total number of positive emotions is greater than the number of negative emotions. Similarly, for gender and age, a greater number of positive emotions are found in men versus women, as well as in the younger population compared to the older population. Analysis by positive emotion categories such as “&lt;em&gt;Apathetic, Benevolence, Well-Being&lt;/em&gt;” and the negative emotion categories “&lt;em&gt;Unhappiness, Malevolence, Anxiety&lt;/em&gt;”, obtain the same result. This positive value majority could be a favourable factor in the acceptance of resuscitators. On ne peut pas être, stricto sensu, déshumanisé mais on peut souffrir des conséquences d’une contestation volontaire et tacite de sa dignité, et d’une déshumanisation de sa capacité à « faire relation ». Y aurait-il une intentionnalité réelle derrière ce « on », ou serait-il finalement le pronom impersonnel de celui ou celle qui laisse faire et se cherche ensuite un bourreau ? Il est de notre responsabilité citoyenne de ne pas nous laisser effrayer par les « collapsologues » qui ensuite en font raillerie pour mieux combattre leurs propres peurs, de ne pas nous tromper de risque, de demeurer des individus responsables dans une république en construction, de ne pas nous laisser enfermer en tant que soignants dans une clinique simpliste… mais de plaider pour garder celle-ci ouverte à la complexité. Sept propositions ont été élaborées en ce sens. Notre alliance avec les nouvelles technologies n’en sera sans doute que moins problématique.</div></div><div><div>The deployment of AI in healthcare can generate a number of fears related to three areas: fears of the great replacement, the great downgrading, and the great deceit. One cannot be dehumanized in the strictest sense, but one can suffer the consequences of a voluntary and tacit contestation of their dignity and a dehumanization of their ability to ``build relationships''. Is there a real intentionality behind this ``one'' or is it ultimately the impersonal pronoun of those who let things happen and then look for a scapegoat? It is our civic responsibility not to let ourselves be frightened by ``collapsologists'' who then mock these fears to better combat their own, not to misidentify the risks, to remain responsible individuals in a republic under construction, and not to allow ourselves as caregivers to be confined to a simplistic clinic… but to advocate for keeping it open to complexity. Seven proposals have been developed in this regard. Le choix de leur usage et l’appréhension de leur impact peuvent être délicats pour les responsables de structure. Ceux-ci engagent l’investissement des professionnels et d’importants moyens financiers dans des outils sensés assurer bien-être et protection des personnes accueillies. L’exemple d’une téléalarme nouvelle génération, utilisant l’analyse de l’environnement sonore des résidents en EHPAD, illustre bien ces questionnements. Entre souhait de préservation de l’autonomie des personnes accompagnées et besoin d’assistance et de protection efficace ; entre recherche d’un outil facilitateur du travail soignant et intrusion dans l’intimité des personnes ; entre alertes pertinentes et gestion de la surinformation : ces dilemmes seront à appréhender par les équipes qui utilisent cette technologie. L’influence de son usage, tant sur les pratiques soignantes que sur le bien-être des personnes, est difficile à évaluer. Il ne serait pas juste de priver des personnes vulnérables de l’accès aux nouvelles technologies sous couvert de principe de précaution. Cependant, il faut garder une certaine vigilance quant au suivi des outils et des pratiques qui vont en découler. Et ne surtout pas oublier que c’est au bénéficiaire qu’il doit profiter tant pour la préservation de sa liberté, de son autonomie que pour sa protection.&lt;/div&gt;&lt;/div&gt;&lt;div&gt;&lt;div&gt;Nursing homes are frequently approached by companies developing innovative technologies, collecting digital data and using artificial intelligence. Choosing how to use these technologies and understanding their impact can be tricky for facility managers. They involve the investment of professionals and considerable financial resources in tools designed to ensure the well-being and protection of the people they care for. The example of a new-generation remote alarm, based on analysis of the sound environment of Nursing homes’ residents, provides a good illustration of these issues. Between the desire to preserve the autonomy of those being cared for and the need for effective assistance and protection; between the search for a tool that facilitates care work and intrusion into people's privacy; between relevant alerts and management of information overload: these are the dilemmas that teams using this technology will have to grapple with. The influence of its use, both on care practices and on people's well-being, is difficult to assess. It would be unfair to deprive vulnerable people of access to new technologies under the guise of the precautionary principle. However, we need to remain vigilant when it comes to monitoring the tools and practices that will result from them. Les espaces de réflexion éthique régionaux se sont saisis de cette problématique éthique depuis de nombreuses années dans leurs missions de débat public, de formation, d’information, de recherche ou d’observatoire des pratiques. Ont ainsi émergé des alertes quant au risque de déshumanisation, d’inégalités d’accès et inégalités d’usage pour les patients dans le cadre de la santé connectée/e-santé (illectronisme, etc.), de sécurité des données et d’information insuffisante. Le public et les professionnels s’inquiètent des conséquences sur le lien humain dans la relation soignant–soigné et posent également les questions de la responsabilité et de la formation.</div></div><div><div>The healthcare sector is particularly concerned by the rapid and exponential development of artificial intelligence systems. The Espaces de Réflexion Éthique Régionaux have been addressing this ethical issue for many years in their missions of public debate, training, information, research and observatory of practices. Alarms have been raised about the risk of dehumanization, unequal access, data security and inadequate information. Si cette règle est simple à énoncer, sa mise en place est dans la pratique plus complexe. Le concept de « <em>fonction apostolique</em> », élaboré par M. Balint, offre au soignant un outil utilisable à cette fin. Après avoir précisé le contenu de ce concept, l’objectif de cet article est de montrer comment un travail sur sa « <em>fonction apostolique</em> » est pour le soignant une façon de cultiver au quotidien un doute positif, de penser sa pratique et d’agir sur elle. En ce sens, il constitue un apport essentiel dans le champ de l’éthique médicale pour la prise en compte du patient en tant que sujet.</div></div><div><div>For the healthcare professional, one of the fundamental bases of ethical positioning in the relationship with his patients consists in questioning his own values, his preconceptions, his convictions and his representations in that they may be opposed to those of the patient. While this rule is simple to state, its implementation is more complex in practice. By elaborating the concept of “<em>apostolic function</em>”, Mr. Balint offers the caregiver a tool that allows him to become aware of the place that his values, preconceptions, convictions and representations occupy in the act of care. After clarifying the content of this concept, the objective of this article is to show how working on one's “<em>apostolic function</em>” is, for the caregiver, a way of cultivating positive doubt on a daily basis, of thinking about his practice and acting on it.
