Faz-se isto tendo em conta o art. 82, §2º, LSA, como exemplo. No passado, isto foi realizado a partir de outras normas vagas relacionadas à CVM. Discussões sobre os limites dos poderes da CVM são antigas, mas vale a pena renová-las por conta dos desafios constantes que surgem no mercado de capitais. Apenas recentemente, foi editada a Lei do Ambiente de Negócios a qual, entre outras coisas, alterou dispositivos da Lei das Sociedades por Ações. Não é dado à CVM criar, modificar ou extinguir o direito. A CVM deve executar normas de ordem pública para cumprir os deveres que foram impostos contra ela. Mesmo assim, na prática, parece ser pouco provável que esta tese será aceita. A ideia de que poder legiferante poderia ser delegado de qualquer modo ou de que a CVM teria poder para preencher lacunas em normas legais parece ter, infelizmente, se consolidado. Entretanto, convém explorar o tema das lacunas e das competências da CVM. Debates sobre os deveres da CVM devem continuar a ocorrer.\u0000PALAVRAS-CHAVE: Direito dos valores mobiliários. {"title":"What About The Fourth World \"Self\"?","authors":"Natália Medina Araújo, Tatiana Cardoso Squeff, Bianca Guimarães Silva","doi":"10.22456/2317-8558.128819","DOIUrl":"https://doi.org/10.22456/2317-8558.128819","url":null,"abstract":"This paper aims at engaging with Baxi’s article “The Dust of Empire: the Dialectic of Self-Determination and Re-colonization in the First Phase of the Cold War” by arguing that self-determination, as defined during the Cold War, does not include indigenous peoples Cosmovision. Considering that Amerindians were not part of the economic pattern imposed to the Third World during that period, the “self” in the eurocentric lens of self-determination excludes indigenous peoples’ selves and condemns them to being silenced, excluded, or extinct, that is, permanent victims of epistemicide. This paper uses a deductive method based on a bibliographic analysis to discuss the topic through perspectivism, as well as the Fourth-World Approaches to International Law (FWAIL). On the one hand, perspectivism emphasizes the spiritual relationship between indigenous people and nature, which is part of the amerindian cosmovision. FWAIL scholars, on the other hand, argue that international law fails to recognize indigenous peoples’ true collective selves, perpetuating the denial of their rights through the appropriation of their resources, territory and bodies. In this sense, through a critical analysis, it is advanced that such universal view put forward by global north during the Cold War is not only incapable of dealing with the cultural differences that self-determination, seen through the Amerindian cosmovision, implies, but also the reason why they are recurring victims of violations of rights. ILO convention no. 107, the Brazilian legal framework and the country’s recurring excluding actions are examples of it. Removing the geopolitical conflict from the centrality of historiographic analysis, the present article aims to understand the operation of international law in the Cold War through Latin American regional dynamics. Through the reading of the articles on “collective security” published in some international law journals during the period of the Cold War (American Journal of International Law and the Mexican Foro Internacional), this article recounts the history of the jurisdictional conflict between regional and universal organizations. It demonstrates that the history of collective security in the hemisphere begins as experiment in formalization of the long and distinct American tradition in international law. The defense of this tradition served as a basis to formalize or legalize the projection of US power in the Americas. Latin Americans responded to this push first by endorsing the creation of a regional organization and a collective security arrangement, later by using law as a strategy to advance their position. However, as collective security increasingly became a justification for violations of the UN Charter, solidarity among American republics faded and cooperation, despite a regional treaty, became virtually impossible. The regional agreement thus proved to be both an enabler and an obstacle for this strategy. Thus, we conclude that the history of the International Law in Latin American during the Cold War was also the history of the demise of American International Law. \u0000KEYWORDS: Cold War. The historical experience is often summarized with the assertion that “the Cold War period saw a decline in the commitment to international adjudication”. An examination of the judicial practice in the period is carried out, namely arbitration and decisions of the International Court of Justice (ICJ). We shall also briefly scrutinize the appearance of jurisdictional clauses in international treaties signed between 1947 and 1990. The second part of the article presents a specific instance of judicial settlement of disputes, outlining the American Treaty for the Peaceful Settlement of Disputes and the fundamental choices of the “Pact of Bogota” in relation to judicial settlement. In the third part, we zoom in on some ideas regarding international adjudication in Latin America and on the writings of some Brazilian authors – such as Haroldo Valladão – to demonstrate their perception of the phenomenon. The present analysis proves that the judicial settlement of international disputes did not depend on the collapse of the Soviet Union for coming into operation. Interstate arbitrations were very much present during the Cold War years. Jurisdictional clauses remained in vogue, a great number of treaties still being adopted that referred their disputes to the International Court of Justice. The purpose of this paper is to engage with the proposal of the editors and reflect upon the issues arising from the traditional portray of the “Cold War”, although offering what could be a fourth perspective on the subject: that of the establishment of “development” as an argumentative pattern in international law. In a dialog with another recent work with special relevance to the history of International Law – Ntina Tzouvala’s “Capitalism as Civilisation” – we revisit some of the essays presented in the book to illustrate the thesis that an attention to the uses of the concept of “development” can be central to an account of this period that goes beyond the East-West feud, leaving a profound legacy in contemporary accounts of Law. By shedding light on perspectives once overlooked, the book shows how the Cold War can be analyzed as a moment of prolific development of standards of domination. The struggle for the Global South was much more than a dispute for military sway or political influence through international institutions, it also encompassed a refined project of creating concepts and a new perspective in international law that permitted the consolidation of political asymmetry through juridical institutions. \u0000KEYWORDS: Cold War. Para tanto, busca-se encontrar o nexo entre a colonização e as sujeições interseccionais atuais no mercado de trabalho da cidade enfrentadas pelas mulheres, tendo em vista as discriminações provenientes da colonialidade do poder e de gênero. A hipótese de pesquisa gira em torno da questão relativa à violação ao princípio da dignidade da pessoa humana, da liberdade sexual, da igualdade, do bem-estar e da própria justiça. Tem-se por objetivo a verificação da vulnerabilidade dos integrantes da comunidade LGBTQ+ frente ao tradicional sistema jurídico brasileiro, bem como analisar a ausência de efetiva reação estatal às injustas agressões praticadas contra grupos sociais vulneráveis. O método de abordagem será o dialético-dedutivo, bem como o empírico, adotando-se como procedimento o bibliográfico.
