We argue that social deviance is not equipped with adequate analytic devices to satisfactorily describe social actions labelled as transgressions. This discussion reconsiders the notion of social deviance, recasting its theoretical significance and use in the field of criminology. In its place, we advance the category of social divergence, highlighting its greater analytical power to address social actions that trigger penal control interventions. Social divergence is a novel conceptual contribution in the tradition of the sociology of conflict. Its purpose is to offer an analytical model of social conflicts and their inner workings as key elements to describe, analyze and improve our understanding of their interactions with penal control systems from a criminological perspective.\u0000Este artículo expone una discusión crítica de la noción de desviación social, un concepto que ha sido pilar de la teoría criminológica y sociológica desde mediados del siglo XX. Sostenemos que la desviación social no está adecuadamente provista como dispositivo analítico para describir satisfactoriamente las acciones sociales que se etiquetan como transgresiones. La discusión reconsidera los alcances de la noción de desviación social, reformulando su significado teórico y su uso en el campo de la criminología. En su lugar, proponemos la categoría de divergencia social, destacando su mayor potencia analítica para abordar las acciones sociales que desencadenan intervenciones de control penal. La divergencia social es una contribución conceptual novedosa en la tradición de la sociología del conflicto. The debate on second modernity and global risk society undoubtedly offers effective keys for the sociological analysis of the pandemic. The essay, also in the light of some data on the spread of contagion and deaths due to COVID-19, with reference to specific contexts such as Brazil and the United States of America, offers a critical reading of the global risk society thesis starting from the post-colonial and decolonial debate. In particular, within an emancipatory social science perspective, the elements of inequality and exclusion that are operating as decisive factors for the sociological understanding of the pandemic phenomenon are brought into focus. To this end, reflections on the forms of inequality at the level of the modern world-economy, on the permanence of structures of hegemony and subalternity based on the “coloniality of power” and on the action of forms of “colonial sociability” and “territorial stigmatization” offer a fertile ground of debate for the analysis and understanding of the unequal consequences of the pandemic and the struggles for right to health.\u0000Este artículo profundiza en el derecho a la salud durante la pandemia de COVID-19, analizando su impacto en términos de desigualdades sociales. La primera sección introduce conceptos extraídos del enfoque de la sociedad de riesgo global, señalando algunas de sus limitaciones para un análisis efectivo de las formas de exclusión social durante la pandemia. La principal afirmación es que la lógica de las desigualdades surgidas en la pandemia de COVID-19 puede ser interpretada más eficazmente a la luz de la sociología poscolonial y decolonial, con referencia a los conceptos de colonialidad del poder (Quijano) y, concretamente, de sociabilidad colonial (Santos). El camino propuesto es poner en diálogo dichos conceptos junto con los de marginalidad avanzada y estigmatización territorial (Wacquant). This article investigates two mechanisms of judicial review in the case law of the ECtHR, French Constitutional Council and Council of State. The first mechanism is the review of the existence of the circumstances justifying the exceptional powers and restrictions on human rights. The second is the misuse of power or détournement de pouvoir doctrine. The article argues that both these elements of judicial review are under exploited while presenting the advantage of being readily available – therefore requiring no judicial creation – and offering strong bases to curb abuses of emergency powers. Examined at two different levels, national and regional, these two lines of reasoning, if deployed appropriately, might inspire further jurisdictions faced with similar emergency challenges.\u0000A medida que los estados de excepción se están volviendo cada vez más frecuentes, los tribunales ya no pueden confiar en enfoques deferentes basados en el supuesto de que las situaciones de excepción son excepcionales y temporales. The paper presents the case-study of such a classification as a deterministic model of evaluation and assessment of legal research. This may impact on career opportunities of individuals as well as on scientific independence, tacitly predefining the selection of research topics and legal methodology. The paper argues that ERC encourages a successful trend of conducting legal research to obtain funding, through the application of indicators. Their aim is to show which process has been followed to achieve and measure results. Legal science then risks being reduced to the analysis of legal performance. In this context, re-reading some writings of Polanyi on social sciences as well as on the critique of economic determinism sheds light on forms of academic determinism that affect the way of carrying-out research.\u0000El sistema de financiación del Consejo Europeo de Investigación (CEI) clasifica el Derecho dentro del sector de las ciencias sociales y las humanidades, e identifica la ciencia jurídica como una ciencia social. Este artículo presenta el caso práctico de dicha clasificación como modelo determinista de evaluación y valoración de la investigación jurídica, lo cual puede repercutir en las oportunidades profesionales de las personas, así como en la independencia científica, al predefinir tácitamente la selección de los temas de investigación y la metodología jurídica. El artículo sostiene que el CEI fomenta una tendencia de éxito en la realización de investigaciones jurídicas para obtener financiación, mediante la aplicación de indicadores. This set of offences (ss. 4, 4A and 5 of the Public Order Act 1986) was aimed to address any behaviour or expressive activities, either oral or written, carried out in a context of physical proximity to the victim. In principle, the foundational base of public order offences runs the risk of becoming blurred if we extend their applicability to hateful messages online and, therefore, to any impersonal way of acting. Consequently, only 13% and 14% of the hate crimes committed online in 2016/17 and 2017/18 in England & Wales involved public order offences. Therefore, there is a certain resistance based on the adequacy of these offences to the online environment without requiring the message to be audible or visible to someone, as a matter of immediacy/proximity. The criminal framework encompasses Sections 312-318 IPC, provisions of the POCSO Act, and the PCPNDT Act, which prescribe significant state surveillance and allow for largely unchecked intimidation by law enforcement of both abortion providers and abortion seekers. Several case laws show the “chilling effect” of criminalization on healthcare providers, leading them to hesitate to provide safe abortion services. The stigma around abortions perpetuated by criminalization, leaves pregnant persons with limited reproductive choices – these include either availing of safe abortions and risking prosecution, availing of unsafe abortions and risking adverse health outcomes, or carrying unwanted pregnancies to term and avoiding prenatal and maternal healthcare. Criminalization disproportionately affects marginalized communities, with examples of legal reform showing carceral approaches' disregard for structural factors affecting certain groups' access to fundamental rights and healthcare services. It is, therefore, imperative to decriminalize abortion completely, framing avenues for redressal within a reproductive justice framework. The proposal to completely abolish penal provisions that govern forced abortions begets concerns about leaving marginalized pregnant persons who frequently experience forced abortions with no legal recourse. This feminist dilemma that ensues requires the adoption of decarceral, intersectional approaches that maintain structures of accountability for harm done, without posing any risk to the rights of marginalized pregnant persons.\u0000El marco jurídico que rige el aborto en India es fundamentalmente una estructura cis-heteropatriarcal, que utiliza un sistema de justicia penal punitivo para controlar los cuerpos de las personas embarazadas. To arrive at this argument, the article deploys a case study of the experience of the Peace Community of San José de Apartadó in Colombia: a campesino community that, in the context of institutionalised impunity for the atrocities committed against its members, broke off relations with Colombia’s justice system. By reflecting upon opposing narratives surrounding this rupture, the article seeks to better understand the survivors’ perspective in a context where narratives of the historically marginalised tend to be occluded by legalistic rationalities that normalise the crimes of the powerful. In so doing, however, the article seeks not to merely give a voice to subjugated knowledges but to mount a challenge to the capacity of legality (as embodied in TJ) in bringing about changes that can adequately address histories of violence. On the contrary, to address such dynamics, the article argues, we need to address the crimes of the powerful in their continuity with a colonial social order, wherein the dehumanisation of colonial subjects serves to rationalise the plunder of their territories.\u0000Este artículo sugiere que la impunidad de los crímenes de los poderosos en el Sur Global es consecuencia de la continuidad del crimen de estado colonial. Para llegar tal conclusión, el texto describe narrativas que han marcado la ruptura de la Comunidad de Paz de Apartadó con el sistema de justicia colombiano.
