They first highlight the interest in addressing the intersection between the process of democratisation and the process of transnationalisation of families. These two processes are refracted in family law. They find their origin in the same refusal of a substantial moral definition of the “good family”. However, all normative perspective is not abandoned. A new normative and effective relationship is established between interactions and institutions. The new regulation of the family gives an important place to interactions and their immanent normativity. Legal principles (human rights, procedural standards) give expression to this mutation. Institutions are no longer given before the interaction, but rather constitute instruments for repairing the interactional order. This trend in the evolution of the law is particularly visible in the two cases treated in the issue: homosexual marriage and international child abduction. The close analysis of these two situations, however, suggests the persistence of obstacles to these transformations, due to the persistence of the principle of national sovereignty. \u0000En esta introducción, los autores presentan la ambición que guió la composición de esta edición dedicada al derecho de familia. En primer lugar, destacan el interés por abordar la intersección entre el proceso de democratización a y el proceso de transnacionalización de las familias. Legal professionals working in criminal courts have adopted a “punitive paternalism” when dealing with these cases that presented plea bargaining, even in cases based on planted evidence, as helping defendants to change their life habits. The article argues that both the “war on drugs” and the “punitive paternalism” are rooted in the neoliberal policies imposed on the Philippines for decades responsible for reproducing gross income inequality and promoting a narrative blaming individuals for their own economic marginalisation. The analysis shows that the deployment of coercive strategies, such as the “war on drugs”, is still dependant on building consent, in the Gramscian sense. The article shows legal professionals’ contribution to the constitution of a hegemonic order in a context of widespread state-sponsored violence.\u0000La “guerra contra las drogas” en Filipinas se ha cobrado la vida de miles de personas y ha resultado en la detención de cientos de miles de consumidores de drogas. Los profesionales del derecho que trabajan en tribunales penales han adoptado un “paternalismo punitivo” al abordar estos casos en los que la negociación de culpabilidad, incluso en casos basados en pruebas plantadas, se presentaba como una ayuda a los acusados para cambiar sus hábitos de vida. While some of the contributions examined this relationship through the symbolic power of the law, others focused on how violence is embedded into the relationship between law and politics. The first group, which focused on the symbolic dimension of power relations, dug into struggles to either accommodate political projects into the existing law or whenever such interpretation was not possible, to propose new legislation consistent with those political goals. Meanwhile, the other group of contributions, those who paid special attention to the association between law and violence, described how the relationship between politics and law is centred disputed legitimacy of law in those societies. This introduction discusses how these two approaches complement each other and offer us a better understanding of the particular role law plays in societies in the Global South.\u0000Los artículos reunidos en este número especial exploran la relación entre política y la ley en el contexto del Sur Global. Originally deployed to investigate a criminal organization using a network of gas stations and car wash companies to “clean” illicit resources, the CWO was rapidly transformed in a major law enforcement operation, and it was used to unravel endemic corruption found in private and state-owned companies. Using a variety of communication resources, the Prosecutor office in charge of the operation developed a set of strategic tactics to promote the discourse that the rule of presumption of innocence was one of the main motives behind the high levels of corruption and impunity in Brazil. This narrative influenced the Brazilian Supreme Federal Court during the judgment of the case involving Brazilian former president Luiz Inácio Lula da Silva. The social pressure caused by the use of strategic communication tools were crucial to lead the court to overrule the meaning of presumption of innocence. The paper examines how these tools were able to promote social traction and how they can be used to influence and shape the meaning and effectiveness of legal rules.\u0000Utilizamos una perspectiva socio-jurídica para analizar críticamente cómo las narrativas que respaldan la necesidad de reducir y castigar la corrupción en Brasil, especialmente las desplegadas en el curso de la “Operação Lava Jato” (LJ – Operación Autolavado), influyeron en el debilitamiento de la presunción de inocencia. {"title":"Citizenship and housing cultures after COVID-19","authors":"Marina Ciampi, Tito Marci","doi":"10.35295/osls.iisl.1743","DOIUrl":"https://doi.org/10.35295/osls.iisl.1743","url":null,"abstract":"Citizenship appears to us as an incessant constituent process, as a dynamic that is never stabilised, as a continuous development of struggles, conflicts, tensions, relationships, contestations and negotiations between social groups and rulers, between subordinate movements and hegemonic institutions. On this level, we can already understand the city (both conceptually and practically) as a political space that crosses bodies, arranging, placing and dislocating them in a series of interactions and relations that configure sociality and power. It is from these interactions that a process of subjectification (valorisation and qualification) and social de-subjectification is initiated: a process that finds in the urban fabric the prerequisites for political realisation (individual and collective) and for the social recognition of human beings. Beyond the many aspects that accompany this discourse, what we are most interested in emphasising here is the relationship between the idea of citizenship, the exercise of political rights and the cultures of living, which after the state of emergency linked to COVID-19 has redesigned an idea of public health as a form on which to redefine social relations.\u0000El carácter de ciudadano se nos presenta como un proceso constituyente incesante, como una dinámica que nunca se estabiliza, como un desarrollo continuo de luchas, conflictos, tensiones, relaciones, impugnaciones y negociaciones entre grupos sociales y gobernantes, entre movimientos subalternos e instituciones hegemónicas. En este nivel, ya podemos entender la ciudad (tanto conceptual como prácticamente) como un espacio político que atraviesa los cuerpos, disponiéndolos, colocándolos y dislocándolos en una serie de interacciones y relaciones que configuran la socialidad y el poder. Es a partir de estas interacciones que se inicia un proceso de subjetivación (valorización y cualificación) y des-subjetivación social: un proceso que encuentra en el tejido urbano los prerrequisitos para la realización política (individual y colectiva) y para el reconocimiento social de los seres humanos. However, a sector of criminal doctrine is adopting a strict approach to this theory to justify socio-legally the application of corporate criminal liability (this is a trend that has been embraced by the Spanish Supreme Court and is spreading throughout Latin America). The systemic idea of organization excludes the individuals who constitute and manage the company, dehumanizing it, separating corporate governance from the role played by individuals and even attributing human attributes to the company. In other words, the members that make up the organization, as well as the influences or constraints they generate in the context of the interaction of individuals within a corporation, are disregarded in the analysis. As an alternative, this text proposes the essential outlines of an \"anthropic model\" of corporate criminal liability, which is built on theoretically and experimentally validated notions and methodologies: neo-institutionalism, game theory and behavioral compliance. In this anthropic model, the adoption and implementation of an effective and adequate governance system to prevent irregularities (or crimes) does not depend on the system itself, but depends directly on the commitment and implementation of the \"human component\" of the organization.\u0000La teoría de sistemas ha recibido críticas significativas por parte de expertos internacionalmente reconocidos en el campo del análisis de las organizaciones. Sin embargo, cierto sector de la doctrina penal está adoptando un enfoque estricto de esta teoría para justificar sociojurídicamente la aplicación de la responsabilidad penal de las empresas (una tendencia que ha sido aceptada por el Tribunal Supremo español y se está extendiendo por América Latina). La idea sistémica de la organización excluye del análisis a los individuos que constituyen y gestionan la empresa, deshumanizándola, separando la gobernanza corporativa del papel desempeñado por los individuos e incluso atribuyendo atributos humanos a la empresa. En otras palabras, se desestiman en el análisis penal tanto a los miembros que conforman la organización como a las influencias o constricciones que originan en ese contexto de interacción de individuos que configura la corporación. Como alternativa, se proponen los lineamientos esenciales de un “modelo antrópico” de responsabilidad penal corporativa, construido sobre nociones y metodologías teórica y experimentalmente validadas: neoinstitucionalismo, teoría de juegos y “behavioral compliance”. Through a qualitative content analysis of the European Ethical Charter on the use of Artificial Intelligence in judicial systems and their environments, as well as the Brazilian Resolution n. 223/2020 of the National Council of Justice, which address the same issue, I compare the EU normative responses to the possibility of introducing algorithms to Courts to their heavily inspired Brazilian counterparts, especially highlighting the commonalities on how risk is communicated about through the documents.\u0000En un contexto en el que el debate público sobre los avances tecnológicos tiene un profundo potencial de impacto en el funcionamiento de los tribunales de justicia, tanto académicos como profesionales emplean habitualmente el concepto de riesgo, que tiene un papel destacado tanto en el discurso académico como en los intentos de regulación en esta materia.
