{"title":"A resposta correta e a liberdade política: Um diálogo entre Ronald Dworkin e Hannah Arendt em prol da hermenêutica jurídica plural","authors":"Elda r Coelho de Azevedo Bussingue, Alberto Dias de Souza","doi":"10.52028/rihj.v21.i34.art11.es","DOIUrl":"https://doi.org/10.52028/rihj.v21.i34.art11.es","url":null,"abstract":"The work seeks to analyze the possibility of correlating the idea of integrity and the correct response of a judicial decision, arising from the work of Ronald Dworkin, and the assumptions of the meaning of politics as freedom in Hannah Arendt. The research problem is the constant diversity of arguments founding judicial decisions based on specific situations, or tangents to the field of law. The hypothesis raised in this work is that legal hermeneutics, necessary for the implementation of normative contents, is also a way of ensuring the freedom of individuals, and not just a set of techniques for translating the meaning of words. Hence the viable encounter between Dworkin, with the proposal of integrity, and Arendt, with the sense of plurality essentially linked to the notion of freedom, as both take politics as a highlight of their reflections. The methodology of the work is analytical and critical, with a focus on bibliographical research. The correct answer in Dworkin overcomes the theses of bivalence and linguistic sufficiency of positivist discretion. Therefore, the idea of integrity arises, which presupposes the reception, by any judge, or the one responsible for juditial decision, of philosophical, moral and political circumstances that emerge from any specific case, as much as from the surrounding community. In this last dimension, it is possible to see freedom as a political human action par excellence, in the wake of Arendt’s thought. Specifically, the hypothesis of the article is that this trio of authors selectively recovers aspects classically associated with legal formalism – such as the distinction between legal judgments and moral judgments or the demand for the universalizability of legal decisions. This transformation is a cross-border problem whose consequences threaten all forms of life on the planet. And although its consequences are said to be democratic, reality has shown that it is the most vulnerable people, communities and countries that will experience it most intensely. Thus, it is possible to affirm that the climate emergency is also a human rights problem, hence the idea of Climate Justice. The hypothesis is that the practice of weighting principles, especially when the rule of origin is extended indiscriminately, contributes to the social phenomenon of the dogmatization of values, which undermines their purpose in the democratic context. To prove this, the work is carried out through bibliographical research, which addresses the constitutional regime of the environment, its transformation of value into social fact, the relation between coherence, non-arbitrariness and equanimity in hermeneutics. Used as an epithet for the Constitution of Brazil of 1988, the expression was coined with the intention of overcoming the dictatorial regime that it previously watched, consolidating itself in this way as a winning story. The general objective of the work is to understand the formation of this narrative, considering that the most varied groups that participated in the 1987/1988 constituent process exerted pressure on each other and on the constituent legislators, in order to approve the constitutional text that most interested them. The methodology used is rhetoric that, through a tripartite view of material, strategic and analytical, uses the dissoi-logoi, or exposition of contrary arguments, to, in the end, carry out an analysis that is intended to be equidistant. To this end, the rhetorical conception, adopted as the theoretical and methodological basis of this work, is opposed to the problem of traditional legal hermeneutics and its search for the correct answers. As a central problem, this work faces the question: is it possible to extract a single narrative from the Constitution? The research is based on a literature re-view based on the analysis of the epistemological contradiction between the current theories of legal argumentation and the theory of Law as Integrity, based on Hans-Georg Gadamer and Ronald Dworkin. We conclude that, despite this contradiction, a theory of argu-mentation is possible within Dworkin’s theory, as long as the logic of developing a previous and methodical path to reach a metaphysical truth is overcome.
