Many struggle to understand how and why the American financial and securities markets collapsed last year. In essence, why did the regulators fail to prevent the collapse? Government officials continue to analyze the relationship between the structural collapse of the markets and regulators’ limited jurisdiction over a class of entities whose transactions substantially impact the markets: hedge funds. Congress can no longer deny hedge funds’ detrimental impact on the financial and securities markets. The impetus for financial re-regulation has arrived. It is incumbent upon Congress to enact laws which extend the jurisdiction of federal regulators to hedge funds. At a minimum, such supervision is necessary to protect the investing public.The elusiveness of hedge funds and their investment strategies is of particular concern. Federal regulation may take the form of a registration requirement. Perhaps publicly-traded companies should disclose their transactions with hedge funds. More comprehensive regulatory reform options include the creation of a hybrid regulatory hedge fund governance matrix based upon the dollar volume, frequency of trades and potential losses that hedge funds may experience. Efficiency and equity issues have resulted from this tradition and the development of local police departments or shared departments across neighboring municipalities in rural and exurban areas has been discouraged. These problems will diminish in scope as municipalities receiving the State Police subsidy opt out of the program and adopt local policing. We examine this potential by estimating models of the municipal decision to use the State Police for local policing among New Jersey municipalities with less than 15,000 population. We find that the elasticities of the decision to use the State Police for local policing with respect to population and median family income to be −1.1 and −2.3, respectively. Not surprisingly, in many federal countries such as Canada and Germany, major programs transfer resources from more wealthy jurisdictions to those with relatively small tax bases or tax revenues. The literature mentions both equity and efficiency reasons for these equalization transfers (see Boadway (2004)). They may be an instrument for achieving horizontal equity among residents of different regions, that is, for ensuring that people can obtain comparable public services at comparable tax rates in all regions. Equalization might also serve as a stabilization device, insuring regions against adverse idiosyncratic shocks with which they may not be able to cope by themselves. Finally, equalization transfers may provide a more “level playing field” for interjurisdictional competition (Oates, 2006). My central thesis is that judicial independence is one of the key ingredients to ensuring that the transformative possibilities embodied in the Constitution become a reality for the majority of South Africans. Despite widespread approval of the principle of judicial review amongst legal scholars, many have warned that an unelected body sitting in judgment of the powers and functions of elected representatives may erode the basic tenets of democracy. This is particularly so in the case of economic or social policy where courts in their judgments may be at odds with the executive, the legislature and popular sentiment on these matters. Two issues that come to mind are the death penalty and procedural rights for the criminally accused, where evidence suggests that the Court's judgments are not viewed favorably by significant sections of the population. I argue that because of the lingering effects of authoritarianism, racism, sexism, and other forms of prejudice - cultural by-products of colonialism and apartheid - an independent judiciary may rise above these sentiments and ensure that South Africa remains committed to the promises of rights embodied in the Constitution. But my thesis also considers judicial independence in light of the racial and gender transformation of the judiciary. Across cultures and government systems, a variety of definitions of performance are in use among political and management actors, media and public opinion. The goal of this study is to use the occasion of a major public crisis or disaster (e.g. USA Bridge Collapse, Italian garbage crisis) to examine how, by whom and towards which directions performance expectations are established, altered and enforced during such episodes across countries. The acute nature of such crises, we believe, focuses the government and the public opinion on the foundation of performance expectations that permits a type of natural experiment amenable to investigative analysis. Its contribution to the literature is twofold: (1) It provides additional evidence that a microeconomic perspective of studying governance leads to a better understanding of key reform issues in many Sub Sahara African (SSA) economies; and (2) With regard to Ethiopia, the paper surmises that the overall standard of corporate governance is disappointing. More specifically, the legal and constitutional instruments do not provide adequate legislative; key international conventions and standards are not ratified; political parties own substantial number of business enterprises and operate in key sectors of the economy; ownership concentration through pyramid structure introduces particular problems of agency and creates crony capitalism; investor and creditor protection laws are inadequate; the absence of organized equity market is a serious void, and finally with regard to professional education, the increase in the number of tertiary institutions granting degrees and diplomas is not matched by sound quality standards. Using data for 18 OECD countries, it shows that partisan turnover systematically affects the long-run equilibrium mix of taxes and services. When partisan turnover is low, more right-wing influence permanently increases corporate tax revenue and the corporate share of pre-tax income; more left-wing influence, by contrast, permanently increases consumption tax revenue and social spending. When turnover is high, even powerful partisans do not increase taxes that disproportionately affect their supporters. When partisans tax their own supporters, they raise more revenue, even when we account for some plausible benefits. The flow of capital, however, has side effects on host economies' governance, among other things. Given the highly expected economic impacts, it has also becoming clear that the increased inflow of Foreign Direct Investment (FDI) and Official Development Aid (ODA) may have impacts on governance institutions of a host country. But the direction of the impact is not obvious. Knack and Rehman (2007) as well as Brautigam and Knack (2004) report negative association between foreign aid and governance indicators whereas Goldsmith (2001) indicates positive relationship between the two variable in Sub-Saharan Africa. Using data on governance indicators, FDI and ODA, the present study explores further whether FDI and ODA promote good governance in Africa during 1975-2002 to explain these conflicting results. Robert Springborg sees the need for the EU to clarify its policies towards the MENA region and Muslim democrats within it. The present lack of EU policies on engaging with moderate Islamists leads them to be at best curious about the EU and at worse to be suspicious of it. Following up on the recent studies by Stringham (2002, 2003), we focus our attention on the emergence of financial markets for several reasons. The common perception is that complicated financial instruments require state sanction to emerge. It is widely argued that in the absence of state regulation of of financial markets, cheating will be common. We maintain, in contrast, that the evidence does not support this pessimistic view. In fact, markets are capable of endogenously generating the rules that govern their operation and these rules discipline cheating severely.
