Rakib","doi":"10.33650/AT-TURAS.V6I1.547","DOIUrl":"https://doi.org/10.33650/AT-TURAS.V6I1.547","url":null,"abstract":"This research basically is to find the position of ‘urf as one of the theories that can provide legal changes in an authoritative-inclusive way to fiqh in the word khalwat in the definitive aspects of syar'iyyah in relation to culture of riding with fiancees in the Madura area. As an external consideration in cultural studies, ‘urf is one of the continuous theories with the discussion of adat to determine law in an authoritative-inclusive manner. In this study using a type of field research (field research) because it involves empirical data that views law as a set of behaviors, actions, and reality. In addition, also library research (library research) to obtain data about a norm while reviewing theories with a qualitative approach because it cannot be obtained by mathematical or numerical statistical procedures, so that it can contain about people's lives (culture), history, ethics, social movements , or family system. From the process of analyzing the meaning of khalwat using the theory of ma'na al-haml with the consideration of 'urf in which there are several elements of maslahat, this study concludes that' urf can change the position of Islamic law by combining consideration of several conditions through the process of changing meaning used in redefining the word khalwat. So as to enable culture to be engaged during the engagement period as happened in the Sumenep and Madura communities in general as a consideration of ‘valid urf. Buying the Air Berkah (Holy Water) from Habib Hasan Al Muhdor, a religios leader of Majelis Shalawat Ahbabul Musthofa, is a continuous tradition practiced by local Muslims at Widoro Krejengan Probolinggo. By observing this religious (or economic?) therapy, this study attempts to argue that they have been transmitting the material thing, money, into the blessing of the attendant spirit mediums. As they received blessing and magical item from the medium air berkah, they reached for wallets to make donation. This study goes to analyze the ways their stock of knowledge are constructed through ritualized practices of buying air berkah and the ways it reproduced the social structure of Krejengan community associated with their religious belief in the commodified item of blessing. Islam Nusantara, he said, is the typical style of Indonesian Islam. There are three main factors that accelerate the process of Islamization of the archipelago, one of which is the resilience of Islam that accommodate local values that do not conflict with the teachings of Islam. Insights and ideas keindonesiaan promoted by KH Zaini Mun'im about the problematics of propaganda Islamiyah, a similarity to Islam Nusantara, according to him, there are several factors which the problems of propaganda to the public which were related to propaganda material. According to him there are two kinds, namely the first; masyru material '(prescribed) such as faith, worship and discipline society. Second; ma'ruf means all actions that are useful and well-regarded, but not against the teachings of Islam, even can be done / done by the community, the opposite of evil. Their spirit of domination is philosophically based on Charles Darwin’s theory of evolution “The Survival of the Fittest” which later incarnates itself in social domain and is used to justify that their domination upon minority groups is a kind of natural selection process. When this idea is perceived continuously from generation to generation, minorities will be the everlasting disadvantaged victims of the other group’s domination and suffer persistent annihilation and oppression, extending from the most moderate form like prejudice to the most extreme one such as discrimination. Besides being intended to discuss the complicated relation between majority and minority groups and explore the significance of the spirit of domination in determining the dynamics of group relation, this study is also aimed at offering some alternative ways to create egalitarian atmosphere in a heterogeneous society. Indeed, such new future is not impossible to be reached as far as reconciliation process is consistently carried out by both groups.
