This study included in the research literature that examines the interpretation of the two scholars about Asyhur Al-Hurum, This research is descriptive analysis, and explore in depth the two letters panafsiran including QS. Al-Baqarah verse 216 and 217. In this study the authors found that of the two books I researched commentary is commentary Mutawalli Al-Sya'râWi works Mutawalli Al-Sya'râwi, and Tafsir of Sayyid Qutb authors found the view of the Quran against Al-Hur Asyhurum Based on the interpretation of the second cleric to surah al Baqarah verse 216 and 217. They all suggested that the prohibition of war in hurumand the prohibition of murder is very relevant today. This is related to the security of the travel process prospective pilgrims and the moments when the hajj. Because the basis of the state can be positioned as a reference for the compilation of a constitution. Since being positioned as the basis of the state, its position has been shaken due to the feud between Islamic intellectuals in responding to problems with the form and system of government in Indonesia. In fact, for a country, building the foundation of the state or the basis of state philosophy (philosofische grondslog) is a fundamental thing. In these three disputes, there are paradigm patterns, namely the fundamentalist paradigm (intending to implement Islamic law as an Islamic state), the reform paradigm (only inserting substantial religious values into the government system), and the accommodationist paradigm (cooperative with existing governments). These three paradigms have always adorned the zones of Islamic political thought in Indonesia. This paper aims to produce Islamic thinkers who accept the position of Pancasila with the nationalist Sufi initials. Because a Sufi is a Muslim who is more deeply Islamic. Along with these developments, positivistic epistemology has mastered the science and the study of the philosophy of science in almost all regions. Thus giving birth to new paradigms and discoveries. Even so, there are still several problems. With this remaining problem, it gave birth to thinkers in the twentieth century who wanted new studies in the philosophy of science, such as Karl R. Poper (1902-1994) with three main themes, namely, the issue of induction, problems and standards and problems of the third world, and Thoma S. Kuhn (1922-1996) came up with a revolutionary idea of science which was marked by the process of shifting the old paradigm to the new one. But in between, Imre Lakatos comes with the Methodology of Scientific Research Programs which contains several important elements, first, the Core Program (hard-core), which is the basis of the Lakatos methodology which is the initial assumption of research or scientific research that cannot be replaced or modified. Second, the protective circle (protective belt), this function is to withstand various attacks, testing and obtaining adjustments, even changes, and understanding, to defend the hardcore. Third, a series of theories, namely the relationship between the theory and the next theory, which is the result of the auxiliary clauses added from the previous theory. These three elements have their respective duties and roles in developing science. The conflict can sometimes be resolved peacefully, but not the least that ends in divorce. The divorce process is arranged, must go through the trial process of the Religious Court with the specified procedural law. The proceedings for a lawsuit in the Religious Court must go through a mediation process between the two parties. Mediation is a way in the process of resolving disputes outside the trial in the presence of a third party tasked with reconciling the parties. Mediation is a mandate of the law to be carried out, so that the proceedings in court can be in accordance with the principle, which is fast, simple and inexpensive. The necessity of conducting mediation in a court, especially a religious court, is to reduce the number of divorces which is increasing in number over the years. Solving problems through mediation, is also a manifestation of maqashid al-shariah, namely hifdz al-nasl, because when there are problems in marriage, the marriage relationship will be damaged and problems will occur. Following up on the maqashid, in Indonesia there was a requirement to carry out mediation in the settlement of every case that went to court. The main objective is to minimize cases that must be decided, so that mediation can be resolved peacefully and safely. The purpose is to describe the process of planning, organizing, implementing, and supervising madrasas in realizing character education for students at MTsN Bondowoso II. This study uses a qualitative approach, with descriptive analysis methods. Data collection is done by using quasi observation techniques, participation, interview and documentation. Data analysis techniques used are data reduction, data presentation, and conclusion. Checking the validity of the findings is done by means of peer discussion and triangulation techniques that use source triangulation and methods/techniques. The results of this study that madrasah management process in realizing character education at MTsN Bondowoso II was implemented through four aspects/four management functions, namely planning in the form of a madrasah activity program plan, organizing in the form of division of tasks for all teachers and madrasah staff to realize the program activities, implementation in the form of implementation from the program plan for madrasah activities, and supervision in the form of evaluating all performance in implementing the madrasah program, which are four aspects integrated with character values that can be used as role models for students. The problems that arise from this study are, First, what is the legal foundation of judge in resolving divorce claims in religious courts using simple, fast and low-cost judicial principles? Second, what are the legal considerations of religious courts in examining, hearing, and deciding divorce cases in religious courts? The research method uses a normative juridical approach. The results of the study show that: First, the principle of justice is simple, fast, and low cost refers to Law No. 4 of 2004 concerning Judicial Power article 4 paragraph (2), and article 5 paragraph (2). Also contained in Law No. 7 of 1989 in article 57 paragraph (3), as well as in article 58 paragraph (2). Second: The legal considerations of the extreme religious court in rejecting a divorce lawsuit in a religious court are in accordance with the legal basis of state legislation and syar'i law. Considering, based on the testimonies of the witnesses, that the dispute between the plaintiff and the defendant only happened once, so that it did not meet the criteria of article 19 letter C, namely continuous disputes and arguments so that there was no hope of living in harmony again.
