The presence of this arrangement provides certainty to the workforce who are people who can do work to produce goods and services both to meet their own needs and for the community. However, over time, there were several changes to the regulations with the presence of the Job Creation Act which reduced the labor guarantee. In this regard, the author will examine several problems, namely: how is the protection of old-age insurance in the social security system for workers in Indonesia, how is the application of the rules for the protection of old-age insurance to the participation of household assistants who work for individual employers, what appears in providing this old-age insurance protection for household assistants, and what efforts will be made by the Manpower Office in embracing household assistants to become participants in the old-age insurance protection. With the presence of several problems that will be studied by the author using a normative juridical research method that will focus on labor legislation, this is also strengthened by a qualitative approach method. In fact, these two elements are manifestations and crystallizations of the ideal idea of ​​democracy. In a democracy, public participation is a condition sine qua non. Without public participation in the process of making laws, it will only result in authoritarian regulations and bias against the true meaning of democracy. So that it will result in the formation of laws that are not sourced from the soul and legal needs of the community (volkgeist). The method in this study uses legal research methods with a qualitative approach in the form of normative legal studies and (normative legal studies), where the type of research is descriptive analytical research. In addition, the approach used is a comparative approach (comparison), a historical approach, an institutional approach and a futuristic approach. Community participation in the formation of laws in Indonesia, South Africa and the United States has already started. Although public participation in law-making has some constraints such as slowdown in the legislative process and budgetary requirements, it brings more benefits to the government and society. This is closely tied to the establishment, evolution, and dissolution of such institutions. As a consequence, the President and the DPR will be capable of determining responsive and constitutional legal politics. This legal policy study focuses on how the growth and regulation of state ministries and state institutions were connected to the constitutional system's establishment, modification, and dissolution. Second, how can legal politics address this in a manner that seems to be constitutional? The objective of this study is to assess the arrangements pertaining to the formation, alteration, and dissolution of ministries and state institutions under the constitutional system in order to define the ideal political legislation.This research uses normative legal research methods with descriptive research specifications and is analyzed through library research and data analysis methods using juridical-qualitative. The results of the research and discussion in this study include: First, the arrangements regarding the formation, modification, and dissolution of ministries and state institutions do not yet have a clear legal basis so that the President as the holder of power, is irregular in issuing his policies. Political rights are one of the fundamental rights that must be upheld and safeguarded by the State, the law, and the government. The Criminal Code's provision of criminal penalties for the elimination of political rights in Article 35 (1) (3), where the electoral process and electoral laws are founded, proves to conflict with the State's mission for the preservation and maintenance of political rights. Menurut pendapat para ahli, Arbitrase merupakan salah satu cara penyelesaian sengketa yang melibatkan pihak-pihak yang bersengketa untuk sepakat dalam memilih hakim atau para hakim yang akan mengambil keputusan, dan para pihak juga harus sepakat untuk menghormati keputusan yang diambil oleh hakim tersebut. Hingga saat ini masih dominannya penyelesaian sengketa para pihak melalui peradilan (litigation) meskipun penyelesaian alternatif sengketa (non-litigation) sudah diatur melalui peraturan perundang-undangan. The research methodology employed in this article is a literature review. This article presents research data in the form of studies of policy implementation and authoritative documents such as laws and regulations, court decisions, and strategic plans of the tax authorities about tax criminal investigations. This article argues that several components must be considered in the policy implementation process associated with the mechanism for terminating tax criminal investigations, namely context, policy focus lens, innovation, levers of influence, facilitator or inhibitor, impact, policy actor, or leader of policy implementation. In 2014 the International Court of Justice issued a ruling that the Japanese Antarctic Research Program II was not included in the provisions of Article 8 paragraph 1 of the International Convention for the Regulation of Whaling 1946, caused the Japanese Antarctic Research Program II to violate international environmental law. The purpose of this study was to determine the existence of the Japanese Antarctic Research Program II based on the perspective of international environmental law and to determine the responsibility of the Japanese state in scientific whaling activities based on the perspective of international environmental law. This type of research is normative legal research using a case approach by conducting a study based on the decision of the International Court of Justice No. 226 of 2014 (Australia v. Japan: New Zealand Intervening). The results of this study, the existence of a special permit for Japanese Antarctic Research Program II is allowed under the provisions of the International Convention for the Regulation of Whaling 1946 and the review of the scientific committee of the International Whaling Commission, but in practice the special permit for this research is not in accordance with the research plan and has many weaknesses so that the Japanese Antarctic Research Program II does not include a special permit for scientific research as contained in Article 8 paragraph 1 of the International Convention of the Regulation of Whaling 1946. The restorative settlement model has been practiced by the criminal justice sub-system ranging from the police, prosecutors to the courts. Restorative settlement is the concept of a settlement where the interested parties meet to resolve the issue together how to resolve the consequences of the violation in the interest of the common future as well. Nowadays new ideas are emerging that the crime of corruption can be solved through restoratife justice. However, there is a need for studies on the application of restoratife justice for corruption crimes both from the aspect of Indonesian criminal law and from the aspect of Islamic law. This research is a normative research that is descriptive-comparative. That is to provide an overview of the application of Restorative Justice in corruption crimes by comparing them according to Indonesian criminal law and Islamic law. The data used are secondary data consisting of primary, secondary and tertiary legal materials. The analysis stage starts from data collection, data processing and finally the presentation of data by pulling deductively knots. The application of restoratife justice in the typist because it has no juridical legal basis, the prosecutor or the police and even the court has no right to represent the victims of state losses, but the community is more entitled. If you really want a restorative application to the crime of corruption, then there is a need for mekenism that must involve public figures more broadly. Similarly, in Islam, corruption is not the same as murder which allows for diyat. One of the development is the Spotify application service. The application has made it easier to enjoy of work of song. Even though the song and music works have been protected in the Copywrite Law, the development has also caused the rise of copywriting violations. This article explores the legal protection for the Spotify application for song copyrighted works in the form of a barcode on the Spotify application for commercial purposes and the legal settlement regarding song copyrighted works in the form of a barcode on the Spotify application for commercial purposes. The research applied normative legal research with the statute, conceptual, and case study approach. The data collected are secondary data and primary which collected from library studies and field studies and analyzed descriptively and qualitatively. The study concludes that in practice legal protection in song and/or music copyrighted works can not be claimed and can not be protected because there is no recording of the results modified into acrylic products. Royalties can not be paid to creators and/or copyright holders though the infringement has been done and it has violated both moral rights and economic rights. This research applies the juridical normative method to literature studies. The data which is presented in this research is secondary data. The findings show that the protection over works on songs in Indonesia has been provided by Law No. 28, 2014 concerning Copyrights. The law states that a song is one protected intellectual property. In its practice, the protection over copyright follows the automatic protection system, which means that the protection is without the process of recordation. The legal consequence is that every person who illegally commits a copyright crime, either for economic rights or for commercial use, shall face criminal sanction. Besides, the other parties other than the creator can be prohibited to exploit the creator’s economic rights.
