Aswari","doi":"10.24843/kp.2020.v42.i02.p05","DOIUrl":"https://doi.org/10.24843/kp.2020.v42.i02.p05","url":null,"abstract":"Ketimpangan kualitas antara perlindungan hukum dan penegakan hukum menjadi fokusbahasan artikel ini dalam mengungkap jejak-jejak digital disetiap langkah proses transaksi jual beli di market place, demi menciptakan keamanan berbelanja pada setiap situs jual beli yang menggunakan metode bertransaksi yang hampir seragam. Artikel ini merupakan penelitian hukum dengan pendekatan konseptual yang menggambarkan batasan teori hukum yang berlaku dalam transaksi secara elektronik. Hasil penelitian menunjukkan bahwa bentuk prosedur bertransaksi yang inovasinya mulai melambat, disaat kebutuhan peningkatan keamanan dalam bertransaksi online masih sangat dibutuhkan. Proses bertransaksi aman telah menghadirkan lebih banyak informasi yang dapat dijadikan electronic evidence dalam penyelesaian sengketa, sehingga grafik perlindungan hukum terus mengalami peningkatan dan dipandang cukup memberikan rasa aman bagi setiap pihak yang terkait dalam sebuah transaksi jual beli di marketplace. Perwujudan perlindungan hukum dalam bentuk penegakan hukum ternyata tidak mampu mengimbangi grafik capaian perlindungan hukum yang ditandai dengan minimnya pemanfaatan bukti dari jejak-jejak digital. Oleh karenanya terdapat ketidakberfungsian peran alat bukti dalam menyelesaikan sengketa, ditengah lambatnya pertumbuhan kuantitas dan kualitas bentuk masyarakat informasi beserta penegakan hukum yang handal diera pemanfaatan sistem elektronik dalam melakukan perbuatan hukum. This learning method as a framework initiated by John Dewey as the achievement of progressive legal education, especially in criminal justice practices. The purpose of this learning method is to provide students with a deepening of criminal justice both based on theory and practice as well as provide opportunities for students to carry out the criminal trial practice by taking examples of criminal case decisions that have obtained permanent legal force. This paper specifically discovers, studies, analyzes and provides deepening related to criminal justice based on theory and practice for law students at the level of the Bachelor of Law program to obtain a progressive legal educationThe method used in this paper is empirical legal research method using primary data and secondary data based on a purposive sampling model with deep-interview concerning the practice of the moot court in law higher education. The results of this study indicate that students have gained a deepening of criminal procedural law, particularly in the implementation of criminal justice guided by supervisors and legal practitioners as tutors and instructors. Injustice, in fact, is one of the lowest value attitudes of judges according to Judicial Commission assessment results. Indeed, showing justice is not easy for judges but to date in its development appears restorative justice that provides justice for all parties. Its future existence and response are interesting to be criticized. Based on this, the purpose of this study is to examine the paradigm of restorative justice in making legal decisions of judges on legal cases and the construction of the judges’ decisions which are paradigmatic in Restorative Justice. This research uses normative legal research with four types of approaches, which are case approach, legislative approach, conceptual approach, historical approach, and comparative approach. The results of the study show the restorative justice paradigm prioritizing restoration or amelioration will seek to provide justice, certainty and usefulness of the law, as well as realize progressive and responsive laws, and this makes it appropriate to be used as a judge’s paradigm in deciding a case. In constructing restorative justice-based judges’ decisions, judges do only make decisions based on the Criminal Procedure Code (KUHAP), but substantially, through the restorative justice paradigm the judges will consider justice for all parties (victims, perpetrators of crime, and the public). Judges do not make decisions based on retributive or retaliation goals but hold on to the values, concepts, principles, and basics of restorative justice prioritizing restoration or amelioration of the parties, meeting the needs of the parties, and prioritizing expediency. \u0000 \u0000Discriminatory treatments of judges have dominated the reports to the Judicial Commission. Kabupaten Malang memiliki produk kopi yang ditanam di lereng semeru yang telah diekspor ke luar negeri. Kabupaten Malang sampai pada saat ini belum mendaftarkan satupun produk unggulan pertanian yang memiliki indikasi geografis (IG). Persoalan yang dikaji dalam artikel ini adalah upaya apakah yang sudah dilakukan pemerintah daerah Kabupaten Malang guna memberikan perlindungan hukum dalam bentuk pendaftaran IG bagi masyarakat petani kopi lereng semeru dalam menghadapi pasar bebas ASEAN Economic Community dan bagaimanakah upaya tersebut ditinjau dalam perspektif keadilan. Artikel ini merupakan penelitian yuridis sosiologis dengan pendekatankualitatif. Upaya yang sudah dilakukan oleh Pemerintah Daerah Kabupaten Malang dalam memberikan perlindungan hukum bagi masyarakat petani lokal adalah pada tahun 2015mengajukan penganggaran pendaftaran IG Kopi Robusta lereng semeru kepada Bupati, namun belum mendapatkan persetujuan dari Dewan Perwakilan Rakyat Daerah (DPRD) Kabupaten Malang.Upaya pemerintah daerah dalam memberikan perlindungan kopi lereng Semeru sebagai kekayaan masyarakat tradisional melalui IG merupakan upaya memberikan keadilan bagi masyarakat lokal. Artikel ini bertujuan untuk menyajikan analisis mengenai penyelenggaraan pemerintahan dalam konteks negara hukum Indonesia yang secara khusus mencermati kewenangan dan signifikansi pembatalan peraturan daerah. Artikel ini disusun dengan menggunakan penelitian hukum normatif yang menggunakan pendekatan peraturan perundang-undangan, pendekatan kasus, dan pendekatan konsep. Dalam rangka pelaksanaan tugasnya di bidang tersebut, polisi menerapkan pemolisian masyarakat melalui kemitraan anggota Polri dan masyarakat. Artikel ini bertujuan untuk menganalisis penerapan Peraturan Kapolri Nomor 3 Tahun 2015 Tentang Pemolisian Masyarakat dalam Penegakan Hukum di Provinsi Gorontalo yang disusun melalui suatu penelitian yuridis-empiris. Hasil penelitian menunjukkan bahwa penerapan peraturan kapolri tersebut belum sepenuhnya dijalankan karena minimnya jumlah anggota kepolisian yang ditugaskan ke masing-masing wilayah kerja. Guna mendukung penegakan hukum di Provinsi Gorontalo, kemudian dibentuk Polisi Masyarakat (Polmas) di masing-masing wilayah atau desa/kelurahan. Penelitian ini menggunakan penelitian yuridis normatif melalui pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa legitimasi hak angket DPR RI terhadap Komisi Pemberantasan Korupsi tidak hanya berdasarkan putusan Mahkamah Konstitusi Nomor 36/PUU-XV/2017, namun harus memenuhi unsur-unsur sebagaimana Pasal 79 ayat (3), Pasal 199, dan Pasal 201 Ayat (2) Undang-Undang Nomor 17 Tahun 2014. Youtube tidak hanya mengikat orang dewasa yang menjadi mitra youtube namun anak juga menjadi mitra youtube. Keabsahan kontrak mitra youtube terhadap anak menjadi permasalahan dan akibat hukum terhadap kontrak yang dilakukan oleh anak. Tujuan penulisan ini untuk mengkaji tentang keabsahan kontrak kemitraan yang dilakukan oleh youtube kepada anak yang tidak cakap menurut pasal 47 Peraturan Pemerintah Republik Indonesia Nomor 82 Tahun 2012 dan mengetahui akibat hukum dari kontrak kemitraan yang dilakukan oleh anak, metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan. Hasil studi menunjukkan bahwa Kontrak kemitraan youtube kepada anak sebagai mitra youtube dengan media elektronik harus sesuai dengan pasal 47 Peraturan Pemerintah Republik Indonesia Nomor 82 Tahun 2012 dan pasal 1320 KUH Perdata dimana kecakapan adalah salah satu syarat untuk kontrak elektronik dianggap sah , apabila tidak memenuhi syarat-syarat maka kontrak kemitraan melalui media elektronik adalah tidak sah. Akibat hukum kontrak mitra melalui media elektronik yang dilakukan oleh anak adalah dapat dibatalkan melalui pengadilan untuk membatalkan kontrak tersebut. China has constantly denied the conduct of gross human rights violations of Uighur moslems within Xinjiang political reeducation camps. This article will elaborate on the actions done by Xinjiang officials to unveil the gross violations of human rights towards the Uighurs within Xinjiang reeducation camps. The article will also examine the available possibility to criminally hold the perpetrators liable and provide effective relief to the victims. This article is constructed using normative legal research method with statutory, case, and fact approaches, along with conceptual/analytical approach. The result shows that there exist gross violations of human rights towards the Uighurs within Xinjiang reeducation camps in a form of arbitrary detention and torture.
