How to understand the symbolic (semiotic) meaning of using the awliya word in al-Maidah 51 in the context of leadership politics in Indonesia? To answer that question, this study uses literature (library research) by asking for semiotics. The results of the study state that the meaning of awliya is QS. Special Al-Maidah 51 in a semiotik manner is tentative, open, and plural because of the nature of language that is not always arbitrary and universal (multiplicity meaning). Signifiers are very influenced by the background of institutional structure, paradigm, and the basis of political stretcher or their support. At the paradigmatic level, both symbolic (textual and contextual) meanings of awliya have a basis for scientific epistemology. While the aspects of his semiotic pragmatism (Peirce) can be measured determine to what extent Awliya's symbolic meanings is effective and followed by Muslims as part of citizenship; and how far awliya is accommodated in the instruments of the state legal system (legislation). Mengapa QS. al-Maidah 51 kerap dijadikan referensi menentukan legitimasi dan justifikasi kepemimpinan jabatan Pemerintahan? Bagaimana memahami makna simbolik (semiotik) penggunaan kata awliya’ dalam al-Maidah 51 itu dalam konteks politik kepemimpinan di Indonesia? Untuk menjawab pertanyaan itu, kajian ini menggunakan kajian pustaka (library research) dengan pendekatan semiotik. Hasil penelitian menunjukkan bahwa pemaknaan awliya’ QS. al-Maidah 51 secara semiotik bersifat tentatif, terbuka, dan plural karena sifat langue yang tidak slalu arbitrer dan universal (multiplicity meaning). Pemberi makna (signified) sangat dipengaruhi oleh latar struktur institusi, paradigma, dan basis politik usungan atau dukungannya. Pada level paradigmatik, kedua makna simbolik (tekstual dan kontekstual) awliya’ memiliki basis epistemologi keilmuan. The rights and obligations of each party arise because of the legal relationship resulting from this therapeutic transaction. For doctors, patients have obligations as well as rights. Likewise, conversely, doctors also have rights and obligations to patients. An equal position between doctors and patients places both as legal subjects. Each subject matter in this position has rights and obligations that must be respected. Lawsuits from parties who feel that their rights are impaired or their interests are in the aftermath of disharmony in the legal relationship between the two parties due to the denial of the obligations of each party. The relationship between doctors and patients / sufferers in the agreement adopted is now carried out in an atmosphere of mutual trust ( confidence ), which is filled with emotions, hopes, and worries of human beings. This paper aims to examine the legal relationship between doctors and patients in therapeutic transactions, and how the legal relationship between doctors and patients is in the perspective of the Consumer Protection Act. In the event of problems in therapeutic transactions or malpractice, then the legal basis for using doctors is inappropriate when using Law Number 8 of 1999 concerning Consumer Protection (UUPK), but Law No. 29 of 2004 concerning Medical Practice or Law No. 36 of 2009 concerning Health. The controversy that has arisen in the application of the UUPK to the context of the relationship between doctors and patients has become one of the drivers of the emergence of the Law on Medical Practice. Doctors' professional services are different from other services as referred to in the UUPK, because the doctor's professional services are closely related to professional ethics. Therefore patients cannot be categorized as consumers based on UUPK. Transaksi terapeutik merupakan perjanjian antara dokter dengan pasien dimana dengan perjanjian ini dokter mempunyai kewenangan untuk memberikan pelayanan kesehatan yang dibutuhkan pasien. Hak dan kewajiban masing-masing pihak timbul karena adanya hubungan hukum akibat  transaksi terapeutik ini. Terhadap dokter, pasien mempunyai kewajiban sekaligus hak. Begitu pula sebaliknya dokter juga mempunyai hak dan kewajiban terhadap pasien. Kedudukan yang sejajar antara dokter dan pasien menempatkan keduanya sebagai subyek hukum. Masing-masing subyek hokum dalam kedudukan inimempunyai hak dan kewajiban yang harus dihormati.Tuntutan hukum dari pihak yang merasa dirugikan haknya atau kepentingannya menjadi buntut atas ketidakharmonisan hubungan hukum antara kedua  belah  pihak  akibat  pengingkaran pelaksanaan kewajiban dari masing-masing pihak. The study uses a qualitative constructivism paradigm with a socio-legal approach to inductive logic. While the research location was in Lampung Province, especially in the Regency; North Lampung, Central Lampung, City of Metro. Primary data is collected through interviews, and equipped with secondary data and observations. The data is then processed and analyzed by qualitative description with content analysis techniques. The results of the study in this study itself are; First, the role of bureaucrats in the Lampung Provincial Government in establishing micro-business legal policies has not been maximized, especially in the implementation of initiation processes, public consultations, and participatory participation of stakeholders. Second, legal policy can be reconstructed if there is strong political will from bureaucrats, forming a small team to conduct aspirations and mobilize participation . Tujuan penelitian ini adal a h untuk memperoleh pemahaman dan analisis yang mendalam mengenai peran P emerintah Provinsi Lampung terkait penumbuhan iklim usaha mikro, agar mampu merekonstruksi kebijakan hukum yang menumbuhkan  iklim usaha dan mikro yang berkeadilan. P enelitian menggunakan paradigma kontruktivisme kualitatif dengan pendekatan socio - legal logika induktif. Sementara l okasi penelitian berada di Provinsi Lampung, khususnya di Kabupaten; Lampung Utara, Lampung Tengah, Kota Metro.  Data primer dikumpulkan melalui wawancara, dan dilengkapi dengan data sekunder dan observasi. Data selanjutnya diolah serta dianalisis secara deskripsi kualitatif dengan teknik analisis isi . Hasil kajian dalam penelitian ini sendiri adalah; Pertama, peran birokrat di Pemerintah Provinsi Lampung dalam menetapkan kebijakan hukum usaha mikro belum maksimal terutama dalam pelaksanaan proses inisiasi, konsultasi publik, sinergitas partisipasipatif stakeholders. The significance of Islamic values and local wisdom in efforts to reform Criminal Law is beneficial for the formation of more aspirational national criminal laws that are in accordance with the socio-cultural conditions of Indonesian people by not ignoring the values of their religious teachings, using theories, concepts, principles and legal interpretation so that the Criminal Law reform is realized to suit the needs of the society . Ali","doi":"10.21154/JUSTICIA.V16I1.1499","DOIUrl":"https://doi.org/10.21154/JUSTICIA.V16I1.1499","url":null,"abstract":"This article aims to investigate about false information as a case of obstruction of justice, here the author uses a type of normative juridical writing with a legislative approach, conceptual approach and case approach, this is the background of the defendant or witness giving information in the trial as proof, but in the process of giving information it turns out that there is a problem, namely the defendant or witness gave a false statement in court, this will certainly hinder the ongoing verification process and the judge or public prosecutor becomes difficult to find material truth. Therefore, the results of this paper state that false information as stipulated in Article 22 of Law Number 31 Year 1999 jo Law Number 20 Year 2001 concerning Eradication of Criminal Acts of Corruption is part of the obstruction of justice because false statements in the trial resulted in the disruption of the trial process and required a long time in the trial process even though it was not directly a consequence, so that the public prosecutor of corruption could enforce Article 21 of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 concerning Eradication of Criminal Acts concerning obstruction of justice or obstruction . Artikel ini bertujuan menganalisis mengenai keterangan palsu sebagai salah satu kasus obstruction of justice atau perbuatan menghalang-halangi , disini penulis menggunakan jenis penulisan yuridis normatif dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus, hal ini di latarbelakangin oleh terdakwa atau saksi memberikan keterangan di persidangan sebagai pembuktian namun dalam proses pemberian keterangan ternyata terdapat permasalahan yakni terdakwa atau saksi memberikan keterangan palsu dipersidangan, hal ini tentunya akan menghambat proses pembuktian yang sedang berjalan dan hakim atau penuntut umum menjadi sulit untuk mencari kebenaran materiil. Nowadays, it is familiar instead of natural marriage, couples sign contracts only on paper. The parties do not intend the paper marriage to the marriage, but the parties agree on non-cohabitation either expressly or implicitly. Sharia is not permissible to conclude a marriage contract without marriage intention, and it is illegal and considered a crime in law. In case a man and a woman claim that they are a couple. This type is a claim that bears the truth and lies, and marriage is not held in both cases. Regarding visual marriage with affirmation and acceptance but without the intention of marriage, a group of contemporary scholars subjoined this type of marriage to the joking (hazl) marriage. The majority of the Hanafis scholars, Malikis, Shaafa'is, and Hanbalis, believe that it is a valid marriage that has its effects, the same as in the marriage of joking. However, another view of the Malikis in the joking marriage is that it is not valid and does not have any effects. Temporary marriage would be a mut'ah marriage if the man appeared his attempt to divorce. Finally, the researcher supports the fatwa that stated paper marriage is more like tahlil marriage, which is not meant to be valid. Cara termudah untuk mendapatkan tempat tinggal di negara-negara maju adalah melalui pernikahan dengan penduduk negara-negara maju. Saat ini, sudah umum terjadi fenomena bukan pernikahan nyata, namun pasangan menandatangani kontrak hanya di atas kertas. Akta nikah tidak dimaksudkan oleh para pihak sebagai fakta perkawinan, tetapi para pihak menyetujui bukan tentang tinggal serumah (kohabitasi) baik secara tersurat maupun tersirat. Dalam Syariah tidak diperbolehkan untuk menandatangani kontrak pernikahan tanpa niat menikah, hal itu dianggap ilegal dan dianggap sebagai kejahatan dalam hukum. Dalam kasus seorang pria dan wanita mengklaim bahwa mereka adalah pasangan. Jenis ini adalah klaim yang mengandung kebenaran dan kebohongan, dan pernikahan tidak dilakukan dalam kedua kasus tersebut. The Directive Principle of State Policy has become a main issue lately which continues to roll over as needed for a realignment of the national development planning system in the Indonesian constitutional system. However, this issue raises pros and cons of the Directive Principle of State Policy which is deemed incompatible with the Indonesian constitutional system after the amendment of the 1945 Constitution. Therefore, to see the compatibility of the Directive Principle of State Policy with the Indonesian constitutional system needs to reclaim the essence of the Directive Principle of State Policy by exploring the original intent of term from the founders of the nation. Through the Pancasila state philosophy approach, it can be seen that there are three basic state consensus agreed upon by the founders of the nation as an effort to realize the goals of the state, called as triangel of basic state consensus . They are Pancasila as the basis of the state philosophy (philosofische grondslag), the 1945 Constitution of the Republic of Indonesia as a basic state law, and the Directive Principle of State Policy as a guideline for the state's basic policies. The important elements of the Directive Principle of State Policy is the existence of directive principles as a guideline that directs a state policy or as a guiding principle in describing the state philosophy and the mandate of the constitution into state development policies and into legislation. Tulisan ini bertujuan untuk menelaah hakikat Haluan Negara dalam sistem ketatanegaraan Indonesia dengan pendekatan filsafat kenegaraan, dengan berbasis pada filsafat kenegaraan Pancasila. Haluan Negara menjadi tema sentral akhir-akhir ini yang terus bergulir seiring kebutuhan akan penataan kembali sistem perencanaan pembangunan nasional dalam sistem ketatanegaraan Indonesia. Namun keberadaannya menuai pro kontra yang dirasa tidak sesuai dengan sistem ketatanegaraan Indonesia pasca amandemen UUD 1945. Karena itu, untuk melihat ketersesuian Haluan Negara dengan sistem ketatanegaraan Indonesia perlu didudukkan kembali hakikat Haluan Negara dengan menggali maksud (original intent) Haluan Negara dari para pendiri bangsa. Using qualitative methods, and participatory approaches, this study produced several findings: First, wealth jihad according to members of the Tablighi Jamaat is an important and important thing. Second, the meaning of economic welfare according to members of the Tablighi Jamaah is when a person can live peacefully with his family even with simple needs. Third, the implication of the existence of wealth jihad against the economic welfare of the family of the Tabligh Jama'at is that they must issue assets to fight in the way of Allah, but they do not feel deficient. In the perspective of Max Weber's action theory, the actions of wealth jihad and economic well-being carried out by the Jamaah Tabligh group can be categorized as goal-oriented actions (Rational Instrumentally), Value-oriented actions, Affective / especially emotional actions and traditional action . Artikel ini bertujuan mengkaji fenomena jihad harta dan kesejahteraan ekonomi keluarga dikalangan kelompok Jamaah Tabligh di Desa Sidoharjo Ponorogo dikaitkan dengan teori tindakan sosial Max Weber, sehingga memberikan pemaknaan yang holistik tentang makna jihad harta dan kesejahteraan ekonomi. Dengan menggunakan metode kualitatif, dan pendekatan partisipatif, kajian ini menghasilkan beberapa temuan: Pertama , jihad harta menurut anggota Jamaah Tabligh merupakan suatu hal yang penting dan utama. Kedua , makna kesejahteraan ekonomi menurut anggota Jamaah Tabligh adalah ketika seseorang dapat hidup dengan damai bersama keluarga meskipun dengan kebutuhan yang sederhana. Ketiga , implikasi dari adanya jihad harta terhadap kesejahteraan ekonomi keluarga Jamaah Tabligh adalah mereka harus mengeluarkan harta untuk berjuang di jalan Allah, akan tetapi mereka tidak merasa kekurangan. Ikhsan","doi":"10.21154/JUSTICIA.V16I1.1535","DOIUrl":"https://doi.org/10.21154/JUSTICIA.V16I1.1535","url":null,"abstract":"The freedom to embrace a religion and belief and worshiping are the rights of each citizen protected by the constitution, including the Dhimmi minority, as the state authorities have issued a Joint Regulation Number 8 and 9 of 2006 on the Guideline of Empowering the Forum of Religious Harmony and Constructing Worship House. Ironically, instead of giving the sense of justice for all society elements, regulations are deemed to limit the activity of worshiping of dhimmi minority. In realizing the equal rights to worship and constructing the house of worship for the Dhimmi minority, the Regulation should be submitted to the Supreme Court to undergo juridical review. The suggestions utilized to review several articles are considered as discriminating us the society's actualization on the government’s product of law. This piece of writing explored the problems of constructing the house of worshiping the context of the rights to worship for dhimmi minority through the Quran's perspective. The conception of the Qur'an generated is reflected in the idea of the jurisprudence of human rights, which strives for establishing the equality of rights to worship for citizens. The jurisprudence of human rights is expected to raise social awareness to appreciate and respect the worshiping activities of dhimmi minority, reducing the retention of inter-religious violence, and creating a harmonious life based on the principles of Islamic law in Maqasid al-Syariah.Kebebasan memeluk agama dan keyakinan serta menjalankan peribadatannya merupakan hak asasi setiap warga negara yang dilindungi oleh konstitusi, termasuk bagi minoritas dhimmi. Pemerintah sebagai pemegang kekuasaan negara telah mengeluarkan Peraturan Bersama Menteri Agama dan Menteri Dalam Negeri Nomor 8 dan 9 Tahun 2006 tentang Pedoman Pemberdayaan Forum Kerukunan Umat Beragama dan Pendirian Rumah Ibadah. Ironisnya, Peraturan yang sejatinya memberi rasa keadilan bagi seluruh elemen masyarakat, justru terkesan membatasi aktivitas peribadatan minoritas dhimmi. Untuk mewujudkan kesamaan hak beribadah dan mendirikan rumah ibadah bagi minoritas dhimmi, Peraturan tersebut perlu diajukan ke meja Mahkamah Agung guna menjalani judicial review. Usulan untuk meninjau kembali beberapa pasal yang dianggap diskriminasi tersebut merupakan wujud pengawasan masyarakat terhadap produk hukum Pemerintah. Tulisan ini mengkaji problematika pendirian rumah ibadah dalam konteks hak beribadah minoritas dhimmi melalui perspektif Alquran. Konsepsi Alquran yang dihasilkan dituangkan dalam gagasan fikih HAM yang berupaya untuk membangun kesetaraan hak beribadah bagi warga negara. Departing from the theory of Khaled Abu Fadl, this paper tries to examine more in line with why HTI was dissolved. The main focus is on the emergence of the dissolution decision, is government authority or unilateral decision needed? To answer , the author uses maqashid's analysis as a way to understand what the government wants to agree on regarding the dissolution. Based on observations and studies of data in literary studies, it was concluded that the dissolution was carried out not with the help of the NKRI but also regarding the security of the mission. Based on this argument, the dissolution of HTI is the government as the authority holder, not authoritarianism caused by the DPR (legislative body), the MA (judiciary), and several religious leaders Satu hal yang tidak dapat dipungkiri bahwa meskipun HTI telah resmi dibubarkan, doktrin ideologi mereka tidak mungkin berhenti begitu saja. Berangkat dari teori Khaled Abu Fadl, tulisan ini berusaha menelaah lebih dalam mengapa HTI dibubarkan. Fokus utama diarahkan pada kemunculan keputusan pembubaran tersebut, apakah sebagai bentuk otoritas pemerintah atau keputusan sepihak (otoritarianisme)? Untuk menjawab hal ini, penulis menggunakan analisis maqashid sebagai cara untuk memahami apa yang ingin dicapai oleh pemerintah terkait pembubaran itu. Berdasarkan pengamatan dan kajian data dalam literarur research, Disimpulkan bahwa pembubaran dilakukan tidak semata dalam upaya menjaga NKRI tetapi juga menjaga stabilitas visi misi dan kinerja pemerintahan.
